A. 05-016 “The Preserve” – River Sound Development, LLC.
Application to construct open space subdivision, country club, golf course
community (934 ac. total) & open space (542.2 ac.) within 100 ft of wetlands.

ACTION: Accept application if complete, determine if significant activity and if

Attorney Royston spoke to the Commission members stating that the application, materials and maps have been distributed and additional copies of the application will be delivered this evening so all the members will have copies to take home and review. Attorney Royston asked the Commission if they could determine if the application is complete, if it will be deemed a Significant Activity, and if Ordinance 71 fees will be required. Attorney Royston also asked the Commission if they could discuss potential scheduling for the public hearings.
Chris Costa told the Commission members that the application was complete. Paul Smith and the members discussed dates for the first and subsequent public hearings since the application would be deemed a Significant Activity.
The first public hearing will be scheduled for 7:30 p.m. on Thursday October 20, 2005 and be held at the Old Saybrook Middle School. Subsequent hearing dates will be every Thursday evening, October 27, November 3, November 10 and continue until the public hearing is finished. The times will be announced.
The Commission members agreed to require Ordinance 71 fees from the applicant. Judy Preston asked Chris Costa to e-mail a list of consultants so the Commission could determine who would be best qualified for technical assistance, golf course design, soil scientists, engineers and legal advice. Mr. Smith asked that all consultant reports for the Commission be submitted no later than September 29 to allow adequate time for review by the applicant.

B. 05-017 Christopher Lewis
Application to construct a 2 bedroom house and sanitary system withing 100 ft.
of wetlands.

ACTION: Accept application if complete, and determine if significant activity
and if Ordinance 71 fees required.
Attorney Royston stated that this application involves 2 separate lots on Clark
Avenue. The applicant is a contract purchaser for the 2 lots which are owned
by two separate individuals. The lots, when combined, would be non-conforming and would require a variance from the Zoning Commission for the house to be built.
Darcy Collins, engineer for the applicant, showed the Commission where the
combined lots were located within the Chalker Beach area. Richard Snarski, soil and wetland scientist flagged the wetland area and verified it as an inland wetland and not a tidal wetland. Ms. Collins passed out revised plans to the Commission members which showed the house in a flood zone which would require the house to be built on piers.
Paul Smith asked what type of plantings were on the lots. Ms. Collins stated that the 2 lots were mostly wooded, some red maples which would not be cut down and invasive Phragmities. Judy Preston asked what type of existing vegetation was on the surrounding properties. Ms. Collins said the southwest side of Chalker Beach was lawn, east and north sides were lawn and invasive Phragmities existed in the rest of the areas.
Judy Preston asked if there were any restrictions to the lots. Attorney Royston said a title search had not been done yet, but according to the deed there were not any restrictions. Attorney Royston mentioned that he would be doing a title search to confirm that there were not restrictions and he also mentioned that the Commission members that they had permission from the applicant, to walk the property.
The Commission members felt that Ordinance 71 fees were not required for this application. After some discussion, the members decided to deem the application a significant activity which would require a public hearing.

The applicant was not present at the meeting so the Commission members were not able to ask questions. Paul Smith mentioned the graphic which accompanied the application was unclear and did not show sufficient information. It did not show elevation details, erosion control and other pertinent information. As a result, Mr. Smith asked the office staff to contact Ms. Duchemin and inform her that the application could not be accepted.

IV. PUBLIC HEARINGS
A. 05-008 Blue Point, Inc.
Application to construct a single family 4-bedroom house with attached 2-car
garage, driveway, utilities, subsurface sewage disposal system.

