NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Special  Meeting that was held on Wednesday, August 19, 2015 at 7:00 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman Philip Broadhurst, Robert McIntyre, Alan Spargo and Carl VonDassel, Jr., alternate

The meeting was then called to order at 7:00 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

15/16-03  Harry Dauphinais, seeks a variance of Par 68.1.2B(8) (minor accessory structure setback/5’ required/.94’ proposed to the west and 1.58’ to the north) of the Zoning Regulations to permit the construction of a 96 s.f. shed at 5 Gagnon Avenue, Map No. 18/Lot 65, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening.  Mr. Dauphinais submitted a septic system plan that his father had for the systems possible location.  There were two 20’ sections of pipe going into square galleys extending out across the back yard.  Mr. Dauphinais previous request has been modified to show 5’ from the north setback, and 2’ from the west setback.  The neighbor on the west side submitted a letter to the Board stating that he did not have a problem with the placement of the shed.  The neighbor on the north stated that the shed is larger than the one that was originally there.  R. McCall stated that he met with the Sanitarian and the Sanitarian stated that the shed could be located on the septic field area since it is less than 200 s.f. and not on a permanent foundation.  There was discussion about rotating the shed 90 degrees.  Mr. Dauphinais stated that the old shed was an odd size, approx. 8’ by 11’ +/-.  The new shed is a pre-built shed that comes in specific sizes.  So the applicant said it could be slightly larger.  R. McIntyre stated that if the applicant came in with new construction the Board would want the applicant to not increase building\structure coverage and try to meet the setbacks.

A Motion was made by R. McIntyre, seconded by A. Spargo to GRANT Application 15/16-03 Harry Dauphinais to site the shed in the location of the pre-existing shed that was previously torn down and a new shed located in its place but it must meet the 5’ setback on both the north and west side of the property.  Turning the shed 90 degrees is up to the applicant.  No discussion and a vote was taken:  In favor: R. McCall, P. Broadhurst, R. McIntyre, A. Spargo, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0

14/15-35 – Kevin & Colleen Shay seek a variance of Par. 26.3.1(minimum lot area/87,120 s.f. required/86,275.11 s.f. proposed) of the Zoning Regulations to permit subdivision of 173,401.22  s.f. (3.98 acres) to two building lots of 87,126.11 s.f. (2 acres) and 86,275.11 s.f. (1.98 acres) on property located at 23 Otter Cove Drive (aka 11 Azaela Way) , Map No. 64, Lot No. 14, Residence AA-3 District, Coastal Area Management Zone, CT River Gateway Conservation Zone.

Discussion with respect to the public hearing closing this evening.  The Board as well as Attorney Cronin requested extra time to review the testimony presented this evening from both Attorney Robert Reardon and Attorney Thomas Cronan who represents the Otter Cove Association.  Court cases were discussed and several versions of site plans were shown.  The audience had an opportunity to speak either in favor or in opposition.  Two letters of support were entered into the record but there were also five letters entered into the record in opposition.  

A Motion was made by A. Spargo, seconded by R. McCall to CLOSE the public hearing and DEFER the decision on Application 14/15-35 – Kevin & Colleen Shay to the next Regular Meeting of the Zoning Board of Appeals which is Wednesday, September 9, 2015 at 7:00 p.m. in the First Floor Conference Room, Town Hall, 302 Main Street. No discussion and a vote was taken:  In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  

Adjournment:  A Motion was made by R. McCall, seconded A. Spargo to adjourn the August 19, 2015 Special Meeting of the Zoning Board of Appeals.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 9:45 p.m.
