SPECIAL MEETING OF THE BOARD OF SELECTMEN

MINUTES

PRESENT: First Selectman Michael A. Pace, Selectman William Peace, Selectman Velma Thomas, Executive Assistant Roland Laine, members of the press and interested citizens.


I.
CALL TO ORDER
First Selectman Michael Pace called the meeting to order at 6:08 p.m.
II.
PLEDGE OF ALLEGIANCE
First Selectman Michael Pace led those in attendance in the Pledge of Allegiance.
III.
COMMENTS FROM THE PUBLIC –  Mrs. Jean Castagno read a letter into the record regarding the Elderly Benefit Committee.  She also requested clarification regarding the information posted to the Town website; questions concerning the WPCA and the CT River Health District.
IV.
COMMENTS FROM THE SELECTMEN –  Selectman Bill Peace provided an update regarding the bicycle trails.  He requested First Selectman Pace to send a letter to the Police Commission to request a study of the intersection of Ingham Hill Road and Elm Street.   The committee is hoping to establish a bike trail from Ingham Hill Road to Schoolhouse Road for non-motorized vehicles only.   First Selectman Pace suggested a letter should also be sent to the Planning Commission for their review and comments.  Mr. Peace stated he would draft this letter.  First Selectman Pace received a request from Zoning Commission requesting comments pertaining to a proposed zoning regulation text change regarding aquifer protection.  First Selectman Pace asked Ms. Thomas and Mr. Peace to review the proposed changes and comment.  First Selectman Pace noted that the Torchlight Parade held December 8, 2007 was excellent.  Bill Reed deserves a tremendous amount of credit. First Selectman Pace stated that he believes there were more groups and participants in this year’s parade than ever before.  Mr. Reed is one of our town volunteers who is always positive and puts forth such a great effort.
V.
APPROVAL OF MINUTES of the Board of Selectmen Special Meeting of November 20, 2007.

Motion to accept the minutes of the Special Meeting of November 20, 2007 with the addition of Selectman Thomas’ memo of support for the re-appointments of Town officials.

BUSINESS BEFORE THE BOARD
A.      Tax Refunds
     1.  F J Corsini II, LLC.                                                    $968.58
     2.  Joseph Rubera & Karen Rosol                               $288.48
THOMAS/PEACE
Motion to accept the recommendation of Tax Collector Barry Maynard and refund the overpayments of $968.58 to F.J. Corini II, LLC and $288.48 to Joseph Rubera & Karen Rosol.
MOTION CARRIED UNANIMOUSLY
B.      Discuss and act to exercise a 5-year renewal option by written notification
     and certificate of insurance to the Connecticut Department of  Transportation for Lease of State Land CT Route 154.
These are two pieces of land owned by the State and leased by the town.  The first piece is across the street from the Town Beach for additional parking.  The second piece is the land in front of James Pharmacy.

Motion to authorize signature for the First Selectman to exercise a 5-year renewal option by written notification and certificate of insurance to the Connecticut Department of Transportation for Lease of State Land CT Route 154.

C.      Discuss and act upon the recommendation of Town Engineer Nathan Jacobson for release of South Cove Hills Subdivision – Turnstone Road $5,800 Maintenance Bond.
This subdivision is near the Essex/Old Saybrook town line on Middlesex TPK.  Larry Bonin will follow up to make sure the work is completed.

Motion to accept the Town engineer’s recommendation and release the South Cove Hills Subdivision – Turnstone Road $5,800 maintenance bond.

D.      Appointments
1.      PENSION AND EMPLOYEE BENEFITS BOARD- Term expiration of Eileen Torrenti.  This is a five-year term due to expire 1/2013.

Motion to re-appoint Eileen Torrenti for a five-year term due to expire 1/2013.

2.      YOUTH & FAMILY SERVICES COMMISSION – Confirmation of Public Health Nursing Board appointment to Youth & Family Services Board.

Motion to table this appointment.

3.      . OLD SAYBROOK COUNCIL ON ENVIRONMENTAL QUALITY
Bob Fish, Chairman of the Conservation Commission, is requesting the BOS to establish this Council as a committee of one, Mr. Jerry Brophy, who will be the Council’s representative from the Conservation Commission.  This will allow the Council and the Commision to seek involvement from the whole community in the establishment of this Council.
PACE/PEACE
Motion to appointment Jerry Brophy as a committee of one to initiate the Old Saybrook Council on Environmental Quality.

E.  Executive Session to discuss pending litigation.
THOMAS/PEACE
Motion to convene executive session at 6:32 p.m. to discuss pending litigation with Selectman Thomas, Selectman Peace, Executive Assistant Roland Laine and Attorney Alexandria L. Voccio in attendance.

F.  Return to Open Session – The BOS returned to open session at 7:48 p.m.
G. Discuss and act on recommendation of legal counsel.

Motion to accept recommendation of legal counsel and sign documents.
