III. REGULAR BUSINESS
A. Minutes
MOTION to approve the minutes of May 16, 2007 as amended. On page 5, paragraph 7, change the spelling of “copula” to “cupola”. MADE By J. Gallicchio. SECONDED by S. Aresco. VOTED IN FAVOR: R. McIntyre, J. Gallicchio, S. Aresco, OPPOSED: none; ABSTAINED: J. Esty, R. Tietjen APPROVED: 3-0-2.
B. Correspondence
Members’ packets contain the following: minutes and an agenda from the Zoning Commission, minutes from the Inlands Wetlands & Watercourses Commission, minutes and an agenda from the Architectural Review Board, minutes from the Conservation Commission, a permit dated 4/19/07 from the IW&WC for Merritt Lane Holdings, LLC on 6 Merritt Lane, a memo dated 5/22/07 from Scott Martinson from the CT River Area Health District re: proposed lot line change, 28 & 30 Riverside Avenue (Map 59 / lot 92 & 94), and letters dated 5/15/07 re: the “Terray” Subdivision from Mrs. Corinne Kilty’s mother, Elizabeth Terray, and from Mrs. Kilty’s siblings, Amy L. Terray, D.C., Kimberly Jensen (Terray), and Laurie Sizemore (Terray).
C. Committee, Representative & Staff Reports
R. Tietjen reported on CRERPA. He mentioned that at the last meeting of the Planning Commission, he stated that the CRERPA Greenway was going to be changed to a State Greenway in the estuary region. It’s now official and has been approved.
R. Tietjen also mentioned that there is a meeting of the Rockfall Foundation scheduled for October 19, 2007.
C. Nelson added that the Rockfall Foundation is an environmental forum, and that they are looking at conservation and land use in Middlesex County.
C. Nelson reported on a workshop in which a speaker came to discuss light pollution. The Architectural Review Board is interested in how they can encourage or require residences and businesses to be more respectful of the night sky by reducing light glare, proliferation of lights and insensitive lighting.
C. Nelson also reported on the second of workshops held with business owners of the Boston Post Road area. There was a lot of good input and a plan for design guidelines is being set up.
C. Nelson also talked about HOPE, a local affordable housing development group that spoke about getting people into homes and out of hotels. She may plan for them to come back to speak again and give a status update.
C. Nelson told the commission that a Blight Ordinance is currently being drafted.
C. Nelson brought to the Commission’s attention a map re: a lot line change for John and Diane Aldi/Captain Aldi, Inc,. 68 North Cove Road, Map 31 / Lots 1& 4. C. Nelson said the request for the lot line change is for the purpose of putting in a swimming pool. Because this is only an administrative function, the Planning Commission did not need to vote or to make a motion. C. Nelson said she just needed R. McIntyre to sign it which he did.

V. OLD BUSINESS
A. “Terray” Subdivision of Land & Coastal Site Plan – 2 Lots (10.10 ac.)

Applicant: Corinne Kilty, Owner Agent: William A. Childress, Esq.
ACTION: Consider and act by 6/20/07 mtg. (NLT 6/21/07)
Two items were submitted by C. Nelson for the record: a permit from the IW&WC dated 5/17/07 for Corinne Kilty, and a statement clarifying open space requirements of Old Saybrook Subdivision Regulations.
Atty. Childress presented for the applicant. He said that C. Nelson suggested that a note be put on the map re: the exemption from open space requirements.
Atty. Childress said that he had presented his case to the Commission at the last meeting, and unless they had any questions, he had nothing further to present.
J. Gallicchio referred to her notes from an informal review from 11/2/05 re: a subdivision with a shared driveway for 3 lots. She said the issue of paving was discussed for that subdivision at that time. She brought it up to discuss the idea of waived paving of a shared driveway for a subdivision.
J. Gallicchio talked about the request to consider waiving only that section of 6.9.4 requiring a shared driveway that requires paving. All the other requirements would be upheld. She also said that in terms of planning, it would be better for the entry to be on the Old Post Road.
J. Gallicchio then asked C.Nelson about a comment in the minutes of the PC from 5-21-07 in which Atty. Childress said that C. Nelson said she did not object to the waiver of paving.
C. Nelson said that she did not object to the waiver of paving. J. Gallicchio then asked C. Nelson for her view on the issue of a shared paved driveway vs. a shared unpaved driveway. C. Nelson responded by explaining that driveways can work whether they are paved or not. If problems occur, it is often because the property owners sharing the driveway do not get along, and the town must step in to mediate the problem. If the property owners are willing to maintain the driveway, whether paved or unpaved, and if the driveway meets the standards set forth in the town’s subdivision regulations re: stormwater and ease of maintainance, and emergency vehicle access, etc., the Planning Commission can discuss individual cases in a case by case basis.
J. Gallicchio suggested if the Commission were to approve the subdivision, perhaps they could waive only the word “pavement”, but still uphold the other requirements of a shared driveway re: width and construction standards.
Atty. Childress said the applicant would be happy to accept that decision from the Commission, waiving only the portion of the regulation that requires paving.
B. McIntyre clarified that if approved, there would still be an easement for utility vehicles under the Carsten’s property, but there would be no vehicular access.
Atty. Childress stated that this would be fine with the applicant.
Atty. Childress said that in the declaration that he presented at the last meeting re: the Daniel Terray parcel, Mr. Terray agreed to share in the maintainance of a shared driveway, and both lots (1 existing and 1 proposed), would share in the maintainence on a pro rata basis.
J. Gallicchio asked C. Nelson about conditions of approval. A note will be put on the plan record. The Daniel Terray declaration will be put on the land deed, but it does not have to be put in the motion.
MOTION to grant the waiver as requested by the applicant Section 6.9.4A of the Subdivision Regulations only that part of the requirement which requires the shared driveway to be paved. Atty. Childress asked the Commission about Section 5.2.6 re: lot access across frontage. The access can’t go across frontage in this case because it would go through several hundred feet of wetlands.

Childress, Esq. with the modification that it’s included on the plan the statement re: the exemption of open space for relatives and the Coastal Site Plan is also approved in that it is consistent with applicable Coastal Management Policies. R. Tietjen asked about the exemption in regard to the transfer of lots and the open space waiver.
Atty. Childress responded that it’s exempt from this type of application. This puts the public on notice that should additional lots be put on, they must qualify or they will have to provide open space or a fee in lieu of open space.
