I.      CALL TO ORDER

Chairman McIntyre called the regular meeting to order at 7:30 p.m.  Four commission members were seated to vote.

III.    REGULAR BUSINESS

  • Minutes – July 21, 2010 minutes were tabled until the next regular meeting.
  • Correspondence and Bills- Letter from Essex merchant inquiring about whether Old Saybrook uses a Municipal Parking Fund.
MOTION to pay invoice #72789 from Jacobson & Associates in the amount of $14.00.  MADE by Robert McIntyre, SECONDED by Janis Esty; IN FAVOR: Robert McIntyre, Janis Esty, Salvatore Aresco, Donald Ranaudo; OPPOSED: None; ABSTAINED: None; APPROVED: 4-0-0

C.      Committee, Representative & Staff Reports – Ms. Nelson reported that a bus shelter will be installed near Staples.  The shelter will be used by Nine Town Transit in its routes to points north along RT 9 to Middletown and points east and west along I-95 from New London to Madison.

IV.     OLD BUSINESS

A.      “Marina Village” Special Exception Application/Coastal Site Plan Review (18 ac.)
        Façade and other renovations to existing buildings and structures; renovation of existing building for restaurant/office uses; renovation of existing 4-bedroom dwelling for office/retail uses; construction of new 2,646 s.f. boat repair building; and construction of new sewerage treatment maintenance building; all at existing 289 slip marina.

        Applicant: Between the Bridges, LLC.    Agent: William A. Childress, Esq.
        ACTION: Review for consistency with Town Plans; report for 8/16/10 ZC public hearing.

B.      “Marina Village” Affordable Housing Development Site Plan Review and zoning text amendments pursuant to C.G.S. 8-30g (18 ac.)
        Construction of 90 dwelling units with appurtenant sewerage treatment facilities and maintenance building, parking, and amenities; and renovations and improvements of existing structures.

        Revisions to zoning text for Section 9 Definitions to add “set-aside affordable housing development;” Section 24 (Residence A District) and Section 35 (Marine Commercial District) to add set-aside affordable housing development and bulk regulations for use in this development only. ~
        Applicant: Between the Bridges, LLC.    Agent: William A. Childress, Esq.
        ACTION: Review for consistency with Town Plans; report for 8/16/10 ZC public hearing.


The Commission reviewed two supplemental documents submitted by the Applicant.  Attorney Childress presented an updated plan for the parking area that overlooks the CT River to create an at-grade platform for a coastal pedestrian viewing area.  Attorney Childress also provided a photo rendition of the greenery around the marine commercial buildings using “green screens” as it will appear from the river.

Mr. Aresco would like to see the 8-30g units dispersed evenly throughout the 4 lots that make up the development.  Mr. Aresco pointed out that 14 of a total of 27 affordable units (51%) are located in Building E. Attorney Childress explained that the 4 lots are part of one development and will be treated as a single development.  Attorney Childress explained the Affordable Housing Land Use Appeals Act recognizes that the development must be economically viable for the developer, therefore, placement of the affordable units must be at the developer’s discretion.  The Commission understand that it may be cost prohibitive to locate affordable housing on the east side of Ferry Road, and discussed how affordable units could be more evenly dispersed on the west side with respect to the act..  
  
MOTION to send a favorable recommendation to the Zoning Commission for the “Marina Village” Special Exception Application/Coastal Site Plan Review (18 ac.)  139, 142 & 163 Ferry Rd (M45/L11, 14, 29, 33) as consistent with the Town Plan of Conservation and Development, specifically: Town Image (Policy), Economic Development (Goals), (Policy), Residential Development (Goals), Conservation & Open Spaces (Goal), Cultural and Historical Resources (Policy), Water Resources (Issues), and the Gateway Conservation Plan by improving the view from the sea to the land from the Connecticut River.  MADE by Robert McIntyre, SECONDED by Donald Ranaudo; IN FAVOR: Robert McIntyre, Janis Esty, Salvatore Aresco, Donald Ranaudo; OPPOSED: None; ABSTAINED: None; APPROVED: 4-0-0

MOTION to send a favorable recommendation to the Zoning Commission for the “Marina Village” Affordable Housing Development Site Plan Review and zoning text amendments pursuant to C.G.S. 8-30g (18 ac.) 139, 142 & 163 Ferry Rd (M45/L11, 14, 29, 33) as consistent with the Town Plan of Conservation and Development, specifically, Residential Development (Goals), Cultural and Historical Resources (Policy), Transportation (Issues).  However, the Commission recommends that the affordable units be more evenly dispersed throughout the development on the west side of Ferry Road.  MADE by Robert McIntyre, SECONDED by Donald Ranaudo; IN FAVOR: Robert McIntyre, Janis Esty, Salvatore Aresco, Donald Ranaudo; OPPOSED: None; ABSTAINED: None; APPROVED: 4-0-0


V.      ADJOURNMENT
