Zoning Board of Appeals

NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, October 8, 2014  at 7:30 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Philip Broadhurst, Alan Spargo and Carl VonDassel, Jr., alternate

Absent:  Robert McIntyre and Christopher Billiau, alternate

The meeting was then called to order at 7:30 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

14/15-04C - David C & Earla K. Frisbie seek a variance of Par 58.6 (setback Gateway Conservation Zone/100’ required/53.2’ to deck and 76.9’ to house proposed) and Par. 58.2.1 (riparian buffer setback/100’ required/53.2’ to deck and 76.9’ to house proposed) of the Zoning Regulations to permit the demolition and reconstruction of a 3,631 s.f. house on property located at 17 Whisper Cove Road, Map 53/Lot 040-01, Residence AA-2 District, Coastal Area Management Zone, Gateway Conservation Zone.

Discussion with respect to the public hearing that closed this evening.  Upon initial review by the Connecticut River Gateway Commission, the Gateway Commission felt that the placement of the house and garage could be moved further away from the river.  The applicant took into consideration the comments from the Gateway Commission and turned the garage 60 degrees.  In doing this the distances from each buffer increased, i.e. Riparian Buffer now 81.0 feet to the house and 70.5 feet to the deck, the same distances for the Gateway Conservation Zone.  

A Motion was made by R. McCall, seconded by A. Spargo to GRANT Application 14/15-04 C David C & Earla K. Frisbie.  With a condition that a pervious driveway be added with an apron in front of the garage doors would be permitted.  No trees within the 100’ buffer are to be removed and a minimal amount of removal of trees in any other areas of this parcel.  The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  Discussion: P. Broadhurst asked about giving options on pervious surfaces and the Board said they did not need to state a specific surface.  No further discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, A. Spargo, C. VonDassel  Opposed:  None   Abstaining: None  The motion passed unanimously. 5-0-0

14/15-07 - Tom & Angela Larco seek a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change); Par 24.6.2 (maximum building/structure coverage/20% allowed/22.4 % proposed) of the Zoning Regulations to permit a 246 s.f. rear deck and stairs on property located at 34 Owaneco Trail, Map 19/Lot 339, Residence A District, Coastal Area Management Zone .

Discussion with respect to the public hearing that closed this evening.  The house building/structure coverage was 19.7% before being elevated to meet the FEMA flood elevation requirements. In elevating the structure the stone patio was no longer an option for the sliding door to the rear of the structure and a deck and stairs were proposed.  The coverage with the deck and stairs increased the percentage to 22.4%.  

A Motion was made by C. VonDassel, seconded by P. Broadhurst to GRANT Application 14/15-07 Tom & Angela Larco.  The proposal is to elevate the house using the existing foundation.  The house has to be lifted an additional two feet higher than FEMA requirements due to the Zoning Regulations.  Elevating a structure to a certain degree necessitates some additional ground coverage in the way of a landing and stairs.  The ground level existing patio is no longer an option. No discussion and a vote was taken:  In favor:  R. McCall, P. Broadhurst, C. VonDassel  Opposed:  D. Alexander, A. Spargo,    Abstaining: None  The motion failed to pass. 3-2-0  The motion was DENIED.

14/15-08 - Brian J. & Deborah S. Belliveau seek a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change); Par 24.5.1 (front yard setback/25’ required/15’ proposed) and Par 24.6.2 (maximum building/structure coverage/20% allowed/21.3% proposed) of the Zoning Regulations to permit a 43.98 s.f. front canopy on property located at 14 Maplewood Road, Map 4/Lot 26, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening.  The proposal as presented is for a portico with columns to go over the existing granite steps at the front entrance.  The building/structure coverage did not change with the addition of the portico since the stairs are already counted as coverage.  The portico will also keep the stairs from freezing in bad weather.  

A Motion was made by A. Spargo, seconded by R. McCall to GRANT Application 14/15-08 Brian J. & Deborah S. Belliveau. Sufficient hardship has been shown.  The proposal is consistent with the neighborhood and will alleviate a safety concern in inclement weather. No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, A. Spargo, C. VonDassel  Opposed:  None   Abstaining: None  The motion passed unanimously. 5-0-0

Minutes:  A Motion was made by R. McCall, seconded by D. Alexander to approve the Minutes of the August 13, 2014 Regular Meeting and the September 10, 2014 Regular Meeting as submitted.  No discussion and a vote was taken:  In favor:  D. Alexander, R. McCall, A. Spargo, P. Broadhurst,  C. VonDassel  Opposed:  None   Abstaining: None  The motion passed unanimously.  5-0-0

Adjournment:  A Motion was made by R. McCall, seconded by A. Spargo to adjourn the October 8, 2014 Regular Meeting of the Zoning Board of Appeals.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, A. Spargo, C. VonDassel  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 8:50 p.m.
