SPECIAL MEETING OF THE BOARD OF SELECTMEN

MINUTES

Present: First Selectman Michael Pace, Selectman William Peace, Selectman Carol Manning, Town Counsel Michael Cronin, Town Planner Christine Nelson, ZEO Chris Costa, Public Works Director Larry Bonin, members of the press and public.



I.
CALL TO ORDER – First Selectman Pace called the meeting to order at 10:00 a.m.

PLEDGE OF ALLEGIANCE – First Selectman Pace led those in attendance

COMMENTS FROM THE PUBLIC - None
IV.
COMMENTS FROM THE SELECTMEN
Selectman Manning stated she had received an email from the President of the Great Hammock Beach Association. He stated that it seemed that the Public Works Department had let the signage project for the neighborhood fall by the wayside. Public Works Director Larry Bonin stated that the 15 MPH signs are not a stock item and they had to be custom ordered. Selectman Peace stated that during his tenure with the DOT, they never approved a 15 MPH zone.
First Selectmen Pace stated that through good management, for the twelfth consecutive year there will be a budget surplus. He thanked all departments for their due diligence.
V.
APPROVAL OF MINUTES Special Board of Selectmen Meeting of June 15, 2011.
MANNING/PEACE
Motion to approve the minutes of the Special Board of Selectmen Meeting of June 15, 2011 with the following corrections: On page one under Selectmen’s Comments, the second to last statement, second to last word “one” to be deleted. On page three second to last motion should read “Support Union” not “Supervisors Union.”
MOTION CARRIED UNANIMOUSLY

VI.
BUSINESS BEFORE THE BOARD
     A.  Discuss results of Team Avery Benefit
Larry Bonin reported that the June 11th Fundraiser at The Kate was a huge success. Cynthia Clegg, President and CEO of the Middlesex County Community Foundation announced that the total raised was $30,050. Mark Leopoldino introduced Avery Rose to everyone.
B.      PUBLIC HEARING:  Winterization
First Selectman Pace opened the Public Hearing at 10:25 a.m.; there were approximately 60 people in attendance. He asked Town Counsel Michael Cronin to review the history of the “200 List.” Town Planner Christine Nelson explained the steps that will be taken when the ordinance is revised. Building Official Don Lucas stated that he is developing a “checklist” that will be used to review each property. Wendy Arnold from the Health District stated that they will work with the town and homeowners to review the health requirements.
Residents asked questions, which were answered to their satisfaction. One resident thanked the town for the time and effort to bring this forward.
First Selectman Pace closed the Public Hearing at 11:15 a.m.
C.      Discuss and act on Seasonal Structures & Proposed Winterization Ordinance.

Motion to move to Town Meeting, date to be determined.
MOTION CARRIED UNANIMOUSLY
First Selectman Pace stated this is the last thing that he had on his long term agenda that he developed when he took office 12 years ago.
Attorney David Royston stated that this is a good action. Old Lyme is in the midst of a Federal Court Case because their Zoning Regulations still control winterization, not a town ordinance.
D.      Discuss and act on Ferry Crossing LLC, the Assignee of HOPE Partnership, Inc, and authorization for financing.
First Selectman Pace asked Attorney David Royston to address the board.
Attorney Royston reviewed a letter dated May 11, 2011 that he had submitted at the last Board of Selectmen’s meeting concerning “Leasehold Financing.” It requires that the town sign off so Ferry Crossing LLC, the Assignee of Hope Partnership can execute their mortgage documents.

Motion to authorize First Selectman Pace to sign documents for Ferry Crossing, LLC.
MOTION CARRIED UNANIMOUSLY
