Zoning Board of Appeals
NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, May 13, 2015 at 7:00 p.m. at the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:
Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Philip Broadhurst, Alan Spargo and Carl VonDassel, Jr., alternate

The meeting was then called to order at 7:00 p.m. The following public hearings were conducted, as well as the decision making sessions. The meeting has been recorded on tape and the following actions were taken:
The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.
14/15-32C - Gloria E. Zailskas seeks a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change); Par 24.6.2 (maximum building/structure coverage/20% allowed/23.2 % proposed) and Par 68.1.2.B9 (tidal wetlands setback/50’ required/32’ proposed) of the Zoning Regulations to permit construction of a 246 s.f. deck at 15 Buckingham Avenue, Map 14/Lot 116, Residence A District, Coastal Area Management Zone
Discussion with respect to the public hearing that closed this evening. The property owner requested variances for a 3.2% increase in coverage and a reduction in the 50’ required tidal wetlands setback for a larger deck. The existing deck is too small for outside grilling and there is a hazard when the grill is on the ground and large hot platters and knives/utensils need to be carried up the deck and into the home. The proposal was to increase the decking to 246 s.f. The existing structure was built in 2007 and at that time the ground coverage had been maximized. The Board felt the task of finding exceptional difficulty or unusual hardship was not found.
A Motion was made by A. Spargo, seconded by P. Broadhurst to DENY Application 14/15- 32C – Gloria E. Zailskas. The land appears to be pretty well stretching the zoning limits which were done by the original owners who obtained variances to construct the dwelling. By doing this, they have really limited subsequent buyers from any future expansion unless there is some way to get rid of some of the other conditions that affect the zoning. 14/15-33 - Environmental Containment Systems, seeks a Certificate of Location for Automotive Use per CGS 14-54(b), at 360 Boston Post Road, Map 53/Lot 49, Gateway Business B-4 District.
Discussion with respect to the public hearing that closed this evening. The property is the old Stanley Motors parcel which has been vacant for well over 10 years. There are other automotive uses in the surrounding area. The property will be renovated and landscaped. The applicant will still have to go to the Zoning Commission for approval as well.
A Motion was made by R. McCall, seconded by A. Spargo to GRANT Application 14/15- 33 – Environmental Containment Systems for the Certificate of Location for Automotive Use per CGS 14-54(b). The property location has been used for automotive uses in the past. No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, A. Spargo, C. 14/15-34C - Kimberly A. Neri Simoncini, seeks a variance of Par 10.8.3 (non-conforming lot size/12,500 s.f. required/6,780 s.f. proposed); Par 24.3.2, (minimum dimension of square/100’ required/35’ proposed); and Par 24.5.3 (other property line setback/15’ required/5.2’ proposed on the south side and 8.5’ proposed on the north side) and 24.5.1 as modified by 68.1.2B(4) (narrow street setback/30’ required/16’ proposed)of the Zoning Regulations to permit the demolition of the existing house and construction of a 1,294 s.f. house at 83 Hartford Avenue, Map 013/Lot 89, Residence A District, Coastal Area Management Zone.
Discussion with respect to the public hearing that closed this evening. The applicant has taken into consideration all of the comments the Board made with respect to this project in July of last year. The new plan eliminates the attic space on the second floor and moves the master bedroom to the rear of the house. The house will be raised to meet the FEMA flood elevation height and there will not be a deck protruding into the front. The gross floor area is exactly the same as it is in the existing structure and the structure will have three forms of egress.
A Motion was made by R. McCall, seconded by D. Alexander to GRANT w/condition Application 14/15- 34 C – Kimberly A. Neri Simoncini. The applicant has done everything to address the concerns the Board expressed in July, 2014. There are a number of letters of approval. The hardship is that the lot is small and the fact that the house has to be repaired since it sustained damage from the storm. With the small lot the applicant has done everything they could to conform to zoning. The condition is that the exiting shed is to be moved to conform with the zoning regulations. Also the Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts. No
