MINUTES of SPECIAL TOWN MEETING  -  July 28, 2015


MINUTES of Special Town Meeting held at the Saybrook Point Pavilion, 150 College Street, Old Saybrook, Connecticut, on July 28, 2015.

Carl Fortuna, First Selectman, called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance.
Approximately 65 persons attending.  Barry Maynard moved, seconded by Joan Broadhurst and unanimously voted that Grant Westerson be Moderator of this meeting.  

ITEM 1.  To act upon the recommendation of the Board of Selectmen, and with the approval of the Old Saybrook Planning Commission, to implement an Agreement between the Town of Old Saybrook and Island Cove Marina, LLC, the Agreement being summarized as follows:

  • The Town of Old Saybrook will convey to Island Cove Marina, LLC those premises, consisting of .21 acres, more or less, being that portion of Sunrise Avenue extending in an easterly direction from its northerly terminus, as shown on a map entitled “Road Transfer and Easement Plan Town of Old Saybrook & Island Cove Marina, LLC” dated June 18, 2013;
  • Island Cove Marina LLC will convey, construct, and implement to the Town of Old Saybrook, at its cost, a road drainage system and easement from Channelside Drive over the land conveyed by the Town, as shown on the Subsurface Infiltration Basin Layout Plan revised to May 5, 2015;
  • Island Cove Marina, LLC will pay the Town of Old Saybrook the sum or $5,000.00;
  • The Town of Old Saybrook will discontinue as a Town road that portion of Channelside Drive conveyed to Island Cove Marina, LLC, as allowed under the provisions of Section 13a-49 of the Connecticut General Statutes.
A copy of the Agreement and Plans referred to above are on file in the Old Saybrook Town Clerk’s office.
A motion was duly made and seconded to consider Item 1.

The Moderator called on David Royston, attorney for Island Cove Marina LLC.   He reviewed the project from the establishment of Floral Park to present day relating to flooding.  He presented exhibits and engineer’s study of the problem which will cost Island Cove approximately $50,000 to comply with the Agreement and noted they will not acquire the deed to the property until the work on the drainage system is completed to the satisfaction of the Town.  He requested that the Moderator read the portion of the June 3, 2015 Planning Commission minutes relating to their approval of this plan.
First Selectman Fortuna spoke in favor of this project which has gone through significant review and approval by various Commissions.  He noted this is good for the neighborhood and the Town drainage rights.  Barbara Maynard spoke about the 1982 flood and damage that occurred, urging those present to approve this Item.
Eleanor LaPlace expressed her frustration with the project and moved, duly seconded, to postpone action on this Item.   Janis Esty moved to amend Ms. LaPlace’s motion and postpone this issue for not more than 30 days.  Attorney Michael Cronin ruled the amendment out of order.  After discussion on the Item Moderator Westerson called for a vote on Ms. LaPlace’s motion to postpone action on Item 1 of the call.  Voting for motion 7; plurality voted against and the Moderator declared this motion failed.

Moderator called for a voice vote and ITEM 1 was ADOPTED.

ITEM 2.  To act upon the recommendation of the Board of Selectmen, and with the approval of the Old Saybrook Planning Commission, to grant a non-exclusive driveway easement over property of the Town of Old Saybrook to Joshua Grochowski and Emily M. Grochowski for the driveway access to their residential premises situated at and known as 102 Old Boston Post Road, Old Saybrook, Connecticut.  The proposed easement area is 17 feet in width and is parallel to the westerly boundary line of the Grochowskis’ property for a distance of 301.38 feet.  The proposed easement is shown on a map entitled “Property Survey Joshua & Emily M. Grochowski 102 Old Boston Post Road Old Saybrook, Connecticut” dated August 20, 2014, a copy of which is on file in the Old Saybrook Town Clerk’s Office.

First Selectman Fortuna described the proposal.  This action will allow the Grochowskis’ to pass and repass (non-exclusive easement) on this piece of property and the Town does not relinquish ownership of this land.   Following comments, on a motion duly made and seconded the Moderator called for a voice vote and ITEM 2 was unanimously ADOPTED.

On a motion duly made and seconded it was unanimously voted to adjourn at 8:10 p.m.
