SPECIAL MEETING OF THE BOARD OF SELECTMEN
Tuesday, October 26, 2010
1:00 P.M.

Minutes
Present: First Selectman Michael Pace, Selectman William Peace and Selectman Carol Manning, Attorney Pat McHale, Police Chief Michael Spera, members of the press and public.

CALL TO ORDER – First Selectman Pace called the meeting to order at 1:05 p.m.

COMMENTS FROM THE SELECTMEN
Selectman Peace stated that he had spent four days with the Board of Education in Strategic Planning for the schools, planning for the next 10 – 15 years. He very impressed with our school leadership, they are doing the best for the kids.
Working with the Fire Department on the furnace replacement, expects bids to go out in February. Goal is a high energy and efficient furnace. Additional funds are available from Northeast Utilities. By replacing the seven circulators can reduce annual savings by 6 percent.

BUSINESS BEFORE THE BOARD

A.  Discuss and investigate complaint of Harbor Management Commission Clerk Ruth Hockert against commission member Richard Goduti.
First Selectman Pace asked Attorney Pat McHale of the firm Kainen, Escalera and McHale to review the complaint.
Mr. McHale stated that Ruth Hockert had filed a complaint on June 21, 2010 with the First Selectman. She filed a second complaint on October 5, 2010.
Under the Town Charter the First Selectmen is responsible to investigate such complaints. He requested to have the entire Board of Selectmen handle and review the allegations.
Mr. McHale as well as the Board of Selectmen encourages the Harbor Management Commission Chairman to work with commission members.
A letter will be sent to Mr. Goduti to state that he is not acting under the guidelines of the town and that he would not be indemnified by the town insurance if Ms. Hockert were to bring any action against the town.
Selectman Manning read the letter that was sent to Mr. Goduti on June 23, 2010.
First Selectman Pace stated that he is trying to solve this in a civil manner.
Attorney McHale advised that the BOS should advise the HMC Chair to better control the meetings.
B.   Discuss and act on recommendation of town attorneys.

Motion to accept recommendation of Attorney McHale and send letter to Mr. Goduti

VII.
COMMENTS FROM THE SELECTMEN
Selectman Manning stated that there is a systemic problem with harassment and bullying. She recommended that some CCM courses be offered.
First Selectman Pace stated that reasonableness has been offered by the HMC Chairman and Board of Selectmen.
