Chair Canney called the meeting to order at approximately 7:05 pm.

The Board tabled the minutes for March 25, 2009, to allow the Board time to review them. Chair Canney opened the public hearing for:
Concept review for: Matt Curry-14 King Fisher-Tax Map 23 Lot 13- possible subdivision on a private road
The owner of the property, George Robinson explained that he owns about 34 acres (TM23 Lot 13) on King Fisher Road and would like to cut off (subdivide) about 5 acres for his son Matt Curry to build a home on. He asked the Board what needs to get done so that he may do that. The Board noted that King Fisher Road is a private road. Mr. Robinson did not know who owns the road. The Board reviewed RSA674:41. They noted there were no existing subdivisions on the road, the house was built in 1982 and that the road was approximately 600-700’ and there were 3 existing homes on this road. Mr. Robinson noted that King Fisher Road was in much better condition than Swan Road which is the Town Road that King Fisher comes off of.
Discussion was on where the applicant would go to first. It was noted that the Board of Selectmen’s (BOS) approval was not needed until the land had been subdivided, in order to get the building permit. The RSA also discusses the liability issue for the Town and the need for a waiver from the applicant.
The conclusion, upon the review of the RSA was that the applicant should first confirm that the mortgage company and insurance company would approve building on a private road, if they met that hurdle then they would have to apply to the Nottingham Zoning Board of Adjustments (ZBA). It was noted that they do not need a certified plan to go before the ZBA but could use a sketch of the plan. The Board reviewed which sections of the Zoning Ordinances they believe he should apply for: Section VI.A.1.a for “frontage” can not be met due to the private road. They may also need “b.” as well. If this was approved by the ZBA then the applicant would have to come back to the Planning Board for the Subdivision approval process and approval from the BOS for the Building Permit on a Private Road.
During the discussion, Ms. Chauvey noted there have been similar cases (La Pointe ’07? & Longueil ‘08) and the Planning Board should develop a policy for this issue. Mr. Russo from the ZBA was present and agreed that the applicant’s first step in the Town’s process should be the ZBA.
Scope of Services for the Impact Fee Study-New Committee
The Board reviewed the draft of the Scope of Services for the RFP for the impact fee study that Ms. Chauvey presented. The Board agreed to the dates/timeline she proposed but changed the due date to Friday, May 1st.
They also discussed forming a Planning Board/Impact Fee Study Steering Committee (PB-IFSSC) to assist the Planning Board when making recommendations to the BOS.
Mr. Russo noted there is good information in the HUD publication Impact Fees & Housing Affordability. Ms. Chauvey also noted Impact Fee Development for NH communities. Mrs. Sears will print out the large documents for distribution for the Planning Board.
MOTION: by Mr. Canney to form this Planning Board/Impact Fee Study Steering Committee which should include members of the public as well as representatives from the Budget Committee, ZBA, Capital Improvement Committee, School Board as well as the Planning Board.

Ms. Chauvey, Mike Russo and Chair Canney would like to be on this committee. Mrs. Sears will do a write up to announce this committee. Deadline for this committee will be April 27th.

The Board did an overview of the draft document; Ms. Chauvey will amend it and return to next week’s workshop meeting to finalize it with the Board. It was noted again that there are two informative publications the Board members should review: Impact Fees & Housing Affordability and Impact Fee Development for NH Communities. Mrs. Sears will print them out and circulate to Board members. They noted there will be a need for public education on this issue and meetings for that purpose are requested in the RFP.
Joint workshop with ZBA
Vice Chair of the ZBA, Mike Russo came to discuss a possible joint meeting for the two Boards to discuss a possible policy on cases such as the King Fisher case from earlier tonight. They also want to discuss better communication between the two boards and how best to serve the applicant. Mrs. Sears will contact the ZBA members to see if a May 13th joint workshop meeting would be possible.
