MINUTES
Present: First Selectman Carl Fortuna Jr., Selectman Scott Giegerich (arrival 3:40 p.m.),
Selectman Steven Gernhardt, Police Chief Spera and members of the public and press.

CALL TO ORDER – First Selectman Fortuna called the meeting to order at 3:35 P.m.

APPROVAL OF MINUTES Special Board of Selectmen Special Meeting May 14, 2013.

Motion to approve the minutes of the Special Board of Selectmen Special Meeting May 14, 2013.

VI.
BUSINESS BEFORE THE BOARD
  • Tax Refund to Elton D. Rhodes in the amount of $734.94.
First Selectman Fortuna noted that the tax refund is on open space, wetlands property off
 Beaver Dam Trail, to have been deeded approximately 30 years ago to the Town that Mr.
 Rhodes has been paying minimal taxes on.  The property has now been deeded to the Town
and by law only 3 years of taxes can be rebated to Mr. Rhodes.

Motion to issue a tax refund to Elton D. Rhodes in the amount of $734.94 in accordance with the request of the Tax Collector.

B.  Discuss and act on removing property located at 69 Middletown Avenue from seasonal
     classification recorded in Volume 200.

By consensus of the Board moved to Item D.
C.   To consider and act on proposed abandonment of a 4ft wide scenic walkway, Cornfield Pt.
First Selectman Fortuna opened for public discussion and invited those present to view the site map of the proposed strip for abandonment.  Monies exist and for the first time last year cleanup was completed to that area.  Presently the area bluff is heavily undermined as observed and determined by Town Engineer.  The Town has an obligation to maintain the easement and if something were to happen to walkway the Town is obligated it make it as it was.  The Town does not own the property.  First Selectman Fortuna read into the record a letter received from Sally and Bob Yoselevsky opposing the closing of the scenic walkway.

Motion to table recommendation to Planning Commission for abandonment of 4ft wide scenic walkway, Cornfield Point and revisit site with Town Engineer.

D.   Discuss and act on authorizing First Selectman Carl P. Fortuna, Jr. to sign the Provider
   Service Contract for the VNA of Southeastern CT for FY 2014.

Service Contract for the VNA of Southeastern CT for FY 2014.

E.  Discuss and act on Board of Selectmen resolution authorizing First Selectman,
  Carl P. Fortuna Jr. to sign copies of the Master Municipal Agreement for Construction
    Projects.

First Selectman Fortuna noted that the Master Municipal Agreement for Construction Projects is a Connecticut Department of Transportation document that simplifies the agreement process between the State and our Town when applying for state or federal monies.  The Agreement allows for the contract to be 90% negotiated.  The remaining 10% is negotiated at the time of the specific project making approval available within 1-2 weeks rather than 1-2 months.

Motion to approve resolution authorizing First Selectman Carl P. Fortuna Jr. to sign the Agreement entitled “Master Municipal Agreement for Construction Projects.

  • Motion to approve Call of Town Meeting for school projects.
First Selectman Fortuna noted that the Town plans to build a new police station and is hopeful to bundle for referendum the Goodwin School window project and the Middle School roof replacement project; optimistic to moving forward to catch a low interest rate environment.  The Call of Town Meeting is to appoint a Building Committee for the two school projects.  First Selectman Fortuna recommends the Board of Education to serve as the Building Committee allowing them to apply with Commissioner of Education by June 30th of this year for reimbursement in FY13/14 when the projects are being done.

Motion to approve Call for Special Town Meeting on Wednesday, June 12, 2013 at 6:30 p.m., Town Hall – First Floor Conference Room.

G.  APPOINTMENTS
     1.  Zoning Commission.  Alternate vacancy. This is a 2-year term due to expire on 11/2013.
     Selectman Gernhardt noted Democratic Town Committee recommendation of J. Colin Heffernan to serve as an alternate on the Zoning Commission.
FORTUNA/ GEIGERICH
First Selectman Fortuna sated that he intends to interview a Democratic candidate. Motion to table to allow for time to interview an additional candidate.

VII.
COMMENTS FROM THE SELECTMEN.    Selectman Gernhardt made comment in regards to Town website maintenance, specifically the Town calendar postings of Board/Commission meeting agendas, minutes and cancellations.  First Selectman Fortuna noted that centralized postings through the Town Clerks office was suggested but determined to continue the practice of each board/commission clerk to file.
First Selectman Fortuna noted that he intends to interview Robert Yust who is interested in the alternate position for the WPCA.
