Present: First Selectman Michael Pace, Selectman William Peace and Selectman Carol Manning, Tax Collector Barry Maynard, Attorney David Royston, Building Official Don Lucas, Enforcement Officer Chris Costa, members of the press and public.

CALL TO ORDER – First Selectman Pace called the meeting to order at 10:00 a.m.

PLEDGE OF ALLEGIANCE – Selectman Pace led those in attendance in the Pledge

COMMENTS FROM THE PUBLIC – None at this time
IV.
COMMENTS FROM THE SELECTMEN
Youth and Family Services has received, at no cost, a bus from 9 Town Transit, this will replace their aging van.

VI.
BUSINESS BEFORE THE BOARD

A.      Discuss and act on Winterization Issues, Seasonal Properties, Ordinance, Various specific property issues.
First Selectman Pace reviewed issues with five properties in town:
1)      98 Chalker Beach Road, residence of Marshall and Dawn Sonn – Mr. Sonn spoke of the family’s history at this residence – purchased property in 1979 at which time the home was a two family residence; utilized the property summers only between 1979-1984 but rented out property as academic rental during that time frame; relocated to this address permanently in 1985. Provided documentation from Connecticut Water Company stating continuous, year-round service since 1984; provided electric bills from 2000 on. Mr. Sonn stated lot size is 17,600 sf. Mr. Sonn also stated he was led to believe that previous town officials were to correct classification of this property from seasonal to year round and was surprised to be notified by his listing real estate agent that the property was still listed as a seasonal residence.

2)      43/45 Attawanhood Road – Mr. & Mrs. Winthrop Cody, Sr. and Mrs. Winthrop Cody, Jr., spoke with regard to this residence. Atty. David Royston also offered comments regarding the lot size and septic system for this property. Mr. Cody stated residence dates back to about 1930 and was utilized as summer cottage. Residence is located on 100’ x 100’ lot but does not meet current front yard and one side yard setbacks. Mr. Cody related that the residence directly to the north of the subject property was recently demolished and re-constructed on a 50’ x 100’ lot and was extended vertically. The Cody’s wish to retain the existing structure to keep it in the nature of the neighborhood.

3)      32 Pratt Road – Residence of Mr. Robert Coty. Mr. Coty addressed the Board with the history of this residence with regard to his family – Purchased by his father in 1955, Mr. Coty has owned property since 1969. House reportedly constructed in 1927 on cinder block foundation surrounding a crawl space. House currently heated with propane gas since 1990 – had electric heat prior to that date. Mr. Coty reported lot size was 80 x 100 and septic system upgraded in 2004. Mr. Coty reported that his mother had requested the property be placed on the seasonal list when the list was being generated.

4)      61 Town Beach Road – Summer residence of Bill and Nancy Heidel who are not contesting the classification of the residence as seasonal. Mrs. Heidel reported that the cottage is the oldest cottage in Cornfield Point, dating back to 1915 and constructed in the original red cedar shingle style. Mrs. Heidel reported the family has owned the property since 1945. Lot size is two, 50’ x 100’ lots. House reportedly has a stone foundation enclosing a crawl space.

5)      93 Middletown Avenue – Residence of Mr. Pavel Wilson who reported the house was constructed in 1909 and has been utilized as a year round residence since 1930. Mr. Wilson indicated that he had supplied documentation from at least two long-term neighbors who attest to the fact that the house was occupied during the winter months. Mr. Wilson has owned and occupied the house since 1984 and that there was heat in the residence when he had purchased it. Lot size was reported to be 4200 sf.
Next Steps
        1. Board of Selectmen will review the files on these properties.
        2. Hold a Public Hearing
        3. Have Planning and Zoning review
        4. Revise Ordinance, which will go to a Town Meeting

The Board of Selectmen will hold a Special Meeting on Monday, August 2, 2010 to further discuss this matter.

B.      Discuss and act on AT & T Lease Purchase for phone system for Youth and Family Services.
Executive Assistant Roland Laine reviewed the lease purchase for replacement of the phone system at Youth and Family Services.

Motion to accept recommendation of staff for a lease/purchase of phone equipment for Youth & Family Service in the amount of $1,373.47 per month for a 12 month lease with a $1.00 buyout.

C.      Discuss and act on CIGNA Health Insurance Documents.

Motion to authorize First Selectman Michael A. Pace to sign CIGNA Health Insurance Documents.

D.      Discuss and act on tax abatement of property acquired by Old Saybrook Land Trust at 34 Edmund Street (M22/L163).  
PEACE/MANNING
Motion to abate the taxes, interest and fees on property acquired by Old Saybrook Land Trust at 34 Edmund Street (M22/L163) totaling $65.80.

E.       Enter in Executive Session to discuss pending litigation.
PEACE/MANNING
Motion to enter Executive Session to discuss pending litigation. Session to include Roland W. Laine, Executive Assistant at 12:25 p.m.
The Board of Selectmen invited Public Works Director Larry Bonin, Public Works Employee William Claffey and Public Works Employee Adam Laverty at 1:10 p.m.
The Board returned to open session at 1:35 p.m.
The First Selectmen will send a letter to town employee to appear be fore the Board of Selectmen on July 20, 2010 at 4:30 p.m.
F.      Discuss and act on recommendation of town attorneys.
No action taken.
