NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Regular Meeting that was held on Wednesday, September 11, 2013  at 7:30 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, and continued to Wednesday, September 18, 2013 heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Adam Stillman, Secretary, Philip Broadhurst and Robert McIntyre

Present:  Christopher Billiau, alternate and Alan Spargo, alternate and Kim Barrows, Clerk

Absent:  Carl Garbe, alternate

The meeting was then called to order at 7:30 p.m.

The following public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

13/14-12  Charles & Ann Serravalle, seeks a variance of  Par. 10.8.2 &  10.8.3 (nonconformity lot size 12,500 required/5,002 s.f. proposed); Par. 24.5.1 as modified by 68.1.2.B4 (narrow street line setback/30’ required/23.3’ proposed), Par 24.5.3(other property line setback/15’ required/6.9’ proposed on south side) and 24.6.2 (building/structure coverage 20% maximum/21% proposed) of the Zoning Regulations to permit the demolition of existing house and construction of new 1,344 s.f. house which will meet FEMA regulations and codes on property located at 10 Uncas Trail, Map 19/Lot 296.

Discussion with respect to the public hearing that closed this evening.  The ground coverage is being reduced.  It is consistent with the neighborhood if kept it as proposed.  Most of the coverage is due to the stair since the house is being elevated to meet the FEMA regulations.

A Motion was made by R. McCall, seconded by A. Stillman to GRANT Application 13/14-12 B Charles & Ann Serravalle to allow the applicants to build as proposed with the condition that the proposed shed be cut down to 6’ x 10’ as opposed to the existing 8’ x 12 and needs to meet the required zoning setbacks from both the rear and the south sideline boundary.  The hardship is that the house would be put on a confined small lot which would make it as proposed in conformity with the neighborhood. No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, P. Broadhurst, A. Stillman  Opposed:  None  Abstaining: None  The motion passed unanimously. 5-0-0

13/14-13C  Mary Worthen, seeks a variance of Par. 58.2  (Riparian Buffer Area Setback/100’ required/60’ proposed) & Par. 58.6 (Structure Setback Gateway Conservation Zone/100’ required/60’ proposed) of the Zoning Regulations to permit the construction of an 810 s.f. inground pool/spa and surrounding patio on property located at 330 Watrous Point Road, Map 64/Lot 17-2.

Discussion with respect to the public hearing that closed this evening. The pool proposal is consistent with the neighborhood.  The CT River Gateway Commission did not oppose the project but had recommendations on plantings/screening and soil erosion along the riverbank.  The pool meets all other setbacks except for the Gateway standards.

A Motion was made by D. Alexander, seconded by R. McIntyre to GRANT Application 13/14-13C B Mary Worthen for the pool at 330 Watrous Point Road – the entire project is completely consistent with the neighborhood in which its going to be and the Board very much appreciates the owners concern about the environment by protecting it and helping to keep it as nice as it is.  The recommendation from the CT River Gateway Commission regarding plantings is made a part of this motion and the plantings that are installed to screen the wall will be 3’ tall when installed and  they will be planted in a staggered row in front of the wall about 30 inches on center.  The recommendation would be that Pieris Japonica [commonly known as Andromeda] which is deer proof be planted and interspersed with Pinxter Azalea which is an indigenous azalea to this area and which will be nice to look at from the river.  Also to avoid the transport of any sediment into the river during the project, the riverfront should be stabilized as quickly as possible.    The Coastal Site Plan Review Application is approved as well because it is consistent with all applicable coastal policies and includes all reasonable measures to mitigate adverse impacts.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, P. Broadhurst, A. Stillman Opposed:  None  Abstaining: None  The motion passed unanimously. 5-0-0

13/14-14 Melissa V. Peck, seeks a variance of 10.8.2 &  10.8.3 (nonconformity lot size 12,500 s.f. required/4,800 s.f. proposed); Par. 24.5.1 as modified by 68.1.2.B4 (narrow street line setback/30’ required/18.1’ proposed); Par 24.5.3(other property line setback/15’ required/3.9’ proposed on east side & 7.7’ proposed on west side) and 24.6.2 (building/structure coverage 20% maximum/27.4% proposed) of the Zoning Regulations to permit the demolition of existing house and construction of new 1,824 s.f. house which will meet FEMA regulations and codes on property located at 19 Beach Road East, Map 12/Lot 92.

There was lengthy discussion between the Board, the applicant’s attorney and the contractor about reducing the building/structure coverage to conform more to the 20% allowed.  The applicant had agreed to remove the second floor deck on the Beach Road East side which reduced the coverage to 26.39%, which is a reduction from the existing which is 29.3%.  P. Broadhurst asked if the stairs on the side [west] could be relocated to underneath the structure.  Mr. Caldarella, the contractor, stated that he did not know if they could meet the headroom needed for the Building Code.  The applicant did not want to wait until the October meeting for a decision.  It was finally decided that a Special Meeting would be set.

A Motion was made by R. McCall, seconded by A. Stillman to SCHEDULE A SPECIAL MEETING FOR Wednesday, September 25, 2013 at 6:00 p.m. in the second floor conference room at Town Hall, 302 Main Street. No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander, R. McIntyre, P. Broadhurst, A. Stillman  Opposed:  None  Abstaining: None  The motion passed unanimously. 5-0-0

Adjournment:  A Motion was made by R. McCall, seconded by A. Stillman to adjourn the September 11, 2013 Regular Meeting of the Zoning Board of Appeals which was continued to September 18, 2013.  No discussion and a vote was taken: In favor: R. McCall, D. Alexander, P. Broadhurst, R. McIntyre, A. Stillman  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The meeting was adjourned at 9:40 p.m.
