NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook will hold a public hearing at the Town Hall, First Floor Conference Room located at 302 Main Street, Old Saybrook on Wednesday, March 11, 2015 at 7:00 p.m. to hear the following:
A Motion was made by R. McCall, seconded by R. McIntyre to rearrange the agenda to move Application No. 14/15-25 C, 12 Cove Street Family Limited Partnership to be heard after the application for Martin & Ann Mackay. No discussion and a vote was taken: In favor: R. McCall, A. Spargo, P. Broadhurst, R. McIntyre, C. VonDassel Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
14/15-26 – Patrick Maher, seeks a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change) and Par. 24.5.1 as modified by 68.1.2B(4) (narrow street setback/40’ required/30’proposed) of the Zoning Regulations to permit construction of a 234 s.f. addition expansion at 30 Cottage Place, Map 29/Lot 53, Residence A District, Coastal Area Management Zone.
Discussion with respect to the public hearing that closed this evening. The applicant was previously granted a variance for an addition. This proposal is to square off a portion of the house. The addition does not encroach further into the front setback than already exists since the house itself encroaches. The reason for the encroachment is due to the roof reconstruction and the bearing walls.
A Motion was made by R. McCall, seconded by P. Broadhurst to GRANT Application 14/15-26 – Patrick Maher. Sufficient hardship has been shown due to the roof reconstruction for the bearing walls. 14/15-27C – Martin W. & Ann T. Mackay, seek a variance of Par 58.2 (riparian buffer) and Par 58.6(setback Gateway Conservation Zone)/100’ required/55’ to pool, 40’ to terraced walls, and 35’ to gardens proposed) of the Zoning Regulations to construct a pool/spa/patio, terraced walls and gardens at 330 Watrous Point Road, Map 64/Lot 17-2, Residence AA-3 District, Coastal Area Management Zone, Gateway Conservation Zone.
Discussion with respect to the public hearing that closed this evening. Variances were previously granted for a similar project in April of 2014. After closer inspection of the property by a Soil Scientis, there were wetlands noted on the site which prompted a different configuration of the pool. The Zoning Enforcement Officer stated that it was enough of a change to come back before the Board. There will be more native landscaping done and the plants are noted on a Plan entitled P.1.0
A Motion was made by R. McCall, seconded by R. McIntyre to GRANT Application 14/15-27C – Martin W. & Ann T. Mackay. The variances are granted. There is approval from the CT River Gateway Commission, stating that there are improvements with an increase in the riparian buffer and the lowering of the swimming pool to make it less visible from the river. The design is an improvement of the project previously approved. The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts. 14/15-25C – 12 Cove Street Family Limited Partnership, seeks a variance of Par. 24.4.2 (max. height/35’ allowed/36.5’ proposed); Par. 24.6.2A(max. building/structure coverage in Gateway Conservation Zone/15% allowed/15.6% proposed); Par. 68.1.2.b.9 (special setback from tidal wetlands/50’ required/48’ proposed to deck); Par. 58.2 (riparian buffer area/100’ required/48’ proposed to deck); and Par. 58.6 (setback Gateway Conservation Zone/100’ required/48’ proposed to deck) of the Zoning Regulations to permit demolition of existing structure and construct 2,879 s.f. house at 12 Cove Street, Map 24/Lot 72, Residence A District, CT River Gateway Conservation Zone, CT Coastal Management Zone.
Discussion with respect to the public hearing that closed this evening. The existing 1925 structure will be torn down and a new code compliant structure built. The variances requested are for the Gateway Conservation Standards which are more restrictive. The location of the house was determined by the dramatic slope on the property which goes from 4’ to 9’ and the determined height of the structure is taken from the lowest point, not the average grade as in other zoning districts.
A Motion was made by R. McCall, seconded by A. Spargo to GRANT w/conditions Application 14/15-25 – 12 Cove Street Family Limited Partnership. The height will be slightly over the requirement due to the steep 9’ slope since the calculation of height is from the lowest point on the property not the average. There will be an elimination of most of the nonconformities and encroachments into the setbacks. The CT River Gateway Commission requested two conditions to its approval, one that the house color be a muted dark color so that it does not stand out from the river, the roofing materials should also be dark in color and native vegetation be planted on the south side of the structure. The Coastal Site Plan Review Application is approved as well because it is consistent with
all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts. No discussion and a vote was taken: In favor: R. McCall, A. Spargo, P. Broadhurst, R. McIntyre, C. VonDassel Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
New Business: A letter dated March 11, 2015 from Peggy Sheahan Knee regarding a variance granted on March 12, 2014 and asking for an extension of time to start the project.
A Motion was made by R. McCall, seconded by R. McIntyre to grant a one year extension for the variance granted on March 12, 2014 for the project at 147 Plum Bank Road. No discussion and a vote was taken: In favor: D. Alexander, R. McCall, A. Spargo, P. Broadhurst, R. McIntyre Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
