MINUTES
OLD LYME INLAND WETLANDS AND WATERCOURSES COMMISSION
REGULAR MEETING
JULY 25, 2017


PRESENT WERE:  Skip DiCamillo, Tom Machnik, Rachel Gaudio, Bob DePianta, and Evan Griswold.  Also present were Keith Rosenfeld and Kim Groves.

MINUTES OF MEETING DATED JUNE 25, 2017

Tom Machnik made a motion to approve the Regular Meeting Minutes dated June 25, 2017.   Bob DePianta seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK DATED JULY 13, 2017

Rachel Gaudio made a motion to approve the Site Walk Meeting Minutes dated July 13, 2017.  Tom Machnik seconded the motion.   The motion passed unanimously.

NEW BUSINESS

17-7 CHRIS BOURNE – 124 FOUR MILE RIVER ROAD – CONSTRUCT A SINGLE FMAILY DWELLING WITH A 2 CAR GARAGE AND CRUSHED STONE DRIVEWAY.  REQUEST FOR FINDING OF NO JURISDICTION

Ross Gladstone, of Indigo Land Design  presented the proposed application.  He noted the commission recently approved a subdivision on this property and conducted a site visit at that time.   He stated the applicant is proposing to construct a single family dwelling.  He stated it would be accessed by a crushed stone driveway.  He stated the only work proposed within the 100’ upland review area is the installation of electrical, telephone and cable utility trench.   He noted there is culvert on the existing driveway that was installed for agricultural use which will remain and the trench will run over the existing culvert.  

Joe Wren stated there is 3 feet of cover over the pipe to the top of the driveway so there is enough room for the trench to go over the pipe therefore there will be minimal disturbance.   He noted the work is done very quickly it is just a cut and cover and usually a two day process.  Evan Griswold expressed concern should a thunderstorm occur during the work.  Wren stated the area would be open for a very short period of time and probably would not be done with the threat of thunderstorms.   Wren stated they could place hay bales along the stream.  

Tom Machnik made a motion for a finding of no jurisdiction.  Bob DePianta seconded the motion.   The motion passed unanimously.   The commission suggested that hay bales be placed in the area of the culvert when the trench is be dug and also that hay bales be placed on the steep slope.   Wren stated the plan will be revised to include the two items.   

17-8 HOPE PARTNERSHIP – 16 NECK ROAD – 4 LOT SUBDIVISION – REQUEST FOR FINDING OF NO JURISDICTION

Joe Wren, of Indigo Land Design oriented the commission as to the location of the 12 acre parcel.    He stated the applicant is proposing a 4 lot subdivision.  He noted no development is proposed at this time.  He stated there is an existing driveway that serves two parcels and proposed driveway to serve the other two lots.   He further stated Mr. Graybill has been trying to contact the adjacent property owner to see if he could purchase rights to the existing driveway rather than construct a new driveway.   He noted some of the utilities from the adjacent property owner cross onto the 12 acre property and this may be a tradeoff but no agreement has been reached at this time.

Wren read a letter into the record dated November 12, 2014 from Richard Snarski.  (See attached).  

Wren reviewed the proposed 4 lot subdivision plan with the commission including schematic house locations, test holes, zoning data table and driveway locations.

Evan Griswold made a motion of finding of no jurisdiction.  Tom Machnik seconded the motion.   The motion passed unanimously.   


OLD BUSINESS

17-6 LAWRENCE PORTER – 3 CHAMPLAIN DRIVE – IN GROUND SWIMMING POOL AND SMALL PATIO

Skip DiCamillo noted that the commission members had visited the site.  

Mr. Porter stated he would like to install an in-ground swimming pool behind the west end of his house.  He stated they have not yet finalized a contractor but the pool size at maximum will be 12 ft. x 24 ft.   Mr. Porter submitted drawings of the retaining wall for the commission to review. The commission reviewed the information provided.  The commission requested the applicant provide a rendering of the retaining wall, distances on the map to the wetlands as well as Swan Brook.    

The applicant granted the commission a 35 day extension to render a decision.  This agenda item will be discussed at the September meeting.

17-1 SANDY SPENCER /BILL MCNEIL – 30 WHIPPOORWILL ROAD – REMOVING MATERIALS TO LEVEL BACKYARD FOR SAFETY AND CORRECT EROSION INTO THE BASEMENT.

Skip DiCamillo stated the commission received a request from the applicant that Evan Griswold recuse himself from the application.   Evan Griswold clarified for the record he had no involvement in the real estate transaction for Mr. McNeil. Chris Kerr stated that on behalf of the applicant he had no issue with Mr. Griswold acting on the application.

Chris Kerr was present on behalf of the applicant.  He stated he had reviewed the correspondence both from Mr. Rosenfeld and Mr. Metcalf.   He stated he had met with Mr. Metcalf at the site as well.   The commission had also visited the site.   


The commission reviewed and discussed the recommendations outlined in Keith Rosenfeld’s memo dated July 21, 2017.

Tom Machnik made a motion to approve the application with the following conditions:

Prior to commencement any excavation work, the applicant, the site contractor and the WEO will meeting to discuss the anticipated scope of work, the expected work schedule and required inspections.  

  • Limit of excavation shall be field staked and inspected by WEO prior to any excavation work.
  • Silt fencing shall be installed along the northerly limit of the excavation adjacent to the wetland and vernal pool area prior to any excavation work.
  • Topsoil stock piles should be placed no less than 100 feet from the wetland areas and should be stabilized with seed and mulch prior to their removal from the property.
  • If excavated materials are to remain on the property (at a location earlier approved by the Ledge Light Health District) it shall be placed no less than 100 feet from the wetland areas and should be permanently stabilized with seed and mulch.
  • If ledge rock is found on-site and blasting is require, the applicant shall obtain all necessary approvals from the Old Lyme Fire Marshal.
  • Applicant is encouraged to allow for a natural regeneration of the areas north east and west of the vernal pool to occur through succession of native plants and weeds, as naturally dispersed by animals, wind, and/or insects.
Rachel Gaudio seconded the motion.   The motion passed unanimously.
