MINUTES

PRESENT:  First Selectman Michael Pace, Selectman William Peace, Selectman Velma Thomas, Executive Assistant Roland Laine, Town Engineer Geoff Jacobson, Zoning Enforcement Officer Christina Costa, Attorney David Royston, Attorney Michael Cronin and members of the Press


I.
CALL TO ORDER
First Selectman Michael Pace called to order at 6:30 p.m.

PLEDGE OF ALLEGIANCE
First Selectman Michael Pace led those in attendance in the Pledge of Allegiance.
III.
COMMENTS FROM THE PUBLIC
None comments were taken.
IV.
COMMENTS FROM THE SELECTMEN
Selectman William Peace gave brief progress update regarding Founder’s Park.  He noted he had a discussion with Bob Fish regarding installing guardrails or placing boulders at the edge of the cliff for safety.  Would like to discuss options at next board meeting.
Selectman Velma Thomas noted the interior design committee is still meeting and at the last meeting a representative from a seating company brought a sample with him for the committee to try.  
First Selectman Michael Pace has met with the Building Committee for an update.  The sound systems and electrical systems specifications are nearing completion.  The New York Times is coming on Monday to do an article on the Center and Town.  He has received a letter from the DEP giving an update on the progress of the removal of the trains and tracks on Bokum Road.  He also received a letter from Youth and Family regarding 4 additional households that required energy assistance in February.  He brought in photos from this year’s Fishing Derby.

APPROVAL OF MINUTES of the Board of Selectman Meeting of
April 17, 2008 and Special Board of Selectman Meeting of April 27, 2008.

VI.
BUSINESS BEFORE THE BOARD

    First Selectman Michael Pace agreed to move items D and E of the top of the agenda to accommodate a scheduling conflict.

A.      Discuss and approve First Selectman Michael A. Pace to sign the Conservation Easement and Restriction for the Ziegler property re-subdivision.
     Attorney David Royston gave a brief history of the subdivision of subject property.  The public would have access to land deed to the Town in the right-of-way, for hiking, however the Town had no obligation to the current property owners for maintenance of this land, the Town had an obligation to the public.  It was also noted that the public had no access to the land designated for conservation.

    Motion to authorize First Selectman Michael Pace to sign the Conservation Easement and Restriction and the mylars.

B.      Discuss and act on winterization, 15 Beach View.

     First Selectman Michael Pace reviewed response from Attorney Michael Cronin regarding 15 Beach View noting there was no reason he found not to allow present owners to continue use of the property as a year-round residence.  Selectman William Peace inquired about the ‘200 list’, which was compromised of approximately 80 to 100 homes considered to be seasonal.  Zoning Enforcement Officer, Christina Costa, will get a more exact figure.

    Motion to remove 15 Beach View from the 200 list and re-designate as a year-round residence, subject to a letter of compliance from the Health District.

C.      Approve the Board of Selectman Resolution for incentive housing zone initiative to assist the Town in obtaining grant money for planning purposes.
Maryann Amore from the HOPE Partnership gave a brief description and answered questions regarding the new legislation regarding the incentive housing zone initiative.  The Town is requesting $50,000 to instigate the zoning process.  The zoning would allow the Town more control over the location of properties and types of buildings that would be designated as affordable housing within the community.

D.      Authorize First Selectman Michael A. Pace to sign contract for new accounting software.
Executive Assistant Roland Laine stated he had received notice that, as of June 30, 2008, the current accounting software used by the Town would be outdated and no longer supported by Sunguard Pentium.  He also noted that since the Town is a current customer, SunGard would give the Town a 50% discount on the updated accounting software. The Town would also need to upgrade its Microsoft software and install additional hardware to complete upgrade.  Payments to be made over a 5- year period, with the total cost of upgrading calculated to be approximately $35,000.00.  First Selectman Michael Pace noted that the Board of Finance had already approved $5,500 toward the necessary upgrade.

F.      Review of required changes in Old Saybrook Flood Plain Management Ordinance.
     Attorney Michael Cronin discussed the necessity of updating the Town’s Flood Plain Management Ordinance to comply with the National Flood Insurance Program.  Changes to the Ordinance will have to be submitted by August 28, 2008 or be subject to suspension by Federal Emergency Management Agency (FEMA).  All towns in the State of Connecticut are required to make necessary changes to their ordinances.  Old Saybrook’s Ordinance is a Town Ordinance is must be submitted to the public by Special Town Meeting for approval.  Town Engineer, Geoff Jacobson and Zoning Enforcement Officer, Christina Costa, reviewed maps and answered questions regarding the updated certification of elevation data from 1988 (most recent), that will be used.  It was noted no changes of existing boundaries for insurance purposes or designated flood zones, but will be more clearly defined.  Failure to make the necessary changes and updates and resulting in Old Saybrook being suspended from the program would have adverse effects on the Town.  Banks would be unable approve loans for properties within the Town of Old Saybrook and insurance companies may cancel coverage, possibly resulting in lenders recalling existing loans.  The proposed revisions will be made available on the Town’s website as well as copies at the Acton Public Library for the public to view prior to the meeting.  First Selectman Michael Pace is requesting copies be sent to all Land Use attorneys in Town as a courtesy.  Date for the Special Town Meeting will be decided upon at the next Board of Selectman Meeting.

    Motion to accept recommendation of Town Counsel Michael Cronin in submitting the proposed Revised Ordinance in the present form to the public at a Special Town Meeting.

G.      Discuss Department of Environmental Protection correspondence concerning Water Pollution Control Authority activities.
     First Selectman Michael Pace stated he had received a letter from the Department of Environmental Protection stating the Town had not completed requirements as agreed by within the time-frame agreed upon.  He sent a response that the requirements were currently being done and received a response saying all conditions had to be met by July 15, 2008 or they would be referring issues to the Attorney General.  First Selectman Michael Pace sent a letter stating the Town is acting in ‘Good Faith’ and working on a satisfactory solution for both the Town and the DEP.  He also noted that a part-time position had been filled through the Health District to monitor mandatory pump-outs.  He is confident the Town will meet the Department of Environmental Protection’s deadline.

H.      Enter into Executive Session to discuss legal matters.
