Chair Stockus called the meeting to order at approximately 7:04 pm. Chair Stockus noted that he asked Mr. Colby to attend tonight’s meeting. Mr. Colby gave a brief description of his job experience and titles; Building Inspector & Code Administrator. He noted that his job description says that he is to advise the Planning Board and Zoning Board. He noted that he has degrees in building construction, and fire protection & fire administration. Chair Stockus advised the Board that they may be able to use Mr. Colby in his Code Administrator capacity, if needed.
Ms. Smith asked about Mr. Colby’s schedule and workload. Mr. Colby stated that he now has time to assist the Board, now that the Pandemic Plan he was working on is completed.
Review of Minutes

Review of Submissions from: Case # P07-08-SUB: Little River Realty Trust, Case # P07-09-SUB: Leonard Giles Revocable Trust
The Board started with the Memo from Jack Mettee dated February 1, 2010 for the Compliance Review for the Howard Subdivision and the set of Plans dated March 11, 2010. They also reviewed the response letter from Jones & Beach dated March 10, 2010. It was noted that the both projects were reviewed by Mr. Mettee relevant to the Subdivision Regulations dated 2006.
The Board reviewed each item in the memo noting which items were completed and which issues still need to be addressed with the applicant at the April 21st public hearing. Some of the issues to be discussed at the next public hearing are:
For the Howard Subdivision: need Site Specific Permit status; when was the date of the Intent to Cut; the need to address who will handle the maintenance of the basins/retention ponds on the property including a written agreement for that; the need for a waiver or not for sewage treatment areas that extend beyond the buildable area & test pits in the septic reserve area; the need for buildable areas and setbacks to be noted on plans SD1, SD2 and TS1.
Also noted for both subdivisions was the need for how best to make sure that it is clear that one subdivision can’t be developed without the other as they depend on each other to meet the access/egress requirements. The Board discussed different ways that this requirement could be met: notes on each set of plans, a formal agreement with the applicants, a request for a waiver from the applicant or all of the above. The Board agreed with Mr. Mettee on the importance of this requirement.
The Board also reviewed the letter from the Conservation Commission dated July 8, 2009: they noted the need for flagging and monitoring of the deed restricted areas. They would also like a status update or final notice of who will be holding the conservation easement and the third party monitoring the project.
For the Giles Subdivision: there was a lengthy discussion on the need for a waiver and the status of the Town’s regulations for wells in the setbacks vs. wells in the buildable area; the Board read and discussed the Planning Board’s Notice of Determination of June 26, 2007 (wells are not structures) and an email with Mr. Mettee’s opinion on the matter; Mr. Colby stated that he believes the subdivision regulations (Section IV, F. 2006) are in conflict with the Zoning Ordinances; Mr. Bacon noted that the well locations are likely to change during construction; he also noted that the well radii that go over lot line’s will be handled in accordance with the State law/permitting process.
Mr. Colby believes that the well heads meet our requirements. Some Board members believe a waiver may be needed on some lots, but that will depend on the final locations of some wells. Ms. Smith noticed that there is a lot with a small portion of the well radius in the septic (4K) area. Mr. Bacon noted that the State subdivision approval process should pick that up and ask for it to be corrected (Lot 31-8).
The Board acknowledged that the note on plan SD1 needs to say Stage Road not Gebig Road. Ms. Smith would like the applicant to verify some of the notes on the Existing Conditions Plan in regards to the natural features and the Alteration of Terrain during construction. The Board again discussed the retention ponds & their maintenance, storm water management, septic systems and wells, test pit data with similar issues already discussed on the review of the Howard plan.
The Board will confirm the language for the cistern easements. The Board finished the review of the Conservation Commission letter from July 8, 2009. As a result the Board will discuss with the applicant some of those issues raised. Also, Ms. Smith and Ms. Mooney would like to review, with the applicant, the suggestion to move the access to the Town lot in the back of the conservation area. They noted that it currently will be difficult to get to as you must go through wetlands to get to the upland. Ms. Smith had a plan from February 23, 2007 that had an alternate 20’ foot path access which did not cross as much wetland and would have direct access to the property that the Town already owns. The Board agreed to discuss, with the applicant, the alternate access to the town property because it is currently not in the
ideal location.
The Board noted that the tables need to be revised on SD1-4, they also need to make the easements more clear on the drainage and fire cistern easements on Lots 31-1 and 31-2. It was also noted that it would be helpful to have hatch marks added to the construction easement on the legend. They also noted that TS1-TS5 need minor adjustments to the legends and plan notes, per Mr. Mettee’s review.
On Plan TS1, the Board would like to confirm the source information on the design infiltration rate, on the plan notes, with the applicant.
It was noted that the engineering review discussion will be done at the April 21st public hearing.
Mr. Colby informed the Board of some Building Code changes going into effect April 1, 2010: the changes to Home Occupations/Live-Work Unit sizes & fire sprinklers installed.
Mr. Colby also updated the Board on the increase in permits being issued in 2010: 12 new houses to date this year.
Given the late hour, Chair Stockus suggested tabling the rest of the agenda. The Board agreed.
