Zoning Board of Appeals
Town of Old Saybrook
NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Town of Old Saybrook at its Meeting that was held on Wednesday, July 14, 2010 at 7:30 p.m. at the Town Hall, First Floor Conference Room, 302 Main Street, heard and decided the following appeals:
Seated for this evenings meeting and voting were the following members: Rexford McCall, Chairman, Chris Gosselin, Joan Strickland, Allan Fogg (alternate) and Mary Kennedy (alternate)
Present: Kim Barrows, Clerk
Absent: Dorothy Alexander, Vice Chairman, Brian Dooley and Kent (Skip) Johnson (alternate)
The meeting was then called to order at 7:40 p.m.
The following public hearings were conducted, as well as the decision making sessions. The meeting has been recorded on tape and the following actions were taken:
The Chairman introduced the Board members who were seated for this evenings meeting. The Chairman then proceeded to read the Legal Notice into the record.
09/10-30 CB Saybrook Point Marina, LLC seeks a variance of Par. 10.7.1 (nonconformity), Par. 37.4.2 (front setback fr. Bridge St./25' req./proposed 21.5' for 2nd story porch and 3rd story deck), Par. 37.4.3B (other property line/15' req./proposed 6.2' for 2nd story deck and 3rd story deck), Par. 37.4.3B (other property line/15' req./proposed 4.7' for 2nd story and for enclosed stairway at rear), Par. 62.4.5B (residential parking/7.5 on-site req./propose 6 spaces on site, 4 off-site) and
Par. 64.5.6A (sign dimensions/3 sq. ft. max req./propose 12 sq. ft. (3x4) max.) of the Zoning Regulations to permit renovations and upgrades to principal building which include demolition of one-story section to the rear and addition of second and third stories (see file for more details) on property located at 21 Bridge Street, Map No. 24, Lot No. 53.
Discussion with respect to the public hearing that closed this evening. R. McCall stated that the Conn. River Gateway Commission was in favor of the application and the Office of Long Island Sound Programs, Marcy Balint, stated that the project was generally consistent with their plan. M. Kennedy stated that there should be a condition imposed on the lighting in the designated parking area. C. Gosselin stated that the applicant has historically not done anything that would hurt the neighborhood. The Board felt that the applicants renovation/restoration of the home would enhance the neighborhood, and that it was within the intent of zoning. There was discussion with respect to the sign and the lighting of the sign on Bridge Street.
A Motion was made by R. McCall, seconded by C. Gosselin to GRANT w/Condition Application 09/10-30C Saybrook Point Marina, LLC as follows: it is only with a variance that changes can be made to meet building and health and zoning codes, it’s a reduction in some non conformities, it is a brand new septic system, there is approval from the Gateway Commission and the Coastal Site Plan Review and the hardship is the deplorable condition of the building which needs a variance for reconstruction, and it fronts on two streets so the setbacks from a corner lot are very difficult to meet, there is no enlargement of the setbacks or no encroachments into the setbacks from what exists already. The Coastal Site Plan is also approved. Discussion: A. Fogg, good to bring the structure up to code. A condition
to the variance for the sign is that the 12 square foot sign is to have no lighting. No further discussion. A vote was taken: In favor: R. McCall, C. Gosselin, J. Strickland, M. Kennedy, A. Fogg Opposed: None Abstaining: None. The motion passed unanimously. 5-0-0
Minutes: A Motion was made by R. McCall, seconded by M. Kennedy to approve the Minutes of the June 9, 2010 Regular Meeting as submitted. No further discussion and a vote was taken: In favor: R. McCall, J. Strickland, C. Gosselin, M. Kennedy, A. Fogg Opposed: None Abstaining: None The motion passed unanimously. 5-0-0
Adjournment: A Motion was made by M. Kennedy, seconded by J. Strickland to adjourn the July 14, 2010 Regular Meeting of the Zoning Board of Appeals. No discussion and a vote was taken: In favor: R. McCall, C. Gosselin, J. Strickland, M. Kennedy, A. Fogg Opposed: None Abstaining: None The motion passed unanimously. 5-0-0 The meeting was adjourned at 8:55 p.m.
The next Regular Meeting of the ZBA will be on Wednesday, August 11, 2010 at 7:30 p.m. at the TOWN HALL, First Floor Conference Room, 302 Main Street.
