I.        CALL TO ORDER

Chairman, Robert McIntyre, called the regular meeting to order at 7:30 p.m.

III.    REGULAR BUSINESS

A.      Minutes

MOTION to approve the minutes of January 6, 2010 as written; MADE by D. Ranaudo; SECONDED by J. Esty; VOTED IN FAVOR: R. McIntyre, J. Esty, D. Ranaudo, S. Aresco, R. Missel; OPPOSED: none; ABSTAINED: none.; APPROVED: 5-0-0.

       B.      Correspondence

In their packets, members received statement # 24267 from Branse, Willis & Knapp dated 1/01/10 in the amount of $290.00 for legal consultant fees for Golinowski, LLC. Christine Nelson explained that the subdivision was approved in 2006 however, documents have not been filed on the land records by the applicant’s attorney.  As a result, legal consultant fees continue and the Ordinance 71 legal fees collected have been exhausted.  Therefore, any further legal fees for this matter will be billed to the Planning Commission budget.  The Commission agreed that a decision must be made by the next meeting if the applicant is going forward with the subdivision.

Also in their packets, members received a memo correcting an Accounting error which posted $640.20 to Dept. of PW for road regulations.  The debit should have been from the Planning budget contractual.

Minutes from CRERPA were included in member’s packets.
C.      Committee, Representative & Staff Reports

C. Nelson reported that the LUD is giving orientation to Zoning Commission and Architectural Review Board to familiarize them with the final Incentive Housing Design Guidelines.  

C. Nelson also reported that the Town will be taking an inventory of all storm water inlets and outlets in order to comply with DEP requirement for all towns to provide a detailed Storm Water Management Plan.

IV.     OLD BUSINESS

V.      NEW BUSINESS

A.      Municipal Improvement to Acquire Land of Keven P. Correl
        0 Coulter Street (Map 49 /Lot 8) Res. A, Coastal Management Zone, Gateway Cons. Zone
        Petitioner: BOS’ Land Acquisition Committee     Agent: Robert W. Fish, Chairman
        ACTION: Consider per Town plans; and Report for 2/4/10 BOS mtg.

C. Nelson explained that the owner of 0 Coulter Street, Map 49, Lot 8 has agreed to make a charitable donation of his tidal marshland property.  The parcel is located adjacent to Founders Memorial Park.  The parcel has been identified as targeted land for purchase by the town.

MOTION to make a favorable recommendation to the BOS for the acquisition of 0 Coulter Street, Map 49, Lot 8, by the Town of Old Saybrook in order for 1.) the protection of habitat for native plant or animal species listed as threatened, endangered, or of special concern and 2.) to preserve ecologically viable habitat, meaning areas of environments in which an organism or biological population normally lives or occurs; MADE by R. McIntyre; SECONDED by  S. Aresco; VOTED IN FAVOR: R. McIntyre, J. Esty, D. Ranaudo, R. Missel, S. Aresco; OPPOSED: none; ABSTAINED: none.; APPROVED: 5-0-0.

VI.     WORKSHOP

        A.      Scenic Roads
                Connecticut Route 154, Ingham Hill Road and Schoolhouse Road
ACTION: Consider per Town plans; and Report for 2/4/20 BOS mtg.

R. McIntyre reminded the Commission that the Town’s current ordinance concerning violations on scenic roads are vague.  However, under Connecticut State Statue, fines are allowed. The Commission discussed whether it wants to propose an update to the Town Code to include fines or penalties.  S. Aresco feels that a program to educate landowners of the historical significance and value of property along a scenic road may give them a sense of stewardship to protect the historical landmarks.  J. Esty agrees but feels that without the ability to impose restitution or reconstruction the Commission will have no recourse if violations occur.  The Commission unanimously agrees education is most important.  For the next meeting C. Nelson will provide examples of other town’s regulations along with the State Statute information.  S. Aresco will speak with the Historical Society to ask for their help in identifying historical trees, stone walls, etc. that characterize our scenic roadways.  K. Flanagan will continue to work on an article for publication in Old Saybrook Events to educate towns people on the importance of scenic roadways.
