                        SPECIAL MEETING OF THE BOARD OF SELECTMEN
                        Wednesday, January 2, 2013
                        3:30 P.M.
                        First Floor Conference Room
                        MINUTES

Present:  First Selectman Carl P. Fortuna Jr., Selectman Scott Giegerich, Selectman Steve Gernhardt,
Town Attorney Michael Cronin, members of the public and press.  
  •       CALL TO ORDERFirst Selectman Fortuna called the meeting to order at 3:30 P.M.
  •      PLEDGE OF ALLEGIANCE Not recited
  •      BUSINESS BEFORE THE BOARD
  •      Discuss and act to further amend the agreement for the acquisition of the cul-de-sac of  Center Road
      West (Offer to Purchase 2-18-05) which was authorized at a Referendum held in 2005.

First Selectman Fortuna called upon Attorney Cronin to outline the first item of business. Attorney
Cronin explained the purpose of the amendment which is to amend the original agreement. There is
a different layout of the buildings at this point and because this involves the sale of Town property,
it is prudent to go to Town Meeting.

Motion made and seconded to amend agreement

B.  Discuss and approve the Call for Special Town Meeting January 16, 2013.

Mr. Gernhardt had additional questions for Mr. Royston about whether the total square footage would
be changing now that there are two large buildings. Mr. Royston explained the layout, comparing the
layout to the original plans and indicating that there is no additional square footage. Mr. Gernhardt also
asked if these plans would still have to go through Zoning which they would. It was also explained
that there will be a light at Center Road which will be timed with Chalker Beach Road. Right now, the
development consists of a Big Y and a Kohl’s.

Carl Fortuna asked Attorney Royston to identify what exactly is being sold. This was demonstrated
on both maps and on Mr. Giegerich’s IPad on Google Maps.

After Town Meeting, the Board of Selectmen will be able to further amend the Agreement without
the need to go to Town Meeting so long as it is deemed consistent with the original purpose of the Agreement.

Flood Plain Ordinance Amendment.  Discussion: The amendment is added to assist homeowners in
getting flood insurance monies. Insurance companies now refer to a “storm event” that might cover
substantial damage (50% or more). The ordinance will correct that to read that if a home is damaged
in two storm events over ten years with damage over 50%, this clause is triggered which could give
a homeowner $30,000.00 to elevate their home. This will be more helpful to the homeowner because
we are amending the ordinance, we must go to Town Meeting.

  •       COMMENTS FROM THE SELECTMENSelectman Giegerich noted the near completion of the
  •    field at the Ferry Road Affordable Housing with sod and irrigation at a cost of approximately $40,000.
  •     The field will be utilized by the U12 youth, the largest population of active participants and when not
  •    being used by the Town it will provide a great backyard for the people in the HOPE Partnership.
  •    First Selectman Fortuna noted that he has obtained millings, at no expense, from the I-95 paving project
  •   which will create a parking lot at that site.
