Vice Chairman Charles Sohl called the regular meeting to order at 7:32 p.m. Four commission members were seated to vote and one member arrived at 7:42 p.m.

A. 09-008 Nancy Engberg (Mike’s Quality Meats & Fine Deli)
Application to construct a 31-seat restaurant addition.

Action: Accept application, determine if significant activity and if Ordinance 71 fees are required.
Mr. Bob Doane, of Doane-Collins Engineering Associates, LLC, appeared on behalf of the Applicant, Nancy Engberg to explain the details of the application.
Mr. Doane explained that currently the building consists of a deli on the first floor and a hair salon on 2nd floor. The plan is to remove the hair salon and add an office on the second floor. The first floor will remain as a deli with plans to add a 31 seat restaurant. The addition will be 1400 sq ft. As part of the plan additional parking spaces will be added to accommodate the zoning requirements. The property is located in the 100 foot upland review area. The wetland/watercourse is located to the south/west side of the property. The east side of the watercourse is maintained as a lawn right to the watercourse. The western side of the watercourse is vegetation. The topography of the parcel is nearly level. There is a 2 foot drop from the building
location to the stream.
During the construction they plan on removing 100 cubic yards of topsoil and subsoil in order to build the foundation and re-grade the area. The subsoil will be removed from the site and the topsoil will be stockpiled on site.
Mr. Sohl asked if the applicant plans on building a deck. Mr. Doane said that he was told there are no plans for a deck. There is currently outside seating that will remain. Mr. Doane noted that the plans may change to reflect the adjustment of the parking lot location to allow for a vegetative buffer between the parking lot and the roadway.
Bob McIntyre commented on the location of the stockpile. It is very close to the wetlands. Mr. Doane will look at one other location on the property. He will add more detail on the plans to show additional silt fence barriers with hay bales if it remains in the current location.
Mr. Pollock asked why the dumpsters are being relocated to within the regulated area. Mr. Doane said he is moving them because they are unsightly where they are now and will add screening which he cannot in the dumpsters’ current location
Mr. Sohl would like to see fencing added between the lawn area and the wetland/watercourse to allow a vegetative buffer. Mr. Doane will work with Mr. Richard Snarski, the soil scientist to determine a wetland buffer.
Mr. Sohl asked about the roof drainage. Mr. Doane said rain water currently drains off the roof to the ground and there are no plans to change that.

Application for construction activities associated with the new construction of a 14-unit residential development and recreational field. Housing use activities to include: construction of a hammerhead turnaround at the end of the access driveway, a refuse/recycle dumpster area, a water quality basin with berm and wood post guardrail, and associated site grading for the above activities. Recreational use activities to include: contouring the currently filled and seeded area, deposition of topsoil in order to construct a 60yd x 85yd multi-use playing field, grading and construction of a 36-space parking area and installation of a barrier fence adjacent to the wetlands along western boundary to prevent access.

Mr. George Smilas, with Bennett & Smilas Engineering, Inc., presented the application on behalf of the applicant. Mr. Smilas handed out new plans which include revisions noted on page 2 of the plans. He explained what changes were made as a result of the discussion held with this commission last month.
The refuse container locations will remain at the end of the turnaround area at the north side of the property, but are 35 feet further away from the wetlands. The turnaround area is made of a “grass paved” porous surface. The wood guard rail will be made of non-creosote wood. The water quality basin to accumulate runoff from the site will include a hardened surface area to allow for any overflow water from the basin. The recreational portion of the property, now included in this application, has a reduced number of parking spaces and is moved further to the east away from the wetlands. The runoff from the parking lot will be directed towards the fields before entering the wetlands to the west. The fields will be contoured with a 2% slope, as is appears currently, with an
additional 6 inches of topsoil added to allow the growth of grass. A fence will be installed, possibly stockade, 4 feet high, as a barrier to the wetlands. A final fence decision will be made prior to the next meeting. Mr. Smilas noted that the recreation area wetlands have no defined outlet. Mr. Smilas also handed the commission copies of the Town of Old Saybrook protocol for turf maintenance in regards to the chemicals applied to the fields. All materials are approved by the EPA.
Mr. McIntyre asked about the vegetation removal and plantings on the new plans. Mr. Smilas pointed out Note #16 on Page #2 on plan which shows a large spruce that will remain. Any other vegetation will be protected by a silt fence around the construction area which will act as the barrier for other vegetation. Note #19 states that the water meter will be removed. The Commission still has not seen any alternative site layouts presented by the Applicant. Mr. Smilas explained that this plan is the best practically and economically for the lenders and the funders working with the site due to the fact that a large portion of this site was excavated and filled in the past which limits its use and the possible locations of the residential units and their septic systems.
Mr. McIntyre asked about the size of the dumpsters, Mr. Smilas said the pad measures 15 ft by 6-7 ft. He feels 3 dumpsters of 5 x 5 or 5 x 6 should fit, if necessary there is room for more dumpsters in the turnaround area.
Mr. McKeown feels that there is a lot of “stuff” i.e.: buildings, septic systems and parking areas included in this small parcel which can all effect nearby wetlands.
No sheds are proposed at this time on the ball field, only portable toilet facilities will be placed on the recreation side.
Mr. McKeown asked where the snow removal will be directed for the parking area on the recreation side. Mr. Smilas will look into it.
Mr. Pollock asked if there will be room for rescue vehicles on the residential side. Mr. Smilas said the roadway will allow for 2 vehicles side by side. The plans will have to be reviewed by the fire and police.

A. Ralph Gometz
Install a rain garden with in the review area of development plan.

Action: Discuss
Mr. Ralph Gometz handed out a cross section of a proposed rain garden (retention facility) along with a survey and a preliminary plan for his property. The properties are in the Old Saybrook Industrial Center located at 2 Center Road West known as lots 7 & 8. Mr. Gometz explained how the rain garden will be constructed and how it will be used by future building sites on his property. Mr. Gometz reminded the Commission that this area was filled 4 times over the years.
