BUSINESS BEFORE THE BOARD
Discussion and approval of land acquisition contract with the Trust for Public Land (TPL): Town Attorney Michael Cronin went through pertinent aspects of the Purchase and Sale Agreement, which has been negotiated for over six months. He stressed how he felt it was important that we have a contract in place, but the issue was complicated by State involvement/co-ownership of the land. Some late changes concerned naming rights by large donors. He stated there are two contracts for approval: one for the large open space piece and one for the house on Bokum Road. The house on Bokum Road is, at this time, proposed to be sold but that will be decided by Town Meeting. The State will pay for the title work and TPL will deliver the property free of any other structures and/or dump sites.
Also discussed was the management agreement and easement. The management agreement was outlined by Carl Fortuna. There will be two members of the Committee, the State and the Town. There will be a stewardship fund, sustainable forestry, some regulated hunting and ongoing maintenance. However, neither party can mandate the other spend any money on the property. The easement is one for passive recreation and is basically a watershed easement and is similar to the Gleason properties. The easement states the prohibited uses, reserved uses and public access requirements.

Move approval of purchase of open space: FORTUNA/GERNHARDT, motion carried unanimously.

Move approval of approximately 2 acres with house: FORTUNA/GERNHARDT, motion carried unanimously.
