I.      CALL TO ORDER

David Wight called the meeting to order at 7:34 p.m.  Three members were seated to vote and two members arrived later.

MOTION to amend agenda to add “Dagmar Deserts, LLC” as New Business item “III, A-1”.  MOVED by David Wight; SECONDED by Elizabeth Swenson;  IN FAVOR:   D. Wight, K. Snow, and E. Swenson; OPPOSED:  none.  ABSTAINED: none  APPROVED:  3-0-0.

III.    NEW BUSINESS

  • “Central Gallery”  Sign
        100 Main Street (rear)/Coulter Street (Map 37/Lot 101)  
Business B-1 District
Applicant/Agent: Hillary Seltzer

Ms. Seltzer is using an existing sign design that she used on a previous building where her business was located here in town.  Ms. Swenson asked about planting/landscaping.  Ms. Seltzer said the a/c unit and the "For Rent" sign are being removed and she will be planting shrubs to spruce up the outside.  Chairman Wight suggested aligning the top of the sign with the top of the window, or moving the sign over the window and adding a trellis on the blank wall space.   

MOTION to recommend approval of the sign with the stipulation that the top of the sign be aligned with the top of the window trim and equally spaced between the edge of the building and the window trim.  MOVED by David Wight; SECONDED by Kingmon Snow;  IN FAVOR:   D. Wight, J. Gibbs, E. Swenson, and K. Snow; OPPOSED:  none.  ABSTAINED: none  APPROVED:  4-0-0.

A-1.            “Dagmar Deserts, LLC” Signs

The board is pleased with the sign design and placement.

MOTION to recommend approval of the signs.  MOVED by Elizabeth Swenson; SECONDED by Jonathan Gibbs; IN FAVOR:   D. Wight, J. Gibbs, E. Swenson, and K. Snow; OPPOSED:  none.  ABSTAINED: none  APPROVED:  4-0-0.

B.      “Incentive Housing Zone” Zoning Regulation Amendment
        Petition to adopt new Section 54 Incentive Housing IH Zone and amend Section 9 Definitions to add definitions of:~ Commission, Developable land, Underlying district, Diverse uses,     
        Duplex, Multi-family dwelling, Single-family dwelling, Two-family dwelling, Townhouse dwelling, Incentive housing development, Mixed-use development and will.

ACTION: Report for 7/20/09 ZC p.h.

Chris Costa, ZEO, explained that Section 9 is the text and definitions that will enable the adoption of the zones.  She reviewed the changes that were made to meet the State of Connecticut Statute. The Board had the following suggested changes:
54.8.2   Setbacks From Rear Property Line.  Distance for rear property line increased to 20 ft unless lesser in the underlying zones  
54.8.3  Setbacks From Other Property Line. Underlying district is residential or B-3 consider allowing zero foot other setbacks.  This may be considered to encourage individual ownership.
54.9.1A   Building/Structure Coverage.  The Zoning Commission should clarify the 10% increase i.e.: (10% increase of an existing 20% should be 30% not 22%)
54.9.2   Maximum gross floor area be increased by 10% as well
54.2.2.   Recommend on street as well as off street parking as part of the design standards.
No comments regarding the new “Definitions”

C.      “Incentive Housing Zone” Zoning Map Amendment
        Petition to amend Zoning Map to adopt the Ferry Point Incentive Housing Overlay Zone, 108 acres total (23.9 acres developable) overlaying portions of the Residence A, Marine   
        Commercial M-C, Shopping Center B-2 Zone and Industrial I-1 Zones.

Christine explained the purpose behind the new map and the areas affected with the overlay zones.

MOTION to send a favorable response to the Petition to amend Zoning Map to adopt the Ferry Point Incentive Housing Overlay Zone, 108 acres total (23.9 acres developable) overlaying portions of the Residence A, Marine Commercial M-C, Shopping Center B-2 Zone and Industrial I-1 Zones with the understanding that it is the first of a series of incentive housing zones.  MOVED by Jonathan Gibbs; SECONDED by David Wight;  IN FAVOR:   G.Pendleton, K. Snow, and D. Wight; J. Gibbs, E. Swenson OPPOSED:  none  ABSTAINED: none  APPROVED:  5-0-0

  • “Town-wide Design Standards” Zoning Regulation Amendment
        Petition to amend Section 3 Certificate of Zoning Compliance~and Section 7 Area, Location & Bulk Standards;~remove Section 8 Additional Standards;~amend ARTICLE VI     
        Town-wide Design Standards, including Section 61 Performance Standards, Section 62 Access, Circulation, Parking & Loading, Section 63 Landscaping, Screening & Buffering.

Chris explained the changes made to the regulations necessary to clarify and consolidate the existing regulation text to allow for the new Design Standards.

Access Parking and Loading – Revise regulation to allow for on street parking spaces in the count of required parking spaces which would encourage the provision for on street parking.

In the future ARB strongly feels the ZC should change the definition of height in a manner that would not discourage sloped roofs. ARB suggests that the new definition will calculate the maximum height of a structure by calculating the average slope of the roofs while reducing the overall allowable heights of buildings accordingly.
