The Commission met at 6:00 for its annual inspection of the Town’s Gravel Pits

Correction needed on page 5, section F.  Motion should read “not exceed 25% of total seating”, instead of “interior seating”.

V  NEW BUSINESS:
A  COATAL SITE PLAN REVIEW: 819 s.f. addition, 37 Riverside Avenue, Map 59/Lot 88, Res. A Zone, CZC # 06-137, Gateway Conservation Zone.                                 Applicant: Peter and Susan Lynch                                      Agent:    David Duncan
Mr. and Mrs. Lynch, and their architect, David Duncan were present.  The property is located within 100 feet of the Connecticut River.  Mr. Lynch stated they are looking got add an 819 s.f. addition which would include a bedroom, bathroom and small den.  The Health Department has signed off on the current septic system.  The addition will be on the existing footprint of the house.  No tree removal for planned addition.
Per Mr. Duncan, siltation fencing will be used.

MOTION to approve the Coastal Site Plan Review for an 819 s.f. addition, 37 Riverside Avenue, Map 59/Lot 88, Res. A  Zone, CZC# 06-137, Gateway Conservation Zone.  That the project be approved as submitted because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impact. C    DISCUSSION:    Londregan Commercial Group, 1596 Boston Post Road, Map 26/Lot 34, B-4 District.
Elizabeth Meyer-Gaden, a commercial broker with the Londregan Real Estate Group, was present.  The current owner of 1596 Boston Post Road has shown an interest in marketing the property.  Some fast food restaurant chains have shown an interest but they would require a drive-thru window.  Ms. Meyer-Gaden came to the commission to explore the possibility of a Petition for Text Change to allow a drive-thru restaurant in a B-4 district.  Discussion was held, with commission members raising concerns about opening more drive-thru windows.  R. Friedmann noted increased garbage thrown out car windows, and also pointed out that traffic is already very busy in that area year round.  He advised Ms. Meyer-Gaden that the applicant would have to come to the Commission and prove that a drive-thru window would be an asset to the town.  Ms. Meyer-Gaden stated she would report back to the owner, and then determine how to proceed.

VI  COMMITTEE REPRESENTATIVE & STAFF REPORTS:

Enforcement Officer Costa discussed numerous pending zoning issues.

Attorney Eric Knapp and Zoning Enforcement Officer Costa continue to pursue the Order to Cease and Desist with regard to the Sams property (9 Rivers Edge Road).  
Chamber of Commerce looking to hold “town-wide” tag sale.  This could be held at private residences, or at business locations.  The Commission discussed concerns of “pop-up” tents and how to restrict this.

The Zoning Commission questioned Enforcement Officer Costa on the status of two separate properties:

1.      Dirt, LLC, Spencer Plains Road, Map 25/Lot 25.  The Commission instructed Officer Costa to pursue enforcement actions against Dirt, LLC for operation of unpermitted gravel pit, signs, unpermitted building, storage of farm animals, improper soil and erosion control and any other violations determined by the Enforcement Officer.  The commission wanted it noted that Dirt, LLC has not returned to the Zoning Commission since their meeting in December of 2003.  It is the Enforcement Officer’s understanding that the D.E.P. landfill issues and the D.O.T. right of way issues/curbcuts have not been resolved to date.  The Commission authorized the Zoning Officer to take legal action as necessary to resolve these violations.  A commission member stated one evening he noticed a television on in a shed/trailer and questioned possibly if it was used for a residential structure.

2.      Duncan and Andrew Downie, 6 Center Road West, Map 26/Lot 6-9.  The Commission questioned the Enforcement Officer about an alleged operation of a gravel pit at this location.  Chris Costa informed the commission she did not think the operation was a gravel pit, but instead stockpiling of construction materials and dirt and fill related to the operation of his business.  The commission requested that Enforcement Officer Costa act on this immediately, and contact Mr. Downie to discuss action on his property and determine if they are in compliance with zoning regulations.
