Chairman, Paul Smith, called the regular meeting to order at 7:30 p.m. and seated all attendant members to vote.

III.    PUBLIC HEARING

A.      Proposed Amendments to Section 8-4 of the Old Saybrook Inland Wetlands &     Watercourses Regulations to include mandatory application referral to the Commissioner of Public Health for compliance with Public Act no. 06-053, Section 2, Section 22a-42f of the Connecticut General Statutes.

MOTION to Approve amendments to Section 8-4 of the Old Saybrook Inland Wetlands & Watercourses Regulations to include mandatory application referral to the Commissioner of Public Health.  MADE by K. Gallahger.  SECONDED by W. Pollock.  No discussion on the motion.  IN FAVOR:  P. Smith, K. Gallagher, W. Pollock, R. McIntyre, C. Wehrly, B. McKeown, C. B.      Max’s Place, LLC.                                                                       
Attorney David Royston sent a letter to the IWWC Commission dated 3/28/07, asking for a 2 year permit extension for application #05-012, Max’s Place, LLC., on the basis that the court appeal related to the subdivision has prohibited them from moving forward at this time.                         
MOTION to Extend permit #05-012, Max’s Place, LLC., for an additional 2 years from its current expiration date of July 14, 2007 to an expiration date of July 14, 2009.  MADE by K. IV.     OLD BUSINESS
                                        
A.   07-003      Merritt Lane Holdings, LLC.
                             Application for 2-Lot subdivision on 27.55 acres with one existing home.  Construction  of one new 7.68 ac. residential building lot, extension of existing gravel driveway       through 100’ wetland review area and installation of underground utilities through
     100’ wetland review area.  No wetlands activity proposed.

The public hearing portion of this application was closed at last month’s meeting.  The Commission members continued their review.  Paul Smith mentioned that the application was for a 2 lot subdivision and mentioned that the access drive and utilities were outside the 100’ foot review area.

MOTION to Approve application #07-003, Merritt Lane Holdings, LLC., 6 Merritt Lane (Map 52/Lot 3-1) with site plan revisions dated 3/14/07.  It was recommended that the IWWC staff write a letter to the Planning Commission to establish a conservation easement on the northern portion of the property following the existing  #52 contour which is approximately 50’ feet beyond the 100’ foot buffer area.  MADE by K. Gallagher.  SECONDED by B. McKeown.  No discussion on the motion.  IN FAVOR:  P. Smith, K. Gallagher, C. Sohl, W. Pollock, B. McKeown, C. Wehrly, R. V.      NEW BUSINESS
        
    A.   07-004           Corinne Kilty
  Application to subdivide a 1.72-acre parcel from a 8.3 ac. parcel for the purpose of   
   building a 3 bedroom single family home.  No activity is proposed in the wetland        area within the 100’ foot review area.
  134 Old Post Rd. (Map 19/Lot 44), Residence A District
  ACTION:  Accept complete application; determine activity significance, request   
   technical fee if needed.
                                                
        Angus McDonald, engineer for the applicant, summarized the application to subdivide a 1.72 acre parcel leaving a remaining 8.3 acre parcel.  The Commission members decided not to deem this application a “significant activity”, Ordinance 71 fees were not required. 

MOTION to Accept application  # 07-004, Corinne Kilty, 134 Old Post Rd. (Map 19/Lot 44).  The next regularly scheduled meeting will be held on Thursday, May 17, 2007 at 7:30 p.m. at the Pasbeshauke Pavilion, Saybrook Point Park, 155 College St. Extension.  MADE by K. Gallagher.  SECONDED by W. Pollock.  No discussion on the motion.  IN FAVOR:  P. Smith, C. Sohl, R. McIntyre, C. Wehrly, K. Gallagher, B. McKeown, W. VI.     DISCUSSION

Classic Carriage Auto Wash – Cease & Desist
Discuss violation.
351 Boston Post Rd. (Map 42/Lot 10-1)
                                                        
           John Pytlik, owner of Classic Carriage Auto Wash, was present and answered questions by Commission members regarding the filling of the wetland buffer area on his property.  Mr Pytlik stated that the fill was obtained by Tilcon and was mostly processed stone, concrete and asphalt.  Mr. Pytlik said he was unaware that the area was a buffer to a wetland and would like guidance by the IWWC Commission to restore the damage he had done.  Chris Costa, IWWC enforcement officer suggested that Mr. Pytlik contact Richard Snarski, soil scientist, as he may have old plans of the property which may show the area of the original wetlands.  The Commission members told Mr. Pytlik he will need to obtain a prepared survey map at least one week prior to the next regularly scheduled meeting so it can be distributed in the Commission packets.

The survey should include:  1.) information from Mr. Snarski regarding past wetland flaggings of the property before it was filled.  2.) site map with contour lines of the entire property, boundaries, and the area that was filled.  3.) the site map should show the area of disturbance behind the gas tanks, car wash and delineate the area to the rear of the building.  4.) the site map should show (super- imposed) the building and structures 20’ feet adjacent to the disturbed area.  5.)  site map should show the elevations on top of the “placed” fill all the way to the rear of the property.

Bob McIntyre mentioned that a backhoe was parked in the wetland buffer area and needs to be removed before oil leaks into the wetlands.  Paul Smith said the drying pit needs to be relocated as well.       

VII.    REGULAR BUSINESS

A.      Staff Report

Chris Costa discussed a proposed 20’ x 60’ garage bay to store motor vehicles/trucks at the Town garage.  Ms. Costa mentioned that the bay would be 125’ feet from the wetlands.  Mr. Smith said that Larry Bonin, Department of Public Works, does not need to come before the Commission.

B.      Representative & Subcommittee Reports

Kim Gallagher asked the Commission for information to give to Bob Fish for his proposal to install a “fish ladder” in Crystal Lake to support spawning fish.
