OLD LYME PLANNING COMMISSION
REGULAR MEETING
THURSDAY, APRIL 13, 2017
PRESENT WERE: Harold Thompson, Steven Ross, Edgar Butcher, and Alternate Todd Machnik seated for Chris Kerr and Alternate Don Willis seated for Robert McCarthy.
TWO LOT SUBDIVISION – PETER & MILDRED CARON – 442-1 SHORE ROAD
Stuart Fairbanks, P.E. of Angus McDonald & Gary Sharpe & Associates presented the proposed two lot subdivision. Fairbanks noted the property is approximately 9 acres and located in both a C-30 and RU- 80 zone. The front portion of the property is in the C-30 zone and the rear portion of the property is in the RU-80 zone. He stated there is an existing shared driveway entering from the road with overhead utilities to the first parcel and underground utilities to the second parcel. He stated the proposal is to cut the 50 ft. strip in half to provide a 25 ft. access to each of the rear lots. Fairbanks noted that Keith Rosenfeld’s memo indicated that rear lots were not allowed in the C-30 zone. Fairbanks stated this parcel is pre-existing. Fairbanks stated an open
space waiver request was submitted as part of the application noting this was a family division of property.
Thompson asked Mr. Fairbanks if he had received a copy of Diana Atwood Johnson’s memo. Fairbanks indicated he did receive the memo and noted he would be meeting with her to discuss the division prior to the next Planning Commission meeting.
Fairbanks noted he also had received a memo from George Caulkins, Ledge Light Health District and noted he has addressed his comments.

Cassella asked if there was a common driveway easement. Fairbanks stated there is one easement but the applicant’s attorney will be providing the additional legal documents including the utility easement.
Steven Ross asked about the proposed open space. Fairbanks stated he felt a waiver was appropriate since it was a family division, the lots are oversized and basically the with the 25 ft. access strips the lots will basically be locked up and therefore cannot be further divided. Steven Ross stated that both parties could agree in the future to put a road into the site.
Harold Thompson made a motion to continue this application until the May meeting. Steven Ross seconded the motion. The motion passed unanimously.
Robert McCarthy arrived and will be seated for the remainder of the meeting.
ORIGINAL DIVISION/FREE SPLIT – HARRY LEWIS – 41 NECK ROAD
Harry Lewis provided the commission with copies of his proposal. Mr. Lewis stated he had an A-2 Survey done in 2013. He noted after doing some research he felt the property was eligible for a free split and has included all the supporting documentation as part of the application. The commission reviewed the proposal. It was clarified that presently there are two homes on one lot and the proposal is two divide the parcel into two so each home would have its own parcel.
Cassella stated he has not reviewed the easement but noted the division might require frontage on a street. He also suggested a zoning data table be placed onto the map which would include the frontage, MABL, and setbacks requirements. The commission discussed the possibility of creating a flag lot which would provide the required 25 feet of frontage for the creation of a new lot.
Mr. Lewis agreed to finalize the plan and come back before the commission at that time.

ZONING REFERRAL – PETITION TO AMEND SECTION 17 A and 17 B AQUIFER PROTECTION REGULATIONS AND ADOPT AN “Aquifer Protection District Surficial Aquifer Protection Area.”
Harold Thompson reviewed the memo dated March 28, 2017 from Keith Rosenfeld regarding the proposed aquifer protection district regulations. Thompson stated it was difficult to determine which text had changed. The commission reviewed the map.
Harold Thompson requested Keith Rosenfeld attend our May Meeting to give a presentation which would give the Planning Commission the opportunity to ask questions regarding the proposed text changes. Cassella also asked that the regulations be red-line to show the changes.
Steven Ross made a motion that the Planning Commission indicate to the Zoning Commission that they cannot have a meaningful discussion without more information and clarification to the commission. The commission would also like a presentation by the Zoning Officer. Robert McCarthy seconded the motion. The motion passed unanimously.
DISCUSSION – PLAN OF CONSERVATION & DEVELOPMENT – SALT MARSH ADVANCEMENT & SEA LEVEL RISE
The commission reviewed the latest revisions to the Plan of Conservation and Development dated March 30, 2017. The commission made a change on Page 2 of the revision under “Coastline Protection” in the first sentence to include the wording at the end of the sentence “and all other tributaries”. Cassella will make the changes and once complete the document will be sent out to all the commissions for their review. Harold Thompson will email Jane Cable to see if it would be possible for the Planning Commission to attend their May 8th meeting thirty minutes prior to their regular meeting to discuss the modifications.

READING AND APPROVAL OF THE MARCH REGULAR MEETING MINUTES
Steven Ross made a motion to waive the reading and approve the minutes as submitted. Seconded the motion. The motion passed unanimously.
