OLD SAYBROOK POLICE COMMISSION

MINUTES OF SPECIAL MEETING
NOVEMBER 18, 2006




A special meeting of the Old Saybrook Police Commission was held on Saturday, November 18, 2006 at 3:00 p.m. at the Old Saybrook Police Department.  PRESENT:  Chairman Conklin, Commissioners Burnham, Dobratz, Gallicchio, Metsack, Sparaco and Winkler.  Also present were Chief Mosca and Town Attorney Michael Cronin.

Chairman Conklin called the meeting to order at 3:05 p.m.

Attorney Cronin explained that he requested this meeting to ask the commission for action in connection with the Cornfield Point road endings legal action.  He described the court proceedings to date, explaining that the town had been determined as the legal owner of the roads and road endings in Cornfield Point, but that a question remained as to the legal traffic authority and as to the number of parking places that would be determined at the road endings on Bellaire/Belleaire Drive, Saltaire Drive, Cottage Road and Billow Road.  

Attorney Cronin indicated that Cornfield Point Association had met earlier in the day and had voted to accept and sign a stipulation allowing 4 parking spaces and allowing the Police Commission to place additional spaces at a later date, if it so chooses.  

Attorney Cronin stated he felt it important for the Police Commission to adopt a resolution declaring its intent, as Legal Traffic Authority under State Statutes and Old Saybrook Code, to place one parking space at each of the four named road endings, which he would present to the judge in court on Monday, in addition to the signed stipulation.

During questions and discussions, Attorney Cronin indicated the commission was giving up no rights to determine the number or placement of future parking spaces at Cornfield Point road endings.  He also indicated that the proposed resolution, if adopted by the commission, would become a town ordinance.  He produced maps showing where the 4 parking spaces were proposed, in accordance with Planning & Zoning approval.  He distributed copies of the proposed resolution for review.

After discussion, motion was made by Comsr. Burnham and seconded by Comsr. Winkler to adopt the proposed resolution, with two grammatical corrections.  Motion passed by unanimous vote.  A copy of adopted Resolution Re Parking at Road Endings at Cornfield Point is attached to and made a part of these minutes.

Chief Mosca stated that the Police Commission, recognized by state statute as the Legal Traffic Authority for the town, has always worked with beach associations in considering their requests and asking for their input and discussions regarding traffic decisions.  However, the Police Commission, as Legal Traffic Authority, makes all determinations.  

Motion to adjourn made by Comsr. Burnham and seconded by Comsr. Sparaco.  Motion carried by unanimous vote.
