Ethics Commission Minutes 04/21/2009
Old Lyme Ethics Commission
Minutes of Regular Meeting
Held at The Town Hall
Tuesday April 21st 2009

The meeting was called to order by Bob Witcomb (chair) at 7.35 PM
Present were Michael Magnus, Brian Hautaniemi, Michael O’Brien and Dwayne Bassler.
        In attendance Robert Staab (alternate).
        No press were present.
No members of the public were present

  • The minutes of the January 20th 2009 meeting were unanimously approved without alteration.
  • No public were present and there was no carry over from earlier comment.
  • The code amendment as proposed was approved by the Town meeting without alteration on January 26th 2009 and this amendment has now been incorporated in the copies of the code to be given to employees etc. and on the web site.
  • Complaints received-No complaints have been received
  • Budget-Bob Witcomb has discussed this with the First Selectman and we will be included in the upcoming budget probably for a symbolic sum of $10 or similar which we understand then gives the Selectmen the right to approve any actual expenses we may incur.
  • Town certification re distribution of the code- No communication of any kind has been received from the Selectmen or the Town Clerk.
Michael Magnus reported that he had discussed this with the State Ethics people and their Attorney and that he had advised that in his opinion we had no obligation to publicise our existence at all and that this was entirely the responsibility of the Selectmen and that even if we did have an obligation we had done far more than necessary.
In spite of this it was unanimously agreed that Michael Magnus would write one more time to the Selectmen copied to the Town Clerk requesting confirmation that all had received a copy of the code.

  • Who do we report to- This matter was raised as a question at the Town meeting and although it is clear that we do not report to the Selectmen it is not clear whom we do report to. During his talk to the State Ethics Lawyer Michael Magnus raised this question and was advised’ no one knows’ but that this subject was under discussion at State. Although the Lawyer promised to advise once a decision is made it was thought by all that we should check again about the time of our next regular meeting.
  • Complaints form- No comments had been received
  • No other business was brought forward
  • The meeting adjourned at 8.05PM
The next regular meeting will be on July 21st at 7.30PM at the Town Hall
