III.    PUBLIC HEARING
A.  SPECIAL EXCEPTION APPLICATION           
Application for Special Exception Use for 6,273 s.f. retail auto parts store,  631 Boston Post Road, Map 36, Lot 104, Business B-2 Zone, Pedestrian Node.  
Applicant:  Advance Auto Parts                Agent:  Joe Wren, P.E.

Joe Wren, P.E., James Andruli of Sargenti Architects, and branding consultant Mike Grabarek addressed the Commission, presented an amended site plan, noting the revision were made in response to review comments.~  Following review and discussion of the revised plan, following were offered by the applicant:  The sign over the entrance will be reduced to meet the Zoning Regulations; the trim above the windows will be bumped out and paint it the same color as the building; the front sign will be centered between the trim edge and the cornice; the monument sign will be surrounded by day lilies and greens all year round to soften the cement base; the two lights on the northeast side of the building will be removed and the two lights on the plans in the rear of the building will be reduced to one; the roof utilities will be screened.  The Commission reviewed approvals and suggestions from the Planning Commission, the Architectural Review Board, Branse, Willis & Knapp, Nathan L. Jacobson and Associates, the Connecticut DOT, Old Saybrook Fire Department, the Office of the Fire Marshall, and the Connecticut River Area Health District.

MOTION to approve the Special Exception Application for 6,273 s.f. retail auto parts store, 631 Boston Post Road, Map 36, Lot 104, Business B-2 Zone, Pedestrian Node with the following conditions:  1) The applicant must provide sidewalk easements to the Town of Old Saybrook 2) Rooftop mechanicals must be screened with the screening material provided during the Public Hearing.  Screening will be the same color as the building. 3) Remove wall pack lighting on the northeast side and limit lighting to one wall pack over building egress door in rear/north side. 4) No more than 3 part delivery trucks will be located on the premises.  Trucks must be parked in the rear (northern side) of the building. 5)The applicant and Town staff will continue to coordinate with the State DOT regarding the front landscaped island.  The ZEO is authorized to modify the island as deemed appropriate. 6) The applicant will provide new, approved sign renderings and elevation drawings demonstrating revisions made during the public hearing process.  7) The applicant will plant green all year vegetative plantings around the monument sign.   • PETITION TO AMEND THE OLD SAYBROOK ZONING REGULATIONS
Petition to remove Saybrook Aquifer Protection (AP) Zone Regulations.  Remove from Sections 4.2 and 9 references to Aquifer Protection Zone.  Remove Section 57 in its entirety.

Christina Costa, ZEO and the Commission discussed that the DEP completed the Level A mapping of the Saybrook Aquifer and now the Old Saybrook Aquifer Protection Area Regulations will govern activities in this area, therefore these sections should be removed from the Zoning Regulations.  There was no public comment on this matter.

Petition to AMEND the Old Saybrook Zoning Map, to remove Saybrook Aquifer Level B Aquifer Protection Zone and Replace with Aquifer Protection Area Level A mapping for Saybrook Well Field Aquifer.

Christina Costa, ZEO and the Commission discussed that the DEP completed the Level A mapping of the Saybrook Well Field Aquifer, which they intend to replace the Level B Aquifer Protection Map.   The Commission reviewed the positive responses from the Planning Commission, Connecticut River Area Health District, Connecticut River Estuary, Connecticut DEP and Branse, Willis and Knapp .  There was no public comment on this matter.

  • Committee, Representative & Staff Reports
ZEO Costa reported that the Stop and Shop Greenhouse will  begin March 1, 2011 and be up until August 30, 2011.  

ZEO Costa received a letter from Greg Bessoni updating the situation with his tenant in the accessory apartment at 22 Denmore Lane.  He stated that the tenant is willing to move by September 1, 2011.  The Commission expressed concern and agreed that if by September 1, 2011, there is no indication that there is action on the tenant’s part to move, legal action will commence against Mr. Bessoni in September.

 Van Wilgen’s Garden Center, 1654 Boston Post Road, to put up an 8X6 shed to store their cash register and to provide protection from the elements for their sales people.  The Commission stated that there were other alternatives available for storage of cash registers and such and that if he wants a shed, he needs to file for a modification of the Special Exception Permit for the site.

The ZEO is receiving bids to print the updated Zoning Regulations sets which have not been printed in years.  The Commission decided that the project should go forward, however no more than $4,000 should be spent on printing and that local business’s should be considered.  

The ZEO reported that Between the Bridges is re-submitting their application on March 10, 2011 and is set to go to Public Hearing on May 2nd, 2011.  

The ZEO reported that there are a lot of applications coming in and this will keep the Commission very busy.  The Commission discussed meeting on a weekly basis in May and the beginning of June to accommodate the workload.
