MINUTES


An Emergency Meeting of the Old Saybrook Police Commission was held on Friday, April 16, 2010 at the Old Saybrook Town Hall.  PRESENT:    Vice Chairman Conklin, Secretary Winkler, Commissioners Gallicchio, Sparaco, Metsack and Zemienieski. (Commissioner Zimienieski was present via phone) Chief Spera was also present.

  • Call to Order
       Vice - Chairman Conklin called the meeting to order at 5:25 p.m.

Vice Chairman Conklin presented the following agenda, following the Call to Order, for the Emergency
Meeting.  

Discuss and Act on a Waiver of Notice of the Emergency Meeting

Executive Session to Discuss Legal Strategy Concerning the Proposed
Emergency Relocation of the Department of Police Services Facility

II. Discuss and Act on a Waiver of Notice of the Emergency Meeting

  • It was discussed that five members of the Police Commission (Vice Chairman Conklin, Secretary Winkler, Commissioners Gallicchio, Sparaco, and Metsack) were in attendance at the Department of Police Services Facility Study / Building Committee Meeting that had just adjourned.  That the information shared at that meeting regarding the grave condition of police headquarters required immediate and urgent action by the Police Commission.  Those in attendance listened to reports by the Chief of Police, the Regional Director of Public Health, and Selectman Peace about the current condition of the facility.  These reports included a discussion on a power issue in the building, the scientifically confirmed presence of mold, a report of a failing roof, recommendations by an Air Quality Professional that all materials including sheetrock, insulation, carpeting and ceiling tiles must be removed from the first floor, and the fact that there is still water flowing, at a rate of almost twenty gallons a minute, into the sump pump chamber requiring additional pumps to manage.  Finally, it was witnessed that the Department of Police Services Facility Study / Building Committee unanimously voted to recommend to the Old Saybrook Police Commission and the Board of Selectman that an emergency relocation of the Department of Police Services Facility commence as soon as possible for the safety of the employees and in order to provide safe, efficient, and effective Law Enforcement Services to the public.  After discussion, a motion was made by Commissioner Gallicchio to waive notice of the meeting based on the emergent need to meet as a Commission. The motion was seconded by Secretary Winkler.  Motion Passed by unanimous vote.
III. Executive Session - To Discuss Legal Strategy Concerning the Proposed Emergency Relocation of the
                Department of Police Services Facility

  • A motion was made by Secretary Winkler to enter into Executive Session for the purpose of Discussing Legal Strategy Concerning the Proposed Emergency Relocation of the Department of Police Services Facility and inviting Chief Spera and Public Health Director Mary Jane Engle into Executive Session. The Motion was seconded by Commissioner Sparaco. Motion Passed by unanimous vote.

IV. Discuss and Act on the Emergency Relocation of the Department of Police Services Facility

  • Based on the witnessed discussion at the Department of Police Services Facility Study / Building Committee meeting, information learned and discussed about the grave condition of the current facility’s roof, first floor, basement, electrical and mechanical systems; the disruption of proper police operations, and the possible long term exposure risks that mold presents to the personnel and the public the Commission concluded that immediate action was required.  A motion was made by Commissioner Gallicchio to commence and recommend to the Board of Selectmen an Emergency Relocation of the Department of Police Services Facility to a suitable facility in the Town of Old Saybrook as soon as possible.  The motion was seconded by Commissioners Zemienieski and Sparaco.  Motion Passed by unanimous vote.
Following the vote, there was discussion regarding the absence of the Chairman as she was unable to attend the meeting due to a funereal.   There was question if the vote should be subject to her approval. It was decided that a quorum was present and that the vote was proper as six of the seven members of the Commission were present and that the Commission abided by their own by-laws and state regulations in conducting the meeting.  The Chief will notify the Chairman of the meeting and the items discussed and decisions made by the Commission.  The Chief will also speak to State FOI officials to ensure all proper procedures with regards to posting the minutes of the Emergency Meeting are met.     


  • Adjournment:
Motion made by Commissioner Metsack to adjourn the meeting. The motion was seconded by Commissioner Gallicchio. Motion passed by unanimous vote.
