I.        CALL TO ORDER

Chairman, Paul Smith, called the regular meeting to order at 7:32 p.m.

III.    OLD BUSINESS

        #12-001 “Tractor Supply Company” Regulated Activity for                                                   Commercial Construction
                401 Middlesex Turnpike (Map 52 / Lot 96)
                Applicant: New England Retail Properties; Agent: James Cassidy, PE



        
        Applicant: New England Retail Properties; Agent: James Cassidy, PE

William Pollack recused himself from the meeting.

James Cassidy, PE with Hallisey, Pearson & Cassidy of Rocky Hill, CT, represented the applicant. He referenced the December 17, 2012 letter from Kim Czapla of the CT Department of Enegry & Environmental Protection (DEEP). In this letter, Ms. Czapla concluded that the three activities in question by TSC are not regulated under the Aquifer Protection Area Program and therefore TSC is not required to register. These activities are:
1. dispensing of oil or petroleum
2. repair or maintenance of vehicles
3. accumulation or storage of waste oil

Kim Gallagher asked if other areas were discussed.
J. Cassidy replied that these specific uses were discussed.
Judy Preston asked if applicant sells pet feed and garden items.
J. Cassidy replied yes, pesticides are sold at retail quantities.

Paul Smith summarized by stating that from a legal point of view, the outcome is that there is not a regulated activity proposed to take place on the property that is regulated by APA guidelines.

MOTION to accept Application #12-001 “Tractor Supply Company” Regulated Activity for Commercial Construction; 401 Middlesex Turnpike (Map 52/ Lot 96) Applicant: New England Retail Properties, Inc.; Agent: James Cassidy, PE for Determination of Regulatory Status and determined that no regulated activities will occur and no further action on the part of the APA is required; MADE by P. Smith; SECONDED by C. Wherly; VOTED IN FAVOR: J. Esty, C. Wehrly, P. Smith, K. Gallagher, J. Preston;  OPPOSED: none; ABSTAINED: none; APPROVED: 5-0-0.

MOTION to approve the minutes of November 15, 2012 as presented.; ; MADE by C. Wherly; SECONDED by J. Esty; VOTED IN FAVOR: J. Esty, C. Wehrly, P. Smith, K. Gallagher, J. Preston;  OPPOSED: none; ABSTAINED: none; APPROVED: 5-0-0.

In their packets, Commissioners received:

C.      Committee, Representative & Staff Reports
        APA decided to hold elections of officers in January 2013.
