Present: First Selectman Michael Pace, Selectman William Peace and Selectman Carol Manning, Town Clerk Sarah Becker, WPCA Site Coordinator Mike Evangelisti, Police Chief Michael Spera, WPCA Finance Manager Gratia Lewis, Treasurer Robert Fish, Board of Finance Members Barry O’Nell and John O’Brien, Police Commission Chairman Christina Burnham, Judge of Probate Terry Lomme, Town Counsel Michael Cronin, Attorney John Wertam, Attorney Bruce Chudwick, members of the public and the press.

CALL TO ORDER – First Selectman Pace called the meeting to order at 10:02 a.m.

COMMENTS FROM THE SELECTMAN
First Selectman Pace recognized the WPCA for their hard work over the years along with Shipman and Goodwin attorneys Bruce Chudwick and John Wertam on the sewer avoidance and creation of the Waste Water Management District.
He further stated that the 2009 – 2010 Audit has been received and we ended the year in the black.
Next years budget is going to be more difficult due to anticipated cuts in state aid. He has sent memos to the Board of Finance concerning a number of matters that will impact the town’s finances.
He also stated that he had received a letter from Matt Rubin concerning Eden Harbor asking that they be on the next Board of Selectmen’s agenda.

BUSINESS BEFORE THE BOARD
  • A.  Appointments
1.      Architectural Review Board - Vacancy alternate member.  This is a 3-year term due to expire 09/2013.

Motion to appoint Ben Akin. This is a 3-year term due to expire 09/2013.

2.      Conservation Commission – Term expirations. Re-appointment Robert Fish, Charles Cobb and Jerry Brophy.  These are 2-year terms due to expire 11/2012. Vacancy appointment.  This is a 2-year appointment due to expire 11/2011.

Motion to re-appoint Robert Fish, Charles Cobb and Jerry Brophy.  These are 2-year terms due to expire 11/2012. Bruce Sherwin to fill a vacant position. This is a 2-year appointment due to expire 11/2011.

4.      Historic District – Term Expirations.  Re-appointment Regular member Randi Bradbury and alternate member Mark Carruthers. These are both 5-year terms due to expire 12/2015.

5.      Water Pollution Control Authority.  To reaffirm and appoint WPCA members and appointments.

Motion to re-appoint Elsa Payne, Doris Zumbroski, and John Claffey, Jr. to 3-year terms due to expire 12/2013. To re-appoint Ed Gyllenhammer to a 2-year term due to expire 12/2012. To appoint Ian Featherstone to a 2-year term to expire 12/2012.

6.      Katharine Hepburn Cultural Arts Center Board of Trustees. Vacancy. This is a 3-year term due to expire 12/2013.

Motion to appoint Jerry Brophy to the Katharine Hepburn Cultural Arts Center Board of Trustees. This is a 3-year term due to expire 12/2013.

7.      Harbor Management Commission. Vacancy due to resignation. This is the balance of a 4-year term due to expire 11/2013.

B.  Tax Refunds
     1.  Robert T. Halle & Carole M. Coviello                                $10,406.58

Motion to accept recommendation of Tax Collector and approve Tax Refund.

C. Presentation by newly elected Probate Judge Terry Lomme.
First Selectman Pace invited newly elected Probate Judge Terry Lomme to address the board. Judge Lomme reviewed the changes that have been made with the consolidation of the nine probate courts to the Saybrook District Court. There were nine judges, now there is only one. There is a clerk from each town. The court will be open 8:30 a.m. to 4:30 p.m.
    C1. Discuss and act on Judge of Probate Memorandum of Understanding (MOU).
First Selectman Pace reviewed the MOU with the Town Counsel Mike Cronin and the Board.

Motion to authorize First Selectman Michael Pace to sign the MOU. Thanks are extended to retiring Probate Judge Roger Goodnow for doing a lot of the leg work to assist in setting this new court up. As well as thanking him for his 14 years of service.

D.  Discuss and act on 2011 Board of Selectmen Meeting Schedule.

Motion to approve the 2011 Board of Selectmen Meeting Schedule.
MOTION CARRIED 2 yea, 1 nay. Selectman Manning voted no because she would like to see some night meetings.
E.  Discuss and act on recommendation of Director of Public Works to release
     Encroachment Bond related to completed work at 2 Whitney Avenue.

Motion to accept recommendation of Director of Public Works to release Encroachment Bond related to completed work at 2 Whitney Avenue.
MOTION CARRIED UNANIMOUSLY
F.  Discuss and act on Water Pollution Control Authority Clean Water Fund contract through the State of Connecticut Department of Environmental Protection.
Attorney Bruce Chudwick stated that the WPCA has approved the CWF contract.

Motion to authorize First Selectman Michael Pace to sign any and all documents as recommended by attorneys Bruce Chudwick, Michael Cronin and John Wertam.

G.  Discuss and act on resolve of the Water Pollution Control Authority stipulated court agreement with the State of Connecticut Department of Environmental Protection.
Attorney John Wertam reviewed the stipulated court agreement. First Selectman Pace stated that this is in line with the August 2009 referendum.

Motion to authorize First Selectman Michael Pace to sign any and all documents as recommended by attorneys.

COMMENTS FROM THE SELECTMEN
First Selectman Pace invited Police Chief Spera to address the board.
Chief Spera reported that one Wednesday, December 30, 2010 a woman was rescued from Long Island Sound off Knollwood Beach. She was discovered by a jogger who called 911. The first rescuer on the scene was former Fire Chief David Heiney, followed by Firefighter Rebecca Lucas. Assisted by Police Officer James Kiacko and a passerby. The woman survived and was transported to the Shoreline Clinic. This was another example of how well the agencies worked together.
