NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, May 14, 2014  at 7:30 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Adam Stillman, Secretary, Philip Broadhurst and Alan Spargo, alternate

Present:  Kim Barrows, Clerk

Absent:  Robert McIntyre, Christopher Billiau and Carl VonDassel, Jr., alternate

The meeting was then called to order at 7:30 p.m.  The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

13/14-42C - Kimberly A. Neri Simoncino, seeks a variance of Par 10.8.3 (non-conforming lot size/12,500 s.f. required/6,780 s.f. proposed); Par 24.3.2, (minimum dimension of square/100’ required/35’ proposed); and Par 24.5.3 (other property line setback/15’ required/5.2’ proposed on the south side and 8.5’ proposed on the north side) of the Zoning Regulations to permit the demolition of the existing house and construction of a 2,066 s.f. house which will meet FEMA regulations and codes on property located at 83 Hartford Avenue, Map 013/Lot 89, Residence A District, Coastal Area Management Zone – Per letter dated May 8, 2014, the opening of this public hearing is being postponed due to re-advertising for additional variance requests.  The public hearing will be held on June 11, 2014.

13/14-41 - Leo Lensing & Carolyn Sharp, seeks a variance of Par 10.7.1 & 10.7.2   (nonconformity enlargement/change); and Par 24.5.1(street line setback/25’ required/17’ proposed) of the Zoning Regulations to permit the demolishing of an existing entry vestibule structure and the building of a 279.6 s.f. screened porch on property located at 81 Atlantic Drive, Map 8/Lot 67, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening.  Applicants want to remove the vestibule on the front of the house and construct a wrap around screened porch.  The bedrooms in the main house are being reduced from 4 to 3 and the “Annex” is being renovated to remove the kitchen and bedrooms and will be a study.  There will no longer be two dwellings on one property.

A Motion was made by R. McCall, seconded by D. Alexander to GRANT Application 13/14-41 Leo Lensing & Carolyn Sharp, 81 Atlantic Drive.  The variances are granted as requested, with the condition that the building known as the “Annex” can never be used as separate living quarters.  The reason for approving the variance request is that a nonconformity is being removed with two separate living quarters on one lot and reducing the number of bedrooms from six to three.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, A. Stillman, A. Spargo  Opposed:  None  Abstaining: None  The motion passed unanimously. 5-0-0

13/14-43 - Bobi Molchan, seeks a variance of Par 24.5.1 (setback accessory structure/35’ required/32.9’ proposed) and Par 24.5.5C (minor accessory building other line setback/10’ required/4.5’ proposed) of the Zoning Regulations to permit the construction of a 280 s.f. garage on property located at 41 Indianola Drive, Map 2/Lot 62, Residence A District, Coastal Area Management Zone.

Discussion with respect to the public hearing that closed this evening. The applicant would like to have the garage for storage since this will be her permanent residence. The lot is a pre-existing nonconforming lot.  A. Stillman stated that there is no other place for the structure on the lot.  D. Alexander stated that this was a self-created hardship.  A. Stillman stated that the neighbor who was in opposition has a structure 5’9” from the property line, wherein this garage will be approximately 5’ from the property line.

A Motion was made by A. Stillman, seconded by A. Spargo to GRANT Application 13/14-43 –Bobi Molchan, 41 Indianola Drive.  The variances are granted as requested locating the proposed garage as noted on the site plan.  The property is consistent with the neighborhood.  The applicant has demonstrated a hardship.  No discussion and a vote was taken:  In favor:  R. McCall, P. Broadhurst, A. Stillman, A. Spargo  Opposed:  D. Alexander  Abstaining: None  The motion passed. 4-1-0

New Business:  A letter dated May 5, 2014 from Ahmed A. Dadi, P.E., as owner’s agent is requesting a one year extension of a variance granted on May 8, 2013 for Appeal No. 12/13-47C – 137 Nehantic Trail, Robert A. Chellstorp, owner to permit construction of a house with a detached garage and demolition of existing shed.  The Board discussed the matter and noted that there was not a reason as to why the extension was needed.  The Board would like a reason for the extension submitted for the June 11th meeting, but did grant an extension to June 11th.

A Motion was made by A. Stillman, seconded by R. McCall to grant an extension for Appeal No. 12/13-47C -137 Nehantic Trail to June 11, 2014 [next Regular Meeting] so that the owner or his agent can provide a reason for the extension of year.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, A. Stillman, A. Spargo  Opposed:  None  Abstaining: None  The motion passed unanimously. 5-0-0

Minutes:  A Motion was made by R. McCall, seconded by R. McIntyre to approve the Minutes of the April 9, 2014 Regular Meeting with the following correction:  pg. 3 it should be Adam Stillman, not Allan Stillman seated again.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, P. Broadhurst, A. Stillman, A. Spargo  Opposed:  None  Abstaining: None     The motion passed unanimously. 5-0-0

Adjournment:  A Motion was made by R. McCall, seconded by A. Spargo to adjourn the May 14, 2014 Regular Meeting of the Zoning Board of Appeals.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, A. Stillman, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 8:30 p.m.
