III. PUBLIC HEARINGS
A. 06-033 Olek Golinowski, LLC. (1.15 total acres of wetlands)
Application to construct a road for access to residential subdivision.
165-167 Bokum Road (Map 61/Lot 13), Residence AA-3 District
ACTIONS: Accepted: 5/18/06, Open PH: 6/15/06,
The Public Hearing remained open so the Commission members could have time to review the technical reports they received at last month’s meeting. The hearing was closed for public
comment last month. Paul Smith read a report, into the record, from Geoff Jacobson dated 8/17/06. The Commission members were able to review and accept a revised plan dated 8/14/06 because the hearing had remained open.
Maurice Woodworth, agent for the applicant, submitted an original document signed by Mark & Jamie Dowaliby showing the drainage easement placed on the property.
Eric Davidson, Environmental Planning Service, answered questions from Kim Gallagher regarding the road salt impact on the wetland area. Mr. Davidson said that a combination of sand, grit and sediment associated with development is more a concern than salt. It was Mr. Davidson’s opinion that a wet basin and grass swale would be an efficient way to filter downstream water.
Public Hearing was closed by Paul Smith and the Commission members voted.
MOTION to approve application #06-033, Olek Golinowski, 165-167 Bokum Road (Map 61/Lot13), with the following conditions:
1.) Install wet bottom basin.
2.) Include all suggestions of Jacobson report dated 8/17/06 in addition to earlier reports by Geoff Jacobson.
3.) Install 2 Hydro Dynamic separators, one near detention pond discharge and one at Bokum Road intersection before the pipe turns south.
4.) Encourage applicant & adjacent property owner to consider a possible agreement for a grass swale at the discharge from Bokum Road but, if no agreement is made then the 200’ of pipe will be allowed as shown of the plans.

B. 06-034 Jay Rankin, (336 s.f. of wetlands to be altered)
Application to subdivide the property into 9 lots accessed by public roadways. A portion of the access road, Bethel Heights, crosses wetlands as shown on the plans.

ACTIONS: Accepted: 6/15/06, Open PH: 7/20/06,
This Public Hearing was continued from last month’s meeting. The applicant submitted a request for extension to consider and incorporate comments from the Town’s engineering consultant Geoff Jacobson which they received earlier this week. Chairman Paul Smith continued the Public Hearing until next month’s regularly scheduled meeting on 9/21/06.
C. 06-036 Merritt Lane Holdings, LLC.
Application to create 6 total building lots on existing 27.55 acre parcel, construct and improve access roadways on Town property for access to parcel & Town open space.
6 Merritt Lane (Map 52/Lot 3-1), Residence AA-1 District
ACTIONS: Accepted: 7/20/06, Open PH: 8/17/06,
Kim Gallagher stated that she knows certain parties involved in this application but that she could make a fair judgment on this matter. No one present at the meeting indicated any objection to Kim sitting to hear and consider this application.
Attorney David Royston submitted the public notice mail receipts and summarized a report dated 8/14/06 from Richard Snarski , soil and wetland scientist for the applicant. Attorney Royston also stated that the applicant will submit a check for the Ordinance 71 fees as soon as the technical fee amounts have been established.
Mr. Joseph Wren, engineer for the applicant summarized the application and discussed the plans known as Exhibit A-1, Sheet IND-1, revised and dated 7/27/06. Mr. Wren also discussed photos of the area designated as Exhibit A2, A3 and A4 and the proposed roadway plan Sheet RWY-1. Paul Smith asked Mr. Wren questions regarding the proposed wetland crossing plan titled GD-3. Mr. Smith asked Mr. Wren to provide information at next month’s meeting about the amount of ledge to be removed, clearing limits, construction limits and amount of upland acreage to be altered.
Joe Wren read a memo from Richard Snarski about the wetland areas, wetland buffer, roadway, conservation easement area, open space area and drainage. Mr. Wren stated that Richard Snarski would be present at next month’s meeting to address questions from the Commission members. Charles Sohl asked Mr. Wren if the Commission members could do a site walk, Mr. Wren said that was acceptable and would coordinate a time and place with Damon Hearne, IWWC enforcement officer.
Paul Smith opened the Public Hearing to the audience.
William Marston, 326 Main St., said he had not heard any mention of a conservation easement which was placed on the Great Cedar Conservation area. Attorney Royston addressed the question and stated that the applicant was aware of the easement restriction. Paul Smith asked Damon Hearne to look into the restrictions on the property with our legal counsel Attorney Cronin.
Barbara Guenther, 19 Cedarwood Lane, was concerned with the amount of road way that would take up land from the Great Cedar Conservation area. Ms. Guenther presented the Commission with a document from the Conservation Commission titled “Great Cedar Conservation Area East – Natural Resources Assessment and Mapping Study” dated 9/2005. Mr. Smith asked the IWWC staff to make additional copies and send them out to the Commission members for their review.
Chris Cryder, 6 Crowley Drive, asked for clarification regarding the paved roads and the intermittent stream running through a man made pond on the property. Mr. Cryder asked if an inventory had been taken of the plant species including the bog system within the stream. Mr. Wren said he believed that an inventory study had not been done.
James Cahill, Lynde St., mentioned that Merritt Lane has a 25 foot wide easement as a private residential road that goes over Town land.
Paul Smith closed the Hearing to the Public. Mr. Smith stated that this hearing would be continued until next regularly scheduled meeting on 9/21/06.
IV. OLD BUSINESS
A. 06-041 Arnold & Alma Phillips
Application to modify existing permit to eliminate requirement to remove abandoned driveway area.

