IV. REGULAR BUSINESS
14-001“Sorensen” Registration for Regulated Activity
430 Middlesex Turnpike (Map 52 / Lot 41-1)
Applicant: Robert C. Sorensen; Agent: ~Joseph Wren, PE
Sandy Prisloe summarized the status of the application. The question before the Aquifer Protection Agency is whether the activity at this location is a regulated activity. Prior to this meeting S. Prisloe had conferred with Kim Zapla, the Aquifer staff person at DEEP, to determine if the Applicant can register a facility beyond the 180 day period. The answer was yes, that there is a five year period after the approval date, in this case March 2011, in which a facility conducting a regulated activity may register.
Joseph Wren, PE, representing the Applicant Robert Sorensen, asked that the Agency approve registration of the existing activity. He referred to page 3 of the Applicant’s “Application to Register a Facility or to Permit Activities in an Aquifer Protection Area”, and explained that the following activities have taken place on the property before and during Mr. Sorensen’s ownership:
- oil or petroleum dispensing for the purpose of retail, wholesale or fleet use
- repair/maintenance of vehicles or internal combustion engines of vehicles
- car or truck washing (unsewered)
J. Preston asked that the first checked item on page 3 be removed from list of regulated activities:
- oil or petroleum dispensing for the purpose of retail, wholesale or fleet use
J. Wren and R. Sorensen agreed to this request. J. Wren then read into the record a portion of a letter from the Applicant’s legal counsel, Donald Tamis, dated March 12, 2014 pertaining to activity on the Sorensen property dating back to 1977, to demonstrate that mechanical repairs have been performed continuously on this property from 1977 to present.
MOTION to ACCEPT Application 14-001 “Sorensen” Registration for Regulated Activity, 430 Middlesex Turnpike (Map / Lot 41-1); Applicant: Robert C. Sorensen. Agent: Joseph Wren, PE; MADE: by E. Steffen; SECONDED: by C. Wehrly; VOTING IN FAVOR: J. Preston, C. Wehrly, W. Smith, E. Steffen, C. Heffernan; OPPOSED: None; ABSTAINED: none; APPROVED: 5-0-0.
S. Prisloe clarified that the regulated activity must be registered every five years.