ACTION: Deliberate Application
David Annino, licensed land surveyor for 4 years, was present and acting for
the agent Joseph Wren, P.E. who was not available for this meeting. Commission
members reviewed the application and summarized last months testimony by a neighbor and the existing roadway which is the entrance to the property and abuts the wetlands. After reviewing the site, Geoff Jacobson, engineering consultant for the Commission, sent a letter suggesting a “rise” be placed in the driveway and sediment traps be placed at the low point of the driveway to contain water runoff.
Kim Gallagher mentioned that she was in favor of the application and would like to accept the piece of land the applicant offered to the town of Old Saybrook.
The Commission members were not able to vote because there was not a quorum present that had attended the public hearing or reviewed the tapes. The application was continued to the next regularly scheduled meeting on September 15, 2005 at the Pasbeshauke Pavilion at 7:30 p.m. to give the Commission members time to review the tapes from the previous meeting.
B. 05-013 Michael Evangelisti
Application to construct a 3-bedroom house, sanitary system, and driveway.

ACTION: Open Public Hearing
The public hearing was opened and Darcy Collins, licensed engineer for the applicant, spoke to Commission members. Ms. Collins stated that the wetland area on the property exists in a “mowed” lawn condition. Ms. Collins states that it is the opinion of Richard Snarski, soil and wetland scientist, and Geoff Jacobson, licensed engineer that the wetland area on the property is for the conveyance of storm water. A 15” pipe discharges water under Bokum Road and into the catch basin east of the wetland area. Ms. Collins passed out a letter dated August 8, 2005 from Geoff Jacobson to Chris Costa stating that the wetland area is of “no value” except for the conveyance of storm water.
The applicant, Michael Evangelisti spoke about his desire to build a house for his son on the property and passed out supportive letters from his neighbors, Raymond Schaffer of 56 Bokum Road, Edmond Yeager, Jr., of 55 Bokum Road and Steven Scagliarini of 61 Bokum Road.
Brian Bagnati of 72 Bokum Road spoke against the proposed house; he was concerned with overland flooding. Mr. Bagnati stated that the 15” pipe does not accept all the water runoff and his yard floods from the grass ditch. Mr. Bagnati said it is not just rain water runoff coming out of the pipe, he has observed brown colored water as well.
The test holes shown on the current plans were dug in 1989. Paul Smith asked Ms. Collins to do new test holes to determine the current soil type and groundwater conditions. Judy Preston asked that the new test holes and data be complete and available for review at the next regularly scheduled meeting. Ms. Preston also asked if the proposed septic system could be moved toward the front of the house, away from the wetland area. Ms. Collins said it is beneficial to have the septic system down gradient from the house and away from the foundation. However, she agreed to prepare an alternate plan that shows the septic system in front of the house.
Geoff Jacobson, engineering consultant, provided a memo suggesting the use of a crushed stone anti-tracking pad, the extension of the silt fence to run further down the northern property line and a drainage easement with rights to discharge if necessary. It was noted that the current plan addresses all of Mr. Jacobson’s comments except the need for a drainage easement that was deemed to be inappropriate.
The Commission members continued the public hearing until the next scheduled meeting on Thursday September 15, 2005 to give adequate time for Ms. Collins to perform additional test holes and the results to be reviewed by the Commission members.
V. OLD BUSINESS
A. 05-010 Darren J. Courtright
Application to construct a 2-bedroom house, sanitary system, and perform
associated grading within the Inland Wetland regulated area.

ACTION: Continue application review.
Darcy Collins, licensed engineer for the applicant, passed out revised
plans and addressed a question raised at last months meeting regarding the land at elevation # 4, the area west of wetland flag 21, 22, and 23. The DEP said certain conditions needed to exist for them to have jurisdiction over the land below elevation 4. Messrs. Snarski and Jacobson have determined that the conditions listed by the DEP do not exist in the area below elevation 4 so the house could be moved and the back area planted with vegetation. The Commission members liked the house location change. Judy Preston felt it would be beneficial for a stipulation to be placed on the deed to eliminate any future owners from cutting the vegetation and putting a lawn in that area.
Robert McIntyre asked the Commission members to extend the application for further review but meet sooner than the next regularly scheduled meeting in September. The Commission members agreed to meet for a special meeting on Thursday August 25, 2005 at 7:00 p.m. at the Town Hall, 302 Main Street, Old Saybrook, CT. to review and act on this application.
B. 05-014 Red Fox, LLC
Application to add gravel to specified parking area; plant perimeter buffer with trees, and add fence around wetlands to prevent incursions.
