NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Meeting that was held on Wednesday, July 13, 2011 at 7:30 p.m. at the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:
Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Chris Gosselin, Secretary, Brian Dooley and Mary Kennedy, alternate
Present: Kim Barrows, Clerk
Absent: Joan Strickland, Allan Fogg (alternate) and Kent (Skip) Johnson (alternate)
The meeting was then called to order at 7:30 p.m.
The following public hearings were conducted, as well as the decision making sessions. The meeting has been recorded on tape and the following actions were taken:
The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.
10/11-23 Robert P. Daniels and Maria T. Rose-Daniels seek a variance of Par. 24.5.2 (rear yard setback/15' required/5' from property line) and Par. 24.5.1 as modified by 68.1.2(B)4 (narrow street setback/30’ required/10.5’proposed) of the Zoning Regulations to permit demolition of existing barn/shed and construct new 24' x 28' (672 sq. ft.) garage with loft for storage above on property located at 85 Town Beach Road, Map No. 2, Lot Nos. 13 & 12.
Per letter dated July 8, 2011 from the applicants attorney, David Royston, the opening of the public hearing is postponed until the September 14, 2011 Regular meeting.
11/12-01 Linda Brigante seeks a variance of Par. 10.7.1 and 10.7.2 (nonconformity enlargement/change), Par. 24.3.1 (minimum lot area/20,000 s.f required/9,000 s.f. proposed), Par. 24.3.2 (minimum dimension of square/100' required/90' proposed), Par. 24.5.3 (sideline setback/15' required/13.04' proposed) and Par. 24.6.2 (maximum coverage/20% required/29% proposed, 32% existing) of the Zoning Regulations to permit demolition of existing house and shed and construct new house with partial second floor on property located at 23
Neptune Drive, Map No. 004, Lot No. 201.
Discussion with respect to the public hearing that closed this evening. There was discussion of the bilco door being within the side setback. Most of the Board members did not see this as a problem. There is not a full basement under the sunroom so the bilco door could not be moved back. The house is being rebuilt so its footprint, minus the bilco door is within the setbacks. B. Dooley stated that in a perfect world a structure could be built within the setbacks on a double lot such as this one. This is an attractive house design and the applicants have made an effort by correcting several issues on the site. C. Gosselin stated that the height of the house would be 28' from grade. There is a reduction or elimination of several of the nonconformities. There will be a new septic
system installed.
A Motion was made by B. Dooley, seconded by C. Gosselin to GRANT Application 11/12-01, Linda Brigante. The new design reduces a number of nonconformities and the building design is in harmony with the neighborhood. The height is also a good design for the building since it will be 28' from grade. No discussion. A vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, B. Dooley, M. Kennedy In Opposition: None Abstaining: None The motion passed. 5-0-0
11/12-02C William and Laurie Paetzold seek a variance of Par. 10.7.1 and 10.7.2 (nonconformity enlargement/change) and Par. 68.1.2 B9 (tidal wetland setback/required 50'/proposed 8' from tidal wetland) of the Zoning Regulations to permit demolition of existing gazebo and construct a new 14' x 18' gazebo with screens on property located at 30 Plum Bank Road, Map No. 6, Lot No. 24.
The public hearing is be held open until the September 14, 2011 Regular meeting with the consent of the property owners. The Board felt that the requested size of the gazebo, 14' x 18' was too large of a structure to be placed that close to the tidal wetlands. The Board has asked the applicants to consider a smaller gazebo, such as a 10' x 12' size, for the property.
A Motion was made by R. McCall, seconded by M. Kennedy to CONTINUE the public hearing on Application 11/12-02C, William and Laurie Paetzold until the September 14, 2011 Regular Meeting. The applicant is to present a proposal that is smaller in size to the Board. No discussion. A vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, B. Dooley, M. Kennedy In Opposition: None Abstaining: None The motion passed. 5-0-0
11/12-03 Monica K. and Michael A. Pitruzzello seek a variance of Par. 10.7.1 and 10.7.2 (nonconformity enlargement/change), Par. 24.5.1 as modified by 68.1.2(B)4 (narrow street setback/30’ required/10’ existing), Par. 24.6.1 (maximum floor area/40% required/50.9 +/- % existing/50.55 +/- % proposed) and Par. 24.6.2 (maximum coverage/20% required/39% existing) of the Zoning Regulations to permit renovation of master bedroom, square off the bedroom and add a second story deck with no roof on property located at 18
Mohican Trail (Indian Town), Map No. 13, Lot No. 37.
Discussion with respect to the public hearing that closed this evening. The applicant is reducing some of the nonconformities. The change to the house will add to the character of the structure. B. Dooley stated that all of the surrounding neighbors are in support of the proposal. There will be no change in the footprint and there will be a reduction of 19 square feet.
A Motion was made by C. Gosselin, seconded by R. McCall to GRANT Application 11/12-03, Monica K. and Michael A. Pitruzzello. The applicant has demonstrated sufficient hardship with the location of the house on the lot and its proximity to the road. The reduction of 19 square feet is a reduction of an existing nonconformity. The volume of the building is reduced thereby keeping it in harmony with the neighborhood. No discussion. A vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, B. Dooley, M. Kennedy In Opposition: None Abstaining: None The motion passed. 5-0-0
Minutes: A Motion was made by R. McCall, seconded by B. Dooley to approve the Minutes of the May 11, 2011 Regular Meeting as submitted. No discussion and a vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, B. Dooley, M. Kennedy Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
Adjournment: A Motion was made by R. McCall, seconded by D. Alexander to adjourn the July 13, 2011 Regular Meeting of the Zoning Board of Appeals. No discussion and a vote was taken: In favor: R.
