NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, August 13, 2014  at 7:30 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members:  Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Adam Stillman, Secretary, Robert McIntyre and Philip Broadhurst
Present:  Alan Spargo, alternate, Christopher Billiau, alternate, Carl VonDassel, Jr., alternate and Kim Barrows, Clerk

The meeting was then called to order at 7:30 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

14/15-01 - Saybrook Point Marina, LLC seeks a variance of seeks a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change); Par 58.6 & 58.2.1(setback Gateway Conservation Zone & Riparian Buffer Area/100’ required/66’ to deck and 30’  to storage shed proposed); and Par. 37.4.3B (other property line setback not abutting navigable water/ 15’ required/10.25’ proposed to the north) of the Zoning Regulations to permit the construction of a 229 s.f. deck, 212 s.f. porch, and 192 s.f. storage building on property located at 27 Bridge Street, Map 24/Lot 51, Saybrook Point SP-3 District, Coastal Area Management Zone, Gateway Conservation Zone.

Discussion with respect to the public hearing that closed this evening.  This is a small narrow lot where the Gateway Conservation Zone & Riparian Buffer intersects the property.  There is a small sideyard setback for the front porch.  The storage building will remain within the buildable area.  The structure will meet the FEMA requirements for the area.  

A Motion was made by A. Stillman, seconded by R. McCall to GRANT w/conditions Application 14/15-01– Saybrook Point Marina, LLC.  The variances as submitted are granted with the following conditions: 1) that the shed shall be less than 100 sq. ft., 2) the height shall be no more than 12’ and 3) the owner will work with a neighbor to try to appropriately place the shed in a place that creates the least obstruction as possible but shall remain within the buildable area.  A variance is not being granted for the placement of the shed in the setback.  The applicant has shown sufficient hardship in both the condition of the lot and the reduction of the encumbrance on the sideline setback which can be used in lieu of a hardship.  The applicant has demonstrated that it is consistent with the neighborhood.  No Discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Stillman  Opposed: None   Abstaining: None  The motion passed unanimously.   5-0-0   

14/15-02C - Roseanne Zdrok seeks a variance of Par 10.7.1 & 10.7.2 (nonconformity enlargement/change); 24.5.1 as modified by 68.1.2B(4) (narrow street setback/40’ required/30’proposed) and Par 24.5.3 (other property line setback/15’ required/10.5’ proposed) of the Zoning Regulations to permit the construction of a 500 s.f. dormer addition on property located at 1 Barnes Road South, Map 14/Lot 51, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening.  This is a seasonal dwelling.  There will be no change in the footprint.  The coverage as it stands already exceeds the percentage allowed and there will be no further change in the percentage.  

A Motion was made by P. Broadhurst, seconded by R. McIntyre to GRANT Application 14/15-02C – Roseanne Zdrok.  The requests for variances are approved.  Sufficient hardship has been shown as stated by the applicant.  In order to add to the size of the building without further encroachments into the setbacks due to the size of the lot and the septic makes it difficult to do any improvements on the property.  The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  No Discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Stillman  Opposed: None   Abstaining: None  The motion passed unanimously.   5-0-0   

14/15-03C - Peter S. Mals seeks a variance of Par. 10.7.1 & 10.7.2 (nonconformity enlargement/change); Par 24.5.3 (other property line setback/15’ required/5.96’ proposed to the north) of the Zoning Regulations to permit the construction of an 844 s.f.  2nd story addition and deck on property located at 7 Fenwood Road, Map 5/Lot 48, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening. There will be no change in the footprint the applicant is going up and the height of the roofline will not change as well.  Proposal is in keeping with the neighborhood.

A Motion was made by R. McCall, seconded by D. Alexander to GRANT Application 14/15-03C – Peter S. Mals.  The variances are granted to expand only upward by adding a second floor to a portion of the existing home and the garage.  There will be no change in the footprint.  The hardship is that the addition can’t be made to conform unless the garage is moved over on the lot but the septic system is in the way.  The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  No Discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Stillman  Opposed: None   Abstaining: None  The motion passed unanimously.   5-0-0   

Minutes:  A Motion was made by R. McCall, seconded by P. Broadhurst to approve the Minutes of the June 18, 2014 Special Meeting and the July 9, 2014 Regular Meeting as submitted.  No discussion and a vote was taken:  In favor:  D. Alexander, R. McCall, A. Stillman, P. Broadhurst, R. McIntyre   Opposed:  None   Abstaining: None  The motion passed unanimously.  5-0-0

Adjournment:  A Motion was made by D. Alexander, seconded by R. McCall to adjourn the August 13, 2014 Regular Meeting of the Zoning Board of Appeals. No discussion and a vote was taken: In favor: R. McCall, D. Alexander, A. Stillman, P. Broadhurst, R. McIntyre  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 8:40 p.m.
