NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Meeting that was held on Wednesday, November 9, 2011 at 7:30 p.m. at  the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:

Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Chris Gosselin, Secretary,  Joan Strickland and Brian Dooley

Present: Mary Kennedy (alternate) who was seated for 11/12-15 only, Kim Barrows, Clerk

Absent:  Allan Fogg (alternate) and Kent (Skip) Johnson (alternate)

The meeting was then called to order at 7:30 p.m.

The following  public hearings were conducted, as well as the decision making sessions.  The meeting has been recorded on tape and the following actions were taken:

The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.

11/12-12C B David L. Colvin seeks a variance of Par. 10.6.1 (nonconformity/use) of the Zoning Regulations to permit conversion of existing 3 season porch into living space and to square off foundation (addition of 44 s.f.) on property located at 1035 Boston Post Road, Map No. 28, Lot No. 35.

Discussion with respect to the public hearing that closed this evening. This is a large lot and the proposed addition is modest.  This is a residence in a business zone.  

A Motion was made by B. Dooley, seconded by C. Gosselin to GRANT Application 11/12-12C B David L. Colvin.   The CAM is approved.  Based on the discussion, the hardship is the historical setback on the property.  The improvements will aide health and safety along with the buildings integrity. The design is in harmony with the historical nature of the building.  No discussion. A vote was taken: In favor: R. McCall, D. Alexander, J. Strickland, C. Gosselin, B. Dooley   In Opposition: None   Abstaining:   None The motion unanimously passed.  5-0-0

11/12-13 B Brian D. and Kelly M. Beaulieu seek a variance of Par. 24.6 (maximum bldg./structure coverage 20% allowed/23% proposed) of  the Zoning Regulations to permit addition of multi-purpose family room on property located at 24 Sea Breeze Road (Cornfield Point), Map No. 3, Lot No. 166.

Discussion with respect to the public hearing that closed this evening. J. Strickland stated that the proposal doesn’t increase the coverage of the ground since there is a concrete slab there already.  C. Gosselin concurred, also it is not within the building setback lines. There is a slight increase in coverage, going from 21% to 23%, which the required is 20%.  

A Motion was made by R. McCall, seconded by J. Strickland to GRANT w/condition Application 11/12-13 B Brian D. and Kelly M. Beaulieu.  It does not really change, in once sense, the coverage of the ground since there is an existing slab where the proposed addition is to be located.  It does not encroach on the setbacks in any sense and it does not block any views for any of the neighbors.  It does increase the cosmetic appeal of the building considerably and is in harmony with the neighborhood. The condition is that there be no “bumpout” where the fireplace is proposed. The rear wall shall be flush all across the back to conform with the existing slab.  No further discussion. A vote was taken: In favor: R. McCall, D. Alexander, J. Strickland, C. Gosselin, B. Dooley   In Opposition: None   Abstaining:   None The motion unanimously passed.  5-0-0

11/12-14 B Saybrook Point Marina, LLC seeks a variance of Par. 37.5.2 (maximum gross floor area 40% required/53.8% proposed) of the Zoning Regulations to permit use of partial basement under rear addition as a game room by guests (total square footage 662 s.f.) on property located at 21 Bridge Street,  Map No. 24, Lot No. 53 – WITHDRAWN

Brian Dooley and Dorothy Alexander recused themselves from this application. Mary Kennedy was seated for this application only.

11/12-15 B Saybrook Point Marina, LLC seeks a variance of Par. 37.4.2 (front yard setback 25' required/22.25' existing) and Par. 37.4.3B (sideyard setback 15' required/5.8' existing) of the Zoning Regulations to permit repairs and renovations to deteriorating front and side porches (existing) on property located at 19 Bridge Street,  Map No. 24, Lot No. 54.

Discussion with respect to the public hearing that closed this evening.  The structural integrity of the porch has been diminished and needs to be fully replaced.  There is no further encroachment into the setbacks.  The house will be renovated, i.e. siding, trim, paint and will enhance the neighborhood.  The porch will have architectural features from the period within which it was originally built.

A Motion was made by C. Gosselin, seconded by J. Strickland to GRANT Application 11/12-15 B Saybrook Point Marina, LLC.  The hardship is the condition of the porch which is the driving factor to grant approval.  For safety purposes, the porch needs to be reconstructed and it is going to be done so in an architectural manner that more accurately represents the period of when the house was originally built.  It will also not project any further than the current porch already does so there is not an expansion in any regard or an increase in any of the nonconformities on the front of the house.  No discussion. A vote was taken: In favor: R. McCall, J. Strickland, C. Gosselin, M. Kennedy   In Opposition: None   Abstaining:   None The motion unanimously passed.  4-0-0

Minutes:   A Motion was made by R. McCall, seconded by D. Alexander to approve the Minutes of the October 12, 2011 Regular Meeting as submitted.  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander,  C. Gosselin, J. Strickland, B. Dooley  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0

New Business:  A Motion was made by R. McCall, seconded by D. Alexander to approve the 2012 Regular Meeting Schedule to hold meetings on the second Wednesday of every month at 7:30 p.m. in the first floor conference room, Town Hall, 302 Main Street, Old Saybrook..  No discussion and a vote was taken:  In favor:  R. McCall, D. Alexander,  C. Gosselin, J. Strickland, B. Dooley  Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0

Adjournment:  A Motion was made by R. McCall, seconded by D. Alexander to adjourn the November 9, 2011 Regular Meeting of the  Zoning Board of Appeals. No discussion and a vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, J. Strickland, B. Dooley   Opposed:  None  Abstaining: None   The motion passed unanimously. 5-0-0  The  meeting was adjourned at 8:30 p.m.
