Chair Mike Russo called the meeting to order at 7:00 pm, explained the nights proceedings and with agreement from the Board members proceeded to open the public hearing for the case:
Case 10-03-AV Application from Andrew & Caryn Anderson for a Area Variance to Article VI Section A.Z & Section E, to allow a inground pool that will have a side setback of 20’ instead of 50’ and a 40’setback instead of 50’ from Hydric B soils. The lot in question is located at 20 Camelot Court, identified as Tax Map 38 Lot 43, and is owned by Andrew & Caryn Anderson.
Mr. Anderson presented the sketch of the property noting different points of reference and what they were asking for. He noted that they are in a cluster devolvement and the lot is irregular. He also noted a rough idea of the 200’ setback for the community well which is behind their house. He also stated that the hydric b soil area is currently dry but does pool in a small area in spring. The Board reviewed photos of the property referencing them on the sketch.
Mr. Russo called for questions from the Board. Mr. Morin asked about the watershed between the properties between their property and Mr. Cooke’s. Mr. Anderson explained that what fill comes out of the pool area will be used to level the walkway during construction. Mr. Anderson noted that they are currently leaving the deck the size it is for now.
Chair Russo confirmed that the DES has stated that they did not need to be involved in the variance for the setback to the hydric b soils.
Mr. Cooke asked about the 50’ setback if that was unique to Nottingham. Discussion was on other towns’ setbacks that are much lower around 15-20’. He also stated he had no objections to this variance.
Mr. Danais stated that the may have water pooling during construction. Ms. Anderson noted that the pool installation company has been advised of the hydric soils and believes it won’t be an issue.
Chair Russo read the applicants answers to the criteria for the variance. The Board agreed that all the criteria had been met.
MOTION by Mr. Danais to approve Case 10-03-AV Application from Andrew & Caryn Anderson for a Area Variance to Article VI Section A.Z & Section E, to allow a inground pool that will have a side setback of 20’ instead of 50” and a 40’setback instead of 50’ from Hydric B soils.
SECOND by Mr. Morin
VOTE 4-Aye. 0- Opposed – 0-Abstained MOTION PASSED
It was noted that there is a 30 day appeal process. They briefly discussed that the dimensions approved need to be accurate and should be conveyed to the contractor. Mr. Anderson agreed.

The Board tabled the minutes until more members are present to review and approve.
