OLD LYME PLANNING COMMISSION
REGULAR MEETING
THURSDAY, NOVEMBER 8, 2018
PRESENT WERE: Harold Thompson, Todd Machnik, Steven Ross, Barbara Gaudio and John Curtis.
PLEDGE OF ALLEGIANCE
The commission began the meeting with the Pledge of Allegiance.
LOT LINE MODIFICATION – 115 & 117 SHORE ROAD. APPLICANT: DAWN ROOT
Michael Barnes, presented the application on behalf of the applicant, Dawn Root. Mr. Barnes noted that there was previously a Lot Line Modification on this property in 2011 and they are now requesting to modify once again. He stated there are two parcels which consist of the main house (Parcel 1) and the seafood market parcel (Parcel 2). He said the intention is to give a little more land to the Parcel 2. The commission has received two memos regarding the modification. The first memo is from Keith Rosenfeld dated November 7, 2018 indicating the proposal complies with the Old Lyme Zoning Regulations and will not create any additional non-conformities beyond what is already existing on the site. The second memo is from Attorney Cassella dated November 7, 2018 stating the applicant
needs to obtain approval from Ledge Light Health District and the new deeds need to be submitted for review.
Mr. Barnes said they have not been able to coordinate the necessary test pit on Parcel 1 but it is their intention to have it completed.
Steven Ross made a motion to approve the application with the condition of Ledge Light Health District Approval and the necessary deeds being submitted and reviewed by counsel prior to filing the mylars. Barbara Gaudio seconded the motion. The motion passed unanimously.
APPROVAL OF THE SEPTEMBER MEETING MINUTES
Steven Ross made a motion to amend the agenda to add the Reading and Approval of the September Meeting Minutes. Todd Machnik seconded the motion. The motion passed unanimously.
Steven Ross made a moton to waive the reading and approve the September Meeting minutes as submitted. Barbara Gaudio seconded the motion. The motion passed unanimously.
ANY OTHER BUSINESS OR CORRESPONDENCE
Mr. Barnes stated he was present to discuss a zoning related issue. He stated back in 2007 he believes as far as the Zoning Regulation Rewrite process there was some remapping of eighteen properties.
He said the 18 properties owners that were affected by their properties being rezoned from C-30 commercial to R-20 residential were not notified. He asked the commission for guidance on how to possibly rezone those properties back to what they were originally. He stated that Kathy Clarke, Veterinary Hospital was a C-30 property that has been there for generations and she was completely unaware that her property was rezoned. He said after reviewing the minutes during that time period he concluded that the commission determined notification was not required.
He further stated they only rezoned half of the road. He said in some instances it was the right side and other instances it was the left side. He also noted the minutes did not explain the change. He also stated he had reached out to members of the commission for additional information. He also noted as a result of this map change additional non-conformities and hardships were created for these property owners. The commission recommended he discuss the issue with the Zoning Commission.
