A. Election of Officers.
Robert McIntyre nominated Paul Smith, Acting Chairman, to be the Chairman of the IWWC Commission. There were no other nominees. Paul Smith recused himself from the vote.

A. 05-021 Bessoni Builders

ACTION: Review and act.
Paul Smith closed the public hearing and the Commission members talked about the various concerns regarding this property and its current tenants. The IWWC Enforcement Officer, Damon Hearne, went out to the site and observed construction equipment, abandoned automobiles, parts and debris scattered around the property. The silt fence that was installed to protect the wetland area prior to the construction of the buildings was not intact and falling apart.
The owner of the property, George Bessoni, was present at the meeting. Mr. Bessoni was advised by the Commission members to clean up the site and find a way to insure that his tenants comply with Town requirements.
Charles Sohl suggested giving Mr. Bessoni one month’s time to allow him to enforce and fix the existing violations. Paul Smith stated that Mr. Bessoni would have to address these issues and continuously monitor and manage his tenants to address the concerns of the Commission about considering his proposal to construct another building on this property. Mr. Smith advised Mr. Bessoni to meet with Damon Hearne, IWWC Enforcement Officer, for specific conditions which could improve the existing property condition.

Frank Reichart recused himself from this application.
Anthony Hendricks, engineer representing the applicant, mentioned that test holes
have not been conducted on the site but he expects to find suitable material on the
site. Mr. Hendricks stated that the proposed septic system is 40’ feet inside the regulated area but it is significantly better than the current cistern which has no tank, and is just a pit in the ground. Mr. Hendricks will put a silt fence around the dry well that is to be abandoned.
Charles Sohl asked Mr. Hendricks if the primary or reserve septic leach field could be located at the front of the house instead of the rear. Mr. Hendricks said a pump system would have to be installed which is not desirable.

V. NEW BUSINESS
A. 05-026 Max’s Place, LLC.
Application to construct a commercial project consisting of 135,000 s.f. of retail tenant space arranged in 7 detached buildings ranging in size from 5,800 s.f. to 63,400 s.f., installation of on-site storm drainage collection, treatment and detention systems, septic treatment facility, leaching field, public water system and utilities.
The main anchor tenant would be a Big Y supermarket

Attorney David Royston, representing the applicant, summarized the application.
Attorney Royston updated the Commission members about the status of Center Road West in regard to the adjustment of ownership lines. Mr. Royston stated that the resubdivision of a portion of Center Road West has not been conveyed yet and they still need various approvals for permits.
David Ziaks, engineer from F.A Hesketh & Associates, showed the Commission members colored site plan renderings. The drawings showed the boundary survey, full layout of the site and the erosion control plan. Mr. Ziaks said he reduced the impact to the regulated area and changed the tenant store location to provide the architectural treatment desired by the Town. Mr. Ziaks also mentioned that all the buildings would be 1 story high. Mr. Ziaks said he has included an alternative to reduce the parking spaces by 25% if the Town Planning Board subsequently allows this to incorporate more landscaping in the parking area.
Paul Smith asked about the small wetland located at the bottom embankment on Spencer Plain Road. Mr. Ziaks said his wetland scientists said the wetland area in that location was not a vernal pool.
Mr. Ziaks talked about the storm water pond outlets, where they would connect, and where they would discharge. Mr. Ziaks mentioned that the storm water ponds will be connected underground with plastic piping to drain water to the outlets. Mr. Ziaks said he will bring expert consultants to address the septic system and the leaching concerns.
Paul Smith stated that this meeting would be to accept the application. Mr. Smith asked Mr. Ziaks to show the stock pile area on the plans as well as the erosion sediment control plans to protect the wetland area for the next meeting on February 16, 2006. Mr. Smith said the plans should show the construction access area and the stone anti-tracking pad for the vehicles.
Brendan McKeown mentioned his concern with the applicant’s proposal to fill and pave a small wetland area located in the parking lot. Mr. McKeown asked the applicant to look for alternatives that would eliminate the need to fill that area.

B. Preliminary Discussion – Olek Golinowski, LLC.
Informal discussion was requested by Mr. Olek Golinowski, LLC. to review a proposed
subdivision into residential building lots.
Bokum Road, (Map 61, Lot 13, &1)
Residence AAA District
Maurice Woodworth, P.E. of Woodworth & Associates, spoke to the Commission
members about his applicant’s desire to build 8 residential, single family homes on
approximately 1 acre lots. Mr. Woodworth said numerous test holes have been dug on
the property, none within the wetlands and the tests show the area to be desirable for building houses with septic systems.
Mr. Woodworth mentioned that in order to access the property without crossing a small existing wetland at the property frontage, he had to get permission from a neighbor to pass through their yard. The applicant is in front of the IWWC Commission to see what might be required to get a permit to cross the wetland area in order to access the property from Bokum Road. Mr. Woodworth said there would not be any other interference or disturbance to the wetlands, and all the proposed house lots would be outside the regulated wetland area.
Robert McIntyre mentioned that the storm water runoff may present an issue and would need to be addressed as to where it would be discharged. Paul Smith said that sheet flow is more desirable than 500’ feet of piping.
Mr. Smith stated to the Commission members that if this proposal becomes an application, it would come before the IWWC Commission because of the need to cross the wetland area. Without the crossing, there is no immediate access to the property from Bokum Road.
C. 05-027 Summit Residential, LLC.
Application for a new outlet channel for existing stormwater basin.

ACTION: Accept application if complete, determine if significant activity
and if Ordinance 71 fees required.
Matt White, engineer for the applicant, came before the Commission members this evening
to informally discuss an existing drainage ditch that is overgrown with brush and trees which is causing the water to overflow and runoff in the wrong direction. Mr. White said the bio-filtration basin recently constructed by his client is not functioning as originally planned, or as approved by the Commission.
Paul Smith said that it was appropriate for any basin work in the wetland area and regulated upland review area to come before the IWWC Commission as an application.

C. Town of Old Saybrook – Town Park temporary pedestrian bridge
170 Schoolhouse Road (Map 47, Lot 6)
Larry Bonin, head of maintenance for the Town of Old Saybrook, asked Damon Hearne,
IWWC Enforcement Officer if he would present to the IWWC Commission, the need for
a temporary walk-way over a section of wetlands for a pedestrian crossing in Town Park.
Mr. Bonin told Mr. Hearne that pedestrians have laid a picnic tabletop and other materials over this wetland section so they can cross without stepping in the water.
Paul Smith suggested that this specific matter be dealt with administratively between the IWWC Enforcement Officer and the Town of Old Saybrook Public Works Department.
MOTION to have wetland disturbance relative to crossing over a section of wetlands in Town Park, 170 Schoolhouse Road (Map 47, Lot 6) be dealt with administratively between the IWWC Enforcement Officer and the Town of Old Saybrook Public Works Department. MADE by Paul Smith. SECONDED by Robert McIntyre. A discussion on the motion resulted in a condition that this action not establish a precedent or approval for future matters of this type to be handled administratively. IN FAVOR: F. Reichart, W.
