Meeting Minutes
May 18, 2009

The meeting was called to order at 5:05 P.M. by Chairman Steve Ross.
Present: Steve Ross, Todd Machnik, Bob Chapman, Dave Roberge (Ex-Officio Member)
Absent with Notification: Gary Smith
Absent:  Tom Penfield, Tim Griswold (Ex-Officio Member)

1. Correspondence
Steve Ross reported that he had received a copy of a letter addressed to Tim Griswold from Mark Mongillo regarding Miami Beach erosion. The board will discuss this as new business later in the meeting.
2.  Approval of April 20, 2009 meeting minutes
Todd Machnik moved, Bob Chapman seconded, to approve the April 2009 minutes as presented.  The motion was unanimously approved.

3. Mile Creek
Steve Ross reported that he met with Paul Capotosto of DEP regarding the need to obtain a maintenance permit for work at Mile Creek.  Presently the town of Old Lyme and the CT DEP are working together to work up the application and file for said permit.

4. Swan Brook – drainage pipes under Hawk's Nest Beach to Long Island Sound
Steve reported that he met with Lou Russo (Miami Beach Association), and Ed Adanti from the Old Lyme Public Works Department to look at the problem of sand settling in the drainage pipes.  It was decided that the town crew will clear out the pipes and keep an eye on it.  

Todd Machnik stated that at a past meeting of the FEC board that he made the comment that Miami Beach was once just a pond.  He brought in a map from 1860 showing that it actually was a pond at that time.

5. Sheffield Brook – Draft Request for Proposal (RFP)
Steve handed out copies of tow draft RFP to board members, town staff, engineering firms and guests. He explained that one was a draft, with input from engineering firms Milone  & MacBroom and Indigo and the second draft  was by Gary Smith.  Steve felt that we had made good progress, and he wished to discuss with the group present, and have board members review and come back with suggestions and/or recommendations for next month's meeting.  He asked that this RFP be simplified.  Todd Machnik stated that the engineering firms bidding on the proposal will have the right to know how this will be paid for.   He recognizes that the town and beach associations have agreed to work together, and that the beach associations understand that the cost will fall on them.  Bob Chapman will hold his questions until he has proper time to review it.

Dave Wheeler (property owner, engineer, OLS), reported that he had experience in writing RFPs and that he would offer his services to the beach association and to the board in this project.  He presented the board with a scope of work document that he drafted that defines the "work needed to be done" at OLS.  He suggested that the OCB association should do the same.  Steve asked that David send an electronic copy to him for distribution to the board.  Steve confirmed that we had already been working together with both beach associations to create a list of work needed.  The FEC board was already in possession of maps and documents providing us with a large amount of information.  Steve suggested to Dave Wheeler that he consider providing his name to the Selectmen to be a member of the FEC board as his expertise would be valuable to the board.  Dave stated that he is a resident of Virginia and part time in Old Lyme, and would consider it.

Dave Roberge stated that the board should accept the draft with review and discussion for the next meeting.  Steve Ross added that we should work from Gary Smith's portion of the draft.  Joe Wren (Indigo) is comfortable with it, but does have a few concerns.  Steve suggested that people review the draft and the document from Dave Wheeler with the goal of creating one draft.

Julia Nixon (property owner, OLS) asked if ALL property owners will have input, not just the adjacent property owners, and will this be done by fall?  Steve was hopeful that it would be done by fall and reminded Julia that our meetings are open to the public and all property owners are welcome.  

Bill Randazzo (property owner, OLS) voiced his concerns as to the process that the FEC board, the beach associations, and the town are using to solve this problem.  A lengthy discussion followed with the conclusion that the three groups would continue to work together for a solution suitable to all.  Dave Roberge went on to explain the process for filing a request for state grant money.

Mark Phelan (property owner, OLS) asked if the contract would have to go to the lowest bidder.  Steve Ross stated “not necessarily” and that whatever decision was made it would be a joint decision by the board and the associations.  

Joe Wren (Indigo) voiced a concern over the draft in hand.  He felt that it was nice and simple in March and now the scope of work had grown to more than needed.  Steve asked Joe to put his comments in an email to Steve for distribution to everyone.  Mary Howley (property owner, OLS) asked if all property owners can be included in all meetings involving this issue and Steve assured her that all discussions will take place at FEC meetings which are open to the public.

7. New Business
Steve shared with the board the letter sent to Tim Griswold (with a copy to Steve) by Mark Mongillo of Miami Beach.  The letter brought to Tim's attention the ongoing erosion problem at Miami Beach asking the town to attend to the issue.  Todd and Steve both stated that the FEC board should not get involved with issues that pertain to the natural erosion of beaches and that this was a matter for the CT DEP.

8. Our next meeting will be on June 15, 2009 at 5:00 PM, town hall, second floor meeting room.

Bob Chapman moved, Todd Machnik seconded, to adjourn the meeting at 6:20 PM.
