DEP comment review
Review of DEP comments
They would like:
The standards distributed through out the plan relocated “ to the best practice for this area” sections, however The Commission wants to also place the entire standards as an addition to the plan
The Commission to add verbiage and map to define open waterfront area.
C.        To add written clarification of tidal wetlands rule defined better as marsh areas;
D.      To add the definition of restricted tidal navigation and tidal wetlands; a restricted navigation area with no wetlands or marsh area
E.      Add map

Note: Dock Design Considerations will be added as chapters 8. Ordinances 9 and final amendment and revisions chapter will be attached as an annotation; an appendix of the recommendations for mooring specifications and location of approved mooring areas.

Answer to number one is a scrivener error with respect to the reference of an “Appendix” and then the ordinances will be added as a chapter rather than an appendix.
Chapter 3 is actually becoming Chapter  8
Under Dock Standards, maneuverability of vessels section eliminate first sentence and the last two sentences.
Under impacts changes “has to had”.
Under open waterfront second paragraph change these to some and would to could
Under Specific Area Objectives (mid page 6) take out “Best practices for this area. Maintain the status quo”.
Use their language in parenthesis as the detail (they are second only to rainforest in overall biological productivity, CT has lost tidal wetlands over years, invasive plans are a big problem in lower CT River.)
Add “shall not include docks” taking out “will be gained through nonstructural “
Include a map that includes all creeks
10.     Done
11.     Replace language that was removed
Leave area  for future uses
Page 8 “ Best practices….remove status quo”
Remove “is imposed by another regulatory body”
Response is - 150% of the allowable float square footage (see DEP Coastal Permit Program Residential Dock Guidelines Design) Considerations which states “generally 100 square feet”
Take out ‘cabana and gazebo…any” and leave  structure or apparatus …
Good as is.
Add their language “neither float nor vessel may extend beyond riparian line generally except for shared docks”.
Write maximum length 25% measured from the edge of the marsh.
Put specifics back in.
Take out the first bullet page 10 change walkway width to 36” and height to  36” and take out last bullet
Attach map
As per 21 (36”)
Remove “not”
Take out the bullet

Change definition of houseboat back to original

The above detailed changes will be made to the proposed Dock Standards and Harbor Management Plan additions and that document will be brought back to the Commission for final review before submission to DEP

MOTION- GINA STILLMAN MOVED TO ADJOURN AT 9:35 P.M.

Respectfully submitted,

Ruth Hockert, Clerk
