I.      CALL TO ORDER

Chairman Janis Esty called the meeting to order at 7:00 p.m.

II.     ROLL CALL

MOTION to approve the Minutes of March 4, 2015 as presented, MADE by M. Urban; SECONDED by D. Walden; VOTED IN FAVOR: J. Esty, M. Urban, D. Walden; OPPOSED: None; ABSTAINED: R. Missel; APPROVED: 3-0-1.

IV.     REFERRAL

A.  “Dibble/Rhodes” Petition to Amend the Old Saybrook Zoning Map from Residence AA-1 District to the Industrial I District
     Property of Clifford & Lynne Rhodes at 110 Ingham Hill Road (Assessor’s Map 35/Lot 9) & Property of Robert E. Dibble, Ingham Hill Road (Assessor’s Map 35/Lot 8), Coastal Area Management District.  Petitioner:  Robert & Jessie Dibble and Clifford & Lynne Rhodes    Agent:  Robert Doane, P.E.

                Robert Doane, presenting for the applicant, explained the request is to change the Rhodes’ property from Zone AA-1 to Industrial Zone                 I-1; and to change the entire Dibble property to Industrial Zone I-1.

At 7:05 Ken Soudan and Kathleen Sugland arrived.

R. Doane stated that the property to be changed is immediately adjacent to the existing Dibble gravel Pit, which is zoned I-1 and so is of similar character to the property that is zoned I-1.

Michael Urban expressed concern about planned future use in the rezoned property, and that the area near the Oyster River is of concern regarding pollutants getting into the water.

MOTION to send a favorable recommendation to the Zoning Commission for “Dibble/Rhodes” Petition to Amend the Old Saybrook Zoning Map from Residence AA-1 District to the Industrial I District  Property of Clifford & Lynne Rhodes at 110 Ingham Hill Road (Assessor’s Map 35/Lot 9) & Property of Robert E. Dibble, Ingham Hill Road (Assessor’s Map 35/Lot 8), Coastal Area Management District. Petitioner:  Robert & Jessie Dibble and Clifford & Lynne Rhodes    Agent:  Robert Doane, P.E.; as it is not inconsistent with the Town Plan of Conservation and Development, noting that the Planning Commission is concerned that part of the property being zoned, specifically the north east corner that faces Fishing Brook, be protected from pollutants or adverse actions that would compromise the environment in that area. MADE by R. Missel; SECONDED by D. Walden; VOTED IN FAVOR: J. Esty, R. Missel, D. Walden, M. Urban; OPPOSED: None; ABSTAINED: None; APPROVED: 4-0-0.

V.      NEW BUSINESS

            A.     “Community Water Systems” Discussion of Attorney Mark Branse’s letter dated, February 12, 2015.

Attorney Eliza Heins explained the reasoning behind modifying Town regulations 6.2 and 6.3. Attorney Branse suggested that the regulation divide up the Certificate of Public Necessity and Convenience requirement with Phase IA, or Phases IA and IB, being performed prior to approval by the Commission; and Phase II being a condition of approval that would occur after approval of the development.

MOTION to ask Branse & Willis to modify the Town’s regulations to reflect “Community Water Systems” per Branse & Willis’s recommendations; MADE: by J. Esty; SECONDED: by M. Urban; VOTED IN FAVOR J. Esty, R. Missel, M. Urban, D. Walden; OPPOSED: None; ABSTAINED: None; APPROVED: 4-0-0.

VI.     ADJOURNMENT
MOTION to adjourn the meeting at 7:50 p.m. until the next regularly scheduled meeting of the Planning Commission on April 1, 2015, at 7:00 p.m., 302 Main Street, Town Hall, 1st Floor Conference Room; MADE: by D.
