NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, September 9, 2015 at 7:00 p.m. continued to Wednesday, September 16, 2015 at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Robert McIntyre, Alan Spargo and Carl VonDassel, Jr., alternate

Absent:  Philip Broadhurst

The meeting was then called to order at 7:00 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

15/16-06 - Vaju R. Odedra, seeks a variance of Par. 34.6.1 (street line setback/50’ required/45.06’ proposed) of the Zoning Regulations to permit the addition of a 192 s.f. covered entry at 1430 Boston Post Road, Map 26/Lot 16, Gateway Business B-4 District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening.  The applicant wants to relocate its check-in area to the Route 1 side.  The proposal is to erect a 12’ x 16’ covered entry way to keep guests that arrive in inclement weather dry.  The existing entry/check-in area on the side has a canopy.  D. Alexander questioned the size of the canopy.  It could be reduced in size so that it does not need a variance, there really isn’t a reason or hardship for it to be that large.    
  
A Motion was made by R. McIntyre, seconded by A. Spargo to GRANT Application 15/16-06 - Vaju R. Odedra.  Granted based on the fact that the applicant is trying to provide adequate cover for the business at it happens at that location and to enhance the appearance of the structure.  Discussion:  D. Alexander stated that it is a bad idea and does not have to be that big.   No discussion and a vote was taken: In favor:  R. McIntyre, A. Spargo, C. VonDassel  Opposed:  R. McCall, D. Alexander  Abstaining: None   The motion failed to pass. 3-2-0   It takes 4 affirmative votes to grant a variance, the application is denied.

15/16-07 - Timothy H. & Margaret P. Russell, seek a variance of Par. 10.7.1 & 10.7.2 (non-conformity enlargement/change) and Par 24.5.1 as modified by 68.1.2B(4) (narrow street setback/30’ required/18.5’ proposed) of the Zoning Regulations to permit the enclosure of an existing 338 s.f. carport at 36 Elmwood Street, Map 37/Lot 30, Residence A District.

Discussion with respect to the public hearing that closed this evening.  The applicant is enclosing an existing carport and making it a garage.  There will be no further encroachment into the setback.  A garage is a reasonable use and the carport already exists.  

A Motion was made by R. McCall, seconded by R. McIntyre to GRANT Application 15/16-07- Timothy H. & Margaret P. Russell. No further encroachment into the setback.  Carport already exists creating a change of an existing nonconformity.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, A. Spargo, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  

15/16-09 - Ken Slight & Paula Horton, seek a variance of Par. 10.7.1 & 10.7.2 (non-conformity enlargement/change) ; Par 24.5.1 as modified by 68.1.2B(4) (narrow street setback/30’ required/21.2’ proposed); Par. 24.6.2 (building/structure coverage/20% required/22.2% proposed); Par 24.5.3 (other line setback/15’ required/9.7’ proposed); Par. 68.1.2B9 (tidal wetlands setback/50’ required/32’ proposed) of the Zoning Regulations to permit the addition of 331 s.f. in deck additions and stairs at 115 Nehantic Trail, Map 19/Lot 18, Residence A District, Coastal Area Management Zone.

There was discussion about the “hardscapes” [large stone patio and walkways] on the site that are within the tidal wetlands setback and whether or not the applicant was going to keep any of it.  The Board asked the applicant to consider coming back next month with a final plan showing what they want to keep for the walkway and/or patio.

A Motion was made by R. McCall, seconded by D. Alexander to CONTINUE the public hearing for Application 15/16-09 - Ken Slight & Paula Horton to the October 14, 2015 Regular Meeting which will be held at 7:00 p.m. in the First Floor Conference Room, Town Hall.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, A. Spargo, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0

15/16-12 - Janice Grubin & Dana Gordon, seek a variance of Par. 10.7.1 & 10.7.2 (non-conformity enlargement/change); and Par 24.5.3 (other line setback/15’ required/8’ proposed) of the Zoning Regulations to permit the removal of rear porch and replace with 10.8 s.f. covered open entry & steps 6 Jarvis Road, Map No. 4/Lot 114, Residence A District, Coastal Management Zone.

Discussion with respect to the public hearing that closed this evening. The applicants are removing the rear porch that is 4’ from the property line and replacing it with a covered open entry and steps that will be 8’ from the property.  This is a reduction in an existing nonconformity.   

A Motion was made by A. Spargo, seconded by R. McCall to GRANT Application 15/16-12 - Janice Grubin & Dana Gordon as submitted.  There are reductions in existing nonconformities.  No discussion and a vote was taken:  In favor: R. McCall, D. Alexander, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 4-0-0  

Adjournment:  A Motion was made by R. McCall, seconded by A. Spargo to adjourn the September 16, 2015 Special Meeting of the Zoning Board of Appeals.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 4-0-0  The meeting was adjourned at 8:10 p.m.
