NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Special Meeting that was held on Wednesday, September 25, 2013  at 6:00 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Adam Stillman, Secretary, Philip Broadhurst, and Robert McIntyre

Present:  Alan Spargo, alternate and Kim Barrows, Clerk

Absent:  Christopher Billiau, alternate and Carl Garbe, alternate

The meeting was then called to order at 6:00 p.m.

The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

13/14-14 B Melissa V. Peck seeks a variance of Par. 10.8.2 and 10.8.3 (nonconformity lot size 12,500 s.f. required/4,800 s.f. proposed), Par. 24.5.1 as modified by 68.1.2(B)4 (narrow street setback/30’ required/18.1’ proposed), Par. 24.5.3 (other property line setback/15’ required/3.9’ proposed on east side and 7.7’ proposed on west side) and 24.6.2 (building/structure coverage 20% maximum/27.4% proposed) of the Zoning Regulations to permit demolition of existing house and construction of new 1,824 s.f. house which will meet FEMA regulations and codes on property located at 19 Beach Road East, Map No. 12, Lot No. 92.

Discussion with respect to the public hearing that closed this evening.  There was discussion with respect to reducing the coverage, stairs underneath reduces the coverage and the removal of the front deck reduces it further.  The coverage will be 26.1%.  Applicants made an honest effort to reduce building/structure coverage.  D. Alexander felt more could have been done to reduce it closer to the 20% allowed.  It is a modest home and an improvement to the neighborhood.

A Motion was made by A. Stillman, seconded by R. McIntyre to GRANT w/condition Application 13/14-14 – Melissa V. Peck at 19 Beach Road East. The variance is granted as requested and submitted in the application with one exception.  The exception is that the deck to the south side of the house be removed, the one on the second story.  The applicant has demonstrated good faith in complying with the wishes of the Zoning Board of Appeals.  They have demonstrated a hardship with the nonconforming lot and obviously there is no way the house can come into conformance with the configuration the Zoning Regulations require.  In addition their desire and intent to bring the home into compliance with flood plain management, it is consistent with the Town’s building plan and consistent as well with the nature and character of the neighborhood. Discussion:  R. McCall wanted to add that the stairs to the main level of the house will be underneath.  No further discussion.   Added to the motion:  Plans dated September 24, 2013 which shows reduced coverage and also shows that the exterior stairs on the west side of the house have been removed and the stairs have been moved internally inside the house.   A vote was taken:  In favor:  R. McCall, A. Stillman, P. Broadhurst, R. McIntyre   Opposed:  D. Alexander   Abstaining: None  The motion passed. 4-1-0

A. Stillman left the meeting at 6:40 and A. Spargo was seated

Municipal Coastal Site Plan Review for Nehantic Trail, Map 19/Lot 360, Residential A District, Applicant/Owner Daniel & Elena Roberts to permit construction of 2,160 s.f. residential structure, driveway and septic system on 12, 500 s.f. lot.

A Motion was made by R. McCall, seconded by P. Broadhurst to grant the CAM application since the proposal is consistent with the neighborhood and is also consistent with all applicable coastal policies and makes all reasonable measures to avoid adverse impacts.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  

Request for an extension of time with respect to Variance 12/13-12 Richard C. & Stephanie M. Gallitto at 30 Sea Breeze Road.  The variance was granted on September 12 2012 to permit demolition of existing dwelling and construction of a new two story dwelling with attached garage.  In a letter/e-mail dated September 23, 2013, the applicants request an extension since the cost of the project was substantially higher than expected.  The Board discussed the matter and made a motion to grant a one year extension.

A Motion was made by R. McCall, seconded by D. Alexander to grant a 12 month extension to October 1, 2014 for Application 12/13-12 Richard C. & Stephanie M. Gallitto, 30 Sea Breeze Road.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  

Adjournment:  A Motion was made by R. McCall, seconded by A. Spargo to adjourn the September 25, 2013 Special Meeting of the Zoning Board of Appeals.   No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Spargo  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 7:00 p.m.