Arnold Phillips summarized his intentions and the need to modify his existing permit.
MOTION: to modify an existing permit #05-018 to eliminate the condition requiring removal of the abandoned driveway fill and instead require Mr. Phillips, application #06-041, under direct observation of Damon Hearne, to till the existing area to a minimum depth of 6”, put suitable top soil and suitable plantings suggested by Richard Snarski and Mr. Hearne in the area and remove excess asphalt material left next to the roadway. Robert Tulisano summarized his proposal to clear enough trees to build a house. Mr. Tulisano proposed an asphalt driveway and a silt fence which would be placed 15’ off the rear of the house he proposed to build.

C. 06-040 Thomas Massini
No activity proposed. Application is pending to formally approve subdivision made without formal approval in 1950s.
Boston Post Rd. (Map 44/Lot 18) Residence B-3 District
ACTIONS: Accepted: 7/20/06, Act by: 9/21/06
Attorney William Childress, representing the applicant, expressed the need for a report from the IWWC to the Planning Commission regarding the remaining lot on a parcel of land that the Massini brothers purchased in 1949. In 1950 the land was divided into 4 parcels and the Massini siblings built homes on 3 of the 4 lots. The 4th lot (2 acres) remained vacant and today cannot be deemed a building lot without subdivision approval. Attorney Childress stated that the Planning Board needs a report from the IWWC Commission saying that the Commission has reviewed the subdivision that created the lot and has no objection to the matter. It was noted that a Wetland application would be required for any future construction proposed on the lot.
MOTION: to approve application #06-040, Thomas Massini, Boston Post Rd.( Map 44/Lot 18)with the following conditions:
1.) No activity is proposed or permitted at this time.
2.) A formal application must come back before the IWWC prior to any construction on the site.

A. 06-042 Samuel and Allison Barnes
Application to construct a house addition and porch within 70 feet of wetlands.
37 Cottage Place (Map 29/Lot 52), Residence A District
ACTIONS: Accept complete application; determine activity significance, request technical fee if needed.
Sam Barnes summarized the application consisting of a two story construction to replace part of the existing home, a porch addition with attached roof, and septic system replacement with a new larger tank in the same location. Paul Smith asked Mr. Barnes to modify the Doane –Collins plans modified to show the outline of the existing driveway and lawn area.
MOTION: to accept application #06-042, Samuel and Allison Barnes, 37 Cottage Place (Map 29/Lot 52). ACTIONS: Accept complete application, determine activity significance;
request Ordinance 71 technical fee.
Mr. Neibrief answered questions from the Commission members about the wetland stream that runs through the back of his property. Mr. Neibrief said he would bring photos of the stream and the location of the stream from the proposed deck to be built, at next month’s meeting.

MOTION: to amend the earlier approval of application #06-033, Olek Golinowski, 165-167 Bokum Rd. (Map 61/Lot 13) to incorporate the fact that the existing wetlands are approved to be filled based on the small size and relatively low value of the wetlands and the lack of feasible and prudent alternatives due to limited property frontage on the public roadway.
