NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Meeting that was held on Wednesday, October 13, 2010 at 7:30 p.m. at the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:
Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Dorothy Alexander, Vice Chairman, Chris Gosselin, Joan Strickland and Brian Dooley
Present: Kim Barrows, Clerk
Absent: Kent (Skip) Johnson (alternate), Mary Kennedy (alternate) and Allan Fogg (alternate)
The meeting was then called to order at 7:30 p.m.
The following public hearings were conducted, as well as the decision making sessions. The meeting has been recorded on tape and the following actions were taken:
The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.
10/11-3 CB Angela Ferrucci and Jonathan Cook seek a variance of Par.10.7.1 (nonconformity), Par.10.7.2 (enlargement/change), Par. 10.8.3 (nonconformity/lots and area) and Par. 24.5.1 as modified by Par. 68.1.2 B4 (setback – narrow street setback/30 ft. required/ 27.65' to street line) of the Zoning Regulations to permit an addition to connect residential dwelling to detached garage providing access to second floor of house and finished room over garage, part of rear deck to be removed to reduce lot coverage on property located at 73
River Street, Map No. 49, Lot No. 29.
Mr. Cook gave his presentation and stated that the property was just inside the Gateway Conservation District and he did not feel that there was any impact on the view from the Connecticut River. The proposal is an addition of a small rectanglular structure to connect the house to the garage which will increase inside living space slightly, add a second bathroom and code compliant stairways. The Board felt that the application should be reviewed by the Gateway Commission, therefore a motion was made to continue the public hearing.
A Motion was made by R. McCall, seconded by C. Gosselin to CONTINUE the Public Hearing on Application 10/11-03C, Ferrucci/Cook until the November 10, 2010 Regular Meeting. The continuance is so that the applicant can present this application to the Gateway Commission for approval. No further discussion. A vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, J. Strickland, B. Dooley Opposed: None Abstaining: None. The motion passed unanimously. 5-0-0
10/11-4B Renata Morteo seeks a variance of Par.10.7.1 (nonconformity), Par. 24.5.1(setback – street setback/30 ft. required/ 28' over existing house footprint) and Par. 24.5.3 (setback-other/15' required/9.9' from property line nearest point) of the Zoning Regulations to permit conversion of second story improved attic area into a full second story (no increase in bedrooms) on property located at 30 Maplewood Street, Map No. 37, Lot No.25.
Discussion with respect to the public hearing that closed this evening. The hardship is the existing footprint on the lot. At the time the house was built it met the setbacks, but the narrow street setback came into play some time later. The project is consistent with the purpose and intent of zoning. The proposal will not increase ground coverage. The house with the change in roof pitch will go from a Cape Cod style home to a Colonial. There will remain two bedrooms on the second floor. There is no other place to expand the house on the lot due to the septic in the rear and the narrow street setbacks.
A Motion was made by C. Gosselin, seconded by R. McCall to GRANT Application 10/11-04, Renata Morteo. Sufficient hardship has been demonstrated with how the current house is placed on the lot and in reference to the modern day standards that now apply, that is the hardship as described by the applicant. The home and modifications are in character with the neighborhood and the additional investigative work done by the Health Department to insure that the septic system is performing is good. No further discussion. A vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, J. Strickland, B. Dooley Opposed: None Abstaining: None. The motion passed unanimously. 5-0-0
Minutes: A Motion was made by R. McCall, seconded by C. Gosselin to approve the Minutes of the September 8, 2010 Regular Meeting as submitted. No further discussion and a vote was taken: In favor: R. McCall, D. Alexander, J. Strickland, C. Gosselin, B. Dooley Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
Adjournment: A Motion was made by R. McCall, seconded by C. Gosselin to adjourn the October 13, 2010 Regular Meeting of the Zoning Board of Appeals. No discussion and a vote was taken: In favor: R. McCall, D. Alexander, C. Gosselin, J. Strickland, B. Dooley Opposed: None Abstaining: None The motion passed unanimously. 5-0-0 The meeting was adjourned at 8:30 p.m.
