VI.     PUBLIC HEARINGS

  • Petition to AMEND the Old Saybrook Aquifer Protection Area Regulations pursuant to amendments to Public Act #10-135.  Amend Sections 4.4 and 8.1 regarding timelines and registrations for municipally owned sites undergoing remedial action pursuant to 40CFR 271.

Christina Costa, ZEO reported that the text went into effect in October of 2010 and the DEP has requested that municipalities amend their APA Regulations to reflect such changes in text.  The ZEO also suggested that the DEP model for numbering Aquifer Protection Regulations be used for Old Saybrook Aquifer Protection Area Regulations so as to create uniformity.  The APA  members reviewed the positive responses from the Planning Commission, Connecticut River Estuary RPA, Branse, Willis and Knapp and the D.E.P.

MOTION to amend the Old Saybrook Aquifer Protection Area Regulations pursuant to amendments to Public Act #10-135.  Amend Sections 4.4 and8.1 regarding timelines and registrations for municipally owned sites undergoing remedial action pursuant to 40 CFR 271, Effective April 1, 2011; MADE: by R.   • Discussion to recommend to the Board of Selectman to consider amending the Code of the Town of Old Saybrook by amending Section 2-1, Aquifer Protection Agency (APA) by removing the Zoning Commission as the APA and designating the Inland Wetlands and Watercourses Commission as the designated APA for the Town of Old Saybrook.
The Commission discussed that the Inland Wetlands and Watercourses Commission was, procedurally, a better fit in overseeing the APA.  The ZEO would remain the Aquifer Protection Agent for the Town of Old Saybrook until Sandy Prisloe, the Old Saybrook Environmental Planner became certified.  There was no public comment on this issue.

VI.     COMMITTEE, REPRESENTATIVE & STAFF REPORTS

        The ZEO reported that the March, 21, 2011 meeting may be cancelled if there is no business.  It is anticipated that in the April, 18th meeting, she may have registrations on which to report.  R. Friedmann has been researching properties to determine businesses that may need to register.

VII.    ADJOURNMENT

Chairman Friedmann adjourned at 10:20 p.m. until the next regularly scheduled meeting to be held on Monday, March 21st, 2011 at the Old Saybrook Town Hall First Floor conference room, 302 Main Street at 7:30 p.m.
