MEETING OF THE BOARD OF SELECTMEN
Tuesday, November 13, 2012

MINUTES

Present:  First Selectman Carl P. Fortuna Jr., Selectman Scott Giegerich (by phone), Selectman Steve
Gernhardt (by phone), Finance Director Lisa Carver, Clean Energy Director Jessica Bailey, members of the public and press.  
  •    CALL TO ORDERFirst Selectman Fortuna called the meeting to order at 10:00 a.m.
  • I  PLEDGE OF ALLEGIANCERecited.
  • II  COMMENTS FROM THE PUBLIC Resident Robert Rutchik commented in regards to
  the mandatory evacuation notice, for both Irene and recent storm Sandy, and instruction for pet
 safety.  First Selectman Fortuna noted that initially pets were not allowed in the designated
  evacuation center, located at the High School, due to children safety and allergy concerns.    The
 anticipated magnitude of the storm surge, with the possibility a homeowner staying for their pet(s), a
  decision was made to allow pets at the evacuation center.  Over 30 pets were successfully crated at
  the shelter.
  Resident Carol Manning asked First Selectman Fortuna to look into whether Grant Westerson,
  member of Board of Finance, is on Town payroll.  First Selectman Fortuna stated it was his
understanding the issue was resolved but will look into it. Ms. Manning also inquired to vacancy
 appointments on the WPCA.  First Selectman Fortuna stated it is the Board of Selectmen intention to
fill the vacancies with qualified candidates within the next 4-6 weeks.
Resident Mary Hansen questioned the WPCA practice of Executive Session(s), whom authorizes
 compensatory time and whom do employees report to?  First Selectman Fortuna stated that he raised
 the appropriateness of Executive Session with WPCA Attorney John Wertam.  First Selectman
Fortuna stated that WPCA reports to the Board of Selectman as should all requests.

VI BUSINESS BEFORE THE BOARD
A.   Discuss and act on adopting Cafeteria Plan resolution for Town of Old Saybrook Premium Only Plan.
Finance Director Lisa Carver stated the adopting resolution will allow for the Town to continue to supply
pre-tax benefits to employees, an IRS required “premium only plan” (POP).  Cost of the plan is $300 annually.

B.  Create a capital account to authorize a Police Building Construction Project.
Treasurer Robert Fish recommended prior to the first dollars spent on the construction for the Police Building
Project the Board of Selectmen authorize the project.  Treasurer Fish noted that 2 accounts exist, the first opened
to pay for rent when the police department moved out of the present police building to their temporary location.
 The second account opened for the Police Building Committee to use on “soft” costs.  First Selectman noted that
he attended the Planning Commission Meeting last week at which time they approved the acquisition of 36 Lynde
Street as a municipal improvement.

J.  Appointments.
1.   Estuary Transit District.  Re-appointment Roland Laine; Board of Selectmen
      representative.  This is a 4-year term due to expire 11/2016.

2.  Historic District Commission.  Re-appointment regular member Mary Kennedy

     12/2017.

Motion to add to agenda discussion of the CPACE (Commercial Property Assessed Clean Energy) Program.

First Selectman Fortuna invited Jessica Bailey, Director, Clean Energy Finance Investment Authority, to explain how the program works.
 Ms. Bailey stated that the program was set up by legislation in 2011 for Clean Energy goals set for the State of Connecticut.  The program
is a tax lien financing program that allows interested building owners in Town that have opted into the program to get 100% up front low cost
long term financing in qualifying energy upgrades for their buildings and repay that as a line item on their property tax bill.  The Town would
have to agree to collect the repayment of the loan through the tax system.  Requirement would be that the upgrade(s) to the building be
permanently affixed to stay with the property.  Town is not liable if something is taken and not on the hook for any defaults.  Four Towns
in the State have already passed a resolution for the program; Norwalk, Middletown, Bridgeport and Hartford.
  •   II COMMENTS FROM THE SELECTMAN.  First Selectman Fortuna noted receipt of a letter from resident Mr. Gustafson thanking
the Town crew for the remarkable job in handling Storm Sandy debris cleanup.  The homeowner was so thankful he paid his tax installment early.
